Notice of Special Meeting

 

MAY 27, 2020

 

 

 

 

            A Special meeting of the City Council was held on Wednesday, May 27, 2020 via Web-Ex.

 

            The meeting was called to order at 6:04 P.M. by the Council President.

 

Roll call showed the following members present:  Councilmembers Stycos, Hopkins, Vargas, McAuley, Donegan, Brady, Paplauskas, Council Vice-President Favicchio and Council President Farina -9.

 

           Also Present:  Daniel Parrillo, Director of Administration; John Psilopoulos, Deputy Director of Administration; Robert Strom, Director of Finance; Mike Igoe, City Controller; Christopher Rawson, City Solicitor; John Verdecchia, Assistant City Solicitor; David DiMaio, City Council Budget Analyst; Evan Kirshenbaum, City Council Legal Counsel.

 

            Council President Farina stated that the following questions were asked at the last meeting:

·         What would be last day we could potentially approve the budget?  Council President Farina stated that per Attorney Kirshenbaum and Assistant Solicitor Verdecchia, in reviewing the City Charter and all the data, they feel the last day we could potentially approve the budget would be June 14th due to the Charter provision that the 15th of June the Treasurer has to certify the Tax Roll in order to send out the tax bills.

·         Is there a possibility to potentially just approve the levy and send out the tax bills and not finalize the budget?  Chair stated that Solicitor Rawson and Assistant Solicitor Verdecchia both felt that that would be illegal, so that would not be an option.

 

Council Vice-President Favicchio indicated that both the Housing Finance and Senate Finance Committees are meeting.  He thinks that some movement has been made at the State level.  We do have a little time, but not much.  The most prudent thing to do would be to get as much information as possible from the State.  We do have the option to wait a week and we could still adopt the budget by the 15th of June.

 

            Director Strom stated that his only concern is if this is delayed to the 10th of June. That would be two more weeks.  He does not see us having a due date of June 15th and his concern is cash flow and debt service payments because we would have to extend the due date.

 

            Mr. DiMaio questioned if it is worth inquiring to see if we could get an extension on the debt service payments.  Director Strom stated that most of our cash is from the first quarter.  At this point in time, he thinks it would be fiscally more prudent if we could send out the tax bills on a timely basis.

 

            Director Parrillo questioned how much clarity is being requested from the General Assembly because our attorneys have given us their opinion. 

 

            Council Vice-President Favicchio asked if the Council could amend the budget and take out the money that we are not sure we are going to get and would we would be able to put it back in as soon as we find out what that amount is.  Director Strom stated that if we do reduce the schools and did not get the $4 million for the Schools, we would have to reduce it on the Revenue side and reduce it on the Expenditure side and the School would have to amend their budget and then when we find out what that money would be, then we would have to appropriate that money to them.

 

            Councilmember Stycos stated that he agrees with Director Parrillo and does not see any reason for delaying this.

 

            Council President Farina called for any amendments to the budget.

 

            Councilmember Stycos stated that he has several amendments to propose and he will explain the purpose of these amendments that add up to approximately $100,000 and take that money and add it to the school budget.  He is operating under the assumption that we are not going to get the $4 million.

 

            Councilmember Stycos motioned to amend line item #52411 on page 11 “Personnel – Employee Assistance Program” by eliminating that line item.  Councilmember Brady seconded the motion.

 

Under Discussion:

            Councilmember Stycos stated that during the Personnel Department’s budget hearing, the Personnel Director indicated that that was not used as much. 

 

            Council President Farina asked Solicitor if this is in the collective bargaining agreement.  Solicitor Rawson stated that he does not know, but he will check into it.

 

            Director Parrillo stated that he does not think it is wise to cut this program.  It may not be utilized to the best of its ability, but for a City our size and not to have such a program, is not a good idea.

 

            Solicitor Rawson stated that he looked at the Teamsters contract and this program is not a collective bargaining provision.

            On motion by Councilmember Stycos, seconded by Councilmember Vargas, it was voted to amend line item #52061 “Cranston Conservation Commission” on page 22 reducing it to -0-.

