Discussion ensues relative to Communication Item 7D dated July 13, 2012 from Steven Brown, Executive Director, RI Affiliate of the American Civil Liberties Union concerning a complaint from Deborah Bergner regarding rules governing conduct at Town meetings and requesting that the Town Council revise its policies.
Discussion ensues relative to Communication Item 7B dated July 5, 2012 from Lois Christy concerning foliage near utility lines on Tuckertown and Ministerial Roads.
Discussion ensues relative to Appointment Item 11B in regard to an appointment to the School Committee to complete a term to expire in November 2012.
Discussion ensues relative to the reappointment of JoAnne Blessing to the Recreation Commission.
Discussion ensues relative to the appointment of Robert Cagnetta to the Historic District Commission. The Solicitor tries to contact Nancy Letendre to see if she has spoken with Mr. Cagnetta in regard to resigning from the Zoning Board of Review.
It is requested that William Litvin be invited to interview on August 27, 2012 relative to his interest in serving on the Recreation Commission.
Discussion ensues relative to New Business Item 12J authorizing an award of bid to R.C. Systems Inc., 35807 Moravian Drive, Clinton Township, MI 48035 for the purchase of Recreation Data Management Software in accordance with all bidding specifications, in an amount not to exceed $12,700.
Discussion ensues relative to New Business Item 12N authorizing the Town Manager to execute individual Payment in Lieu of Tax (PILOT) Agreements for FY2012-2013 with The South Kingstown Land Trust, Welcome House of South County and The Jewish Children’s Home of Rhode Island (Camp JORI) in accordance with the Town Code, Chapter 17 Taxation, Article IV. Property Tax Exemptions and Payment in Lieu of Tax Agreements for Charitable Organizations, Section 17-45. Authorization; and to affirm the guidelines described in a memorandum from the Town Manager to the Town Council dated July 23, 2012 and entitled: “PILOT Program FY 2012-2013.”

A resolution authorizing an award of bid to JCI Jones Chemical Inc., 103 River Street, Warwick, NY 10990 for sodium bisulfite at the unit bid price of $1.57 per gallon; and as further described in a memorandum from the Public Services Director to the Town Manager dated July 9, 2012 and entitled “Bid Recommendation – Wastewater Chemicals (Bid Reference # SK0001WO).”
C. A resolution authorizing an award of bid to Univar, 175 Terminal Road, Providence, RI 02905 for sodium hypochlorite at the unit bid price of $0.6650 per gallon; and as further described in a memorandum from the Public Services Director to the Town Manager dated July 9, 2012 and entitled “Bid Recommendation – Wastewater Chemicals (Bid Reference # SK0001WO).”
D. A resolution authorizing an award of bid to International Dioxcide, 40 Whitecap Drive, North Kingstown, RI 02852 for sodium chlorite at the unit bid price of $7.99 per gallon; and as further described in a memorandum from the Public Services Director to the Town Manager dated July 9, 2012 and entitled “Bid Recommendation – Wastewater Chemicals (Bid Reference # SK0001WO).”
Discussion ensues relative to the presumed appeal to be filed by the Ocean Mist in opposition to the Town’s CRMC assent for the installation of the sheet pile sea wall in Matunuck.
Discussion ensues relative to the Town of South Kingstown’s comprehensive annual financial report for the fiscal year ended June 30, 2011 qualifying for a Certificate of Achievement for Excellence in Financial Reporting. It is the 22nd year that the Finance Director has received this award.
Discussion ensues relative to the Browning property and the management plan associated with that.
Discussion ensues relative to the Matunuck Oyster Bar and the purchase of land for parking from the State.
Discussion ensues relative to the Grand Opening for the new animal shelter. It is tentatively scheduled for Saturday, August 18, 2012 at 11:00 AM.
Discussion ensues relative to the fire horn at the Wakefield Fire Station and complaints from the neighborhood. A Public Informational Meeting has been scheduled for Monday, August 6, 2012 at 3:00 PM.
Discussion ensues relative to the formal wetlands application by Judith Savage. A resolution was on the June 25, 2012 agenda affirming and endorsing the recommendations made by the Conservation Commission to the RIDEM Office of Water Resources/ Permitting Section, Freshwater Wetlands Program in a letter dated June 19, 2012 concerning application #11-0226 by Judith C. Savage, 1852 Ministerial Road, AP 54, lot 49 for a residential dock facility. Said recommendations are further described in a memorandum from the Director of Planning to the Town Manager dated June 19, 2012 and entitled “Wetlands Application of Judith C. Savage, 1852 Ministerial Road, AP 54, lot 49 (proposed residential dock facility).”

Council President Whaley invites residents to come forward with comments.
Jonathan Daly-LaBelle is present and comments on the School Committee appointment and the letter from the ACLU regarding the Council’s rules of decorum.
9. TOWN MANAGER’S REPORT
Andrew Nota, Director of Administrative Services notes that the Town has received a Certificate of Achievement for Excellence in Financial Reporting from the Government Finance Officers Association. The Town Manager’s Interim Reports dated July 12 and July 19, 2012, and the Agenda and Miscellaneous Reports dated July 26, 2012 are accepted, approved and placed on file.
10. TOWN SOLICITOR’S REPORT
The Town Solicitor has no report this evening.
11. APPOINTMENTS
A. UNANIMOUSLY VOTED: to reappoint Joanne E. Blessing to the Recreation Commission for a term to expire June 2015.
