COUNTY OF NEWPORT

 

The Town Council of the Town of Tiverton, County and State aforesaid held a Special Meeting on Wednesday the 18th day of March 2015 at 7:00 p.m. at the Tiverton Town Hall, 343 Highland Road.

 

MEMBERS PRESENT:

 

Council President deMedeiros, Vice President Chabot, Councilor Lambert, Councilor Mello, Councilor Pelletier, Councilor Perry and Councilor Sousa

Town Administrator Matthew Wojcik was absent

 

OPEN SESSION

 

Councilor Lambert motioned to enter into Closed Executive Session pursuant to RI Laws, 42-46-5(a) (1), Discussion of Interviews of Legal Services. Seconded by Councilor Sousa the motion passed on a vote of 6-1, Councilor Pelletier opposed.

 

The Council entered into Executive Session at approximately 7:05 p.m.

 

CLOSED EXECUTIVE SESSION:

Discussion of Interviews for Legal Services – 42-46-5(a) (1)

 

The Council returned to Open Session at approximately 8:10 p.m.

 

OPEN SESSION:

 

In Open Session President deMedeiros announced no formal action was taken in Closed Executive Session.

 

Councilor Pelletier motioned to seal the minutes of Closed Executive Session, seconded by Councilor Perry, motion passed unanimously.

 

Councilor Pelletier motioned to appoint the firm of Whelan, Kinder & Siket, LLP for labor counsel, Brennan, Recupero, Cascione, Scungio & McAllister, LLP for land use and Ursillo, Teitz & Ritch, LTD for general solicitor services.

 

Councilor Lambert requested each firm be taken individually. Councilor Pelletier was agreeable to serve as three separate motions.

 

Councilor Pelletier motioned to appoint the firm of Whelan, Kinder & Siket as Labor Counsel.  Seconded by Councilor Perry, motion passed unanimously.

 

Councilor Pelletier motioned to appoint the firm Brennan, Recupero, Cascione, Scungio & McAllister (BRCSM) for land use.  Seconded by Councilor Lambert the motion failed 2 to 5.  Councilors Lambert and Pelletier in favor, Councilors Chabot, Sousa, Mello, Perry and deMedeiros opposed.

 

Councilor Perry motioned, seconded by Councilor Lambert to appoint the firm of Ursillo, Teitz & Ritch for  general solicitor services.  Motion failed 2 to 5, Councilors Lambert and Pelletier in favor, Councilors Chabot, Sousa, Mello, Perry and deMedeiros opposed.

 

Councilor Perry motioned to appoint the firm of Anthony DeSisto Law Associates for land use.  Seconded by Councilor Mello, motion passed 6 to 1.  Councilor Pelletier opposed.

 

Councilor Perry motioned, seconded by Councilor Mello to appoint the firm of Anthony DeSisto Law Associates for general solicitor services.  Motion passed 5 to 2.  Councilors Lambert and Pelletier opposed.

 

Council President deMedeiros announced the Town Administrator will meet with the firms appointed in the morning and prepare an agreement of terms.  Attorneys DeSisto, Federico and Skwirz were in attendance.  Council President questioned if they would be ready to attend Planning Board meeting on Tuesday, March 24th.  Attorney DeSisto responded will be prepared.

 

Councilor Pelletier questioned if the letters received from Chief Blakey, Brian Janes of Open Space Commission and Stephen Hughes of Planning Board would be made public.  Clerk confirmed copies are available for public.

 

ADJOURNMENT:

 

Councilor Mello motioned to adjourn, seconded by Councilor Chabot, motion passed unanimously.

 

Council adjourned at approximately 8:20 p.m.