 

Under Discussion:

            Councilmember Stycos stated that he is a big supporter of conservation, but the Commission in the last three years, spent a total of $645.00, but we are budgeting them over $5,000.

 

            Councilmember Paplauskas recognized Carl Santucci, Chairman of the Conservation Commission, and asked him what the Commission’s plans are for the $5,500.  Mr. Santucci stated that that money will be spent to create a trail.  He pleaded with the Council to fund that amount.

 

            Councilmember Vargas stated that she would suggest that the Commission report to the City Council once or twice a year on the status of their projects and their funds.

 

            Councilmember Donegan agreed with Councilmember Vargas and added that any Commission that is receiving funds from the City should be required to provide status reports once or twice a year to the City Council.

 

            Councilmember Stycos asked that the City Council think about the schools because he thinks that what the schools will be doing in September is a lot more important than the Commission’s plans.  He thinks that the Commission needs to look at other spending sources such as grants in order to get projects done.  Mr. Santucci stated that they do look at everything and are careful with the projects.

            On motion by Councilmember Stycos, seconded by Councilmember Donegan, it was voted to create a new line item on page 7 under “Revenue – Police Department” entitled “Training Center Rentals” appropriating $21,420.

 

Under Discussion:

            Councilmember Stycos stated that this would do two things, it would add that money to the budget and it would take the current balance and put it in the budget.  He also indicated that his information came from Director Strom.

 

            Councilmember Brady asked opinion on this from the Administration.

 

            Director Strom stated that funds from a separate fund #456 “Training Academy Maintenance” and what Councilmember Stycos would like to do is take that and put it into the General Fund so if anything happened and maintenance needs to be done at that facility, it would have to be paid out of the Police budget or Building Maintenance budget.  He also indicated that the $21,420 is cumulative.

 

            Councilmember Paplauskas asked how much they have brought in this year.  Director Strom stated that they brought in approximately $10,000 and paid out approximately $18,000.

            On motion by Councilmember Stycos, seconded by Councilmember Donegan, it was voted to amend line item #53209 “Police Department – Rent” on page 16 and reducing it by $11,599.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:  Councilmembers Stycos, Hopkins, Vargas, McAuley, Donegan, Brady, Paplauskas, Council Vice-President Favicchio and Council President Farina -9.

            On motion by Councilmember Stycos, seconded by Councilmember Vargas, it was voted to amend line item #49130 “Mooring Fees – Harbor Master” on page 9 increasing it by $1,000.

Under Discussion:

            Councilmember Stycos stated that this proposal would require an Ordinance in the future to increase the fees to $25 per mooring.

            On motion by Councilmember Stycos, seconded by Councilmember Donegan, it was voted to amend line item #42128 “Miscellaneous Licenses” on page 5 increasing it by $1,400.

Under Discussion:

            Councilmember Stycos stated that this has to do with fireworks licenses and increasing them from $50 to $140 per year.  He stated that he thinks fireworks are a dangerous item and license fee is justified because of the danger they could cause our community and Fire Department.

             On motion by Councilmember Stycos, seconded by Councilmember Donegan, it was voted to amend line item #43100 “Fire Department – Gas Petroleum Permits” on page 7 increasing Revenues by $3,000.

 

Under Discussion:

            Councilmember Stycos stated that this would have to be done by Ordinance if this amendment is passed and it would be a flat $75 fee.  He also stated that this comes from the Fire Marshall.

 

Roll call was taken on above motion and motion passed on a vote of 7-1 with 1 not present.  The following being recorded as voting “aye”:  Councilmembers Stycos, Vargas, McAuley, Donegan, Brady, Council Vice-President Favicchio and Council President Farina -7.  The following being recorded as voting “nay”:  Councilmember Paplauskas, -1.  Councilmember Hopkins was not present to vote.

 

            Councilmember Stycos asked Mr. DiMaio what total of all these items is.  Mr. DiMaio stated $45,039.

            On motion by Councilmember Stycos, seconded by Councilmember Donegan, it was voted to amend line item #52211 “City Council Auditor” on page 11 reducing it from $24,000 to $12,000.

 

Under Discussion:

            Councilmember Stycos stated that the reason for this is once the Budget is adopted, there are no critical things for the Auditor to do for the remainder of the year.

 

            Councilmember Brady stated that a good Auditor will save the City hundreds of thousands to millions of dollars and this is why he is opposed to this reduction.

 

            Council Vice-President Favicchio stated that he calls on the Auditor, especially during the budget hearings for information, but also during the year.  We are not paying big money for this position.

 

            Councilmember Vargas stated that we have a City Internal Auditor and she asked if the City Auditor works with our Council Auditor at all or does he work just for the Finance Department.  Council President Farina stated that if we called on the City Internal Auditor for anything, we would have to pay that person compensatory time or overtime and he urged the Council to vote against this amendment.

 

            Councilmember McAuley stated that we should look at what the City Auditor is paid and if we are getting our money’s worth.  That is something we can discuss at a later time.

            On motion by Councilmember Stycos, seconded by Councilmember Brady, it was voted to amend “School System” and increase additional “City appropriations” from $400,000 to $445,039.

 

Under Discussion:

            Councilmember Brady asked Director Strom his opinion with this additional money to the Schools based on maintenance of effort.  Director Strom stated that the $45,000 would be added to the appropriation and would be part of the maintenance of effort.

            On motion by Councilmember Stycos, seconded by Councilmember McAuley, it was voted to amend the “Capital Budget – Public Works” by deleting “$50,000 for “Pavement Management Study” and deleting that line item.

 

Under Discussion:

            Councilmember Stycos stated that this is something we could put off for at least a year.

 

            Councilmember Paplauskas asked if Administration has any opinion regarding this.

 

            Director Parrillo stated that Public Works Director Mason did state it could be put off for one year.

 

            Council President Farina asked if it can go into the General Budget.  Director Strom stated that because it is related for infrastructure and roads, he believes it could come out of the Capital Budget.

            On motion by Councilmember Stycos, seconded by Councilmember McAuley, it was voted to amend line item #206 “Capital Budget - Sewer Projects” by deleting $700,000.

 

Under Discussion:

            Council Vice-President Favicchio asked if there is something we can do without.  Director Strom stated that per discussions with Public Works Director Mason, he had that listed in the Sewer Fund and it can be removed from the Capital Budget.

 

            Councilmember Stycos stated that those projects will be paid out of the Sewer Fees Revenue.

            Councilmember Stycos asked Director Strom the status of the purchase of the bucket truck on whether this could be put off.  Director Strom stated that he spoke to the Fire Chief yesterday and he felt that the bucket truck is something he felt was important because the one they have is old and is in need of repairs and he does have a site to place this.  The request is from $1.2 million to $2 million and the other two items originally requested, he is not pursuing this year.

            Council Vice-President Favicchio stated that he would like to make an amendment to getting the bills out and protect us from any serious shortfalls. 

 

            On motion by Council Vice-President Favicchio, seconded by Councilmember Brady, it was voted to remove from the School Budget $4,640,495 from the Revenue side and remove that on the Expenditure side also.

 

Under Discussion:

            Councilmember Stycos asked for clarification from Mr. Balducci on the exact amount because the amount stated by Council Vice-President Favicchio is not correct.  Joseph Balducci, School Chief Financial Officer, stated that the projected State Aid to School for next year is $4.1 million.

 

            Motion and second were withdrawn.

 

            On motion by Council Vice-President Favicchio, seconded by Councilmember Brady, it was voted to amend Revenue side of the School Budget by reducing it by $4,131,094.

 

Under Discussion:

            Superintendent Jeanne Nota-Masse stated that if this budget is approved and that becomes their City allotment, she questioned if that means that they have to amend their budget and get it back to the City. 

 

            Councilmember McAuley stated that if for some reason, the State comes back at $2.1 million, he asked if we could then tap into the Rainy Day Fund and isn’t that the most prudent thing to do during these tough times?  Director Strom stated that in speaking to Moody’s, they recommend to run the course of the Fiscal Year and if we have to do adjustment and at the end of the Fiscal Year we generated a deficit and would filter down into the Rainy Day Fund.  To draw from the Rainy Day Fund, they frown against that.  Councilmember McAuley thanked Director Strom for the explanation.

 

            Attorney Kirshenbaum asked that the Council consider the fact that there are Charter amendments being proposed about restricting use of the Rainy Day Fund and restricting a tax increase.

 

            Councilmember Stycos stated that this amendment makes sense for the situation we are in.

             Councilmember McAuley motioned to propose not opening up the Budlong Pool this summer and zero out all pool line items.  Councilmember Stycos seconded the motion.

 

Under Discussion:

            Councilmember McAuley stated that it does not seem feasible under the economic times we are in to open the pool.

 

            Director Parrillo stated that we are still waiting for guidelines from the State when it comes to how many kids would be allowed in a group and no plans have been made as to the pool or summer camp.

 

            Councilmember McAuley asked if the Administration would prefer to wait on this motion.  Director Parrillo stated that the Administration would like to have the possibility to open the camp for the kids and have some sort of program because it goes hand in hand with the pool, but we need to wait for further guidance from the State.

 

            Councilmember Vargas asked if the budgeted amount is for the full season.  Director Strom stated that the Administration budgeted based on a shortened season, based on direction from the State.  We did not budget for the full season at the pool or the playground program.

 

            Anthony Liberatore, Director of Parks and Recreation, stated that the budget is based on a four week program, which generally would be for eight weeks.  With the COVID, there is no way we can open the pool with all the regulations.  It would be impossible with all the restrictions.

 

            Director Strom stated that if you leave the funding in the budget and the pool does not open and programs don’t happen, it could be used as a fourth quarter transfer next year.

 

            Councilmember McAuley stated that he is willing to withdraw his motion.

 

            Motion and second were withdrawn.

 

            Councilmember McAuley stated that he wanted to cut the pay raises for the City Council and the Mayor.  He asked for legal opinion if it is proper for him to make this as an amendment or through an Ordinance.  Attorney Kirshenbaum stated that he thinks it should be done by Ordinance.  Assistant Solicitor Verdecchia agreed with Attorney Kirshenbaum.

            Councilmember Donegan motioned to take $40,000 for “Stadium Football Lettering and move it to next year’s budget.  No one seconded the motion.

 

            Director Liberatore stated that he guesses it could be moved to the next Fiscal Year, but he is not sure.

 

            Director Strom stated that if this is removed this year, it would have to be added back in next year’s budget.

 

            Councilmember Donegan asked Director Liberatore if he thinks this is fair given the circumstances. Director Liberatore stated, no.  He asked that the Council keep in mind that this is the City’s bond account.  The funds would not come out of his budget.  This is bond money.  It is not taking money away from the schools.  He believes if this is not used, you have to pay interest and penalties.

 

            Councilmember Brady asked if there are any penalties if the bond is not used.  Director Strom stated that we are already paying principle and interest on that bond.  WE have already drawn on that for various projects.

 

            Councilmember Brady stated that based on the fact that we are still paying interest regardless, maybe Councilmember Donegan should remove his motion.

 

            Councilmember Stycos stated that we need to set our priorities straight.  It adds nothing to the value of our athletic program.  We have a tremendous fiscal problem and to spend $40,000 for lettering on the end zone is frivolous spending.  Put the money where it is going to make a difference in people’s lives and not adorn football fields with logos.

 

            Councilmember Hopkins asked what the cost would be if we painted the lettering at the end zone for one year as opposed to cutting the lettering in the turf and would that reduce the amount of cost.  Director Liberatore stated that he does not want to put paint on synthetic turf.  He tends to agree with Councilmember Stycos to not do it until next year or not do it at all.  Councilmember Hopkins stated that maybe we can have wind screens put in which state “Home of the Thunderbolts”.

 

            Council Vice-President Favicchio stated that since we are paying interest and principle on this bond, he asked if we could direct those funds to something else.  Director Strom stated that this is something that the Planning Commission approved, but it does not mean that it can’t be changed to something that is more of a priority.  He asked that everyone keep in mind that this is Capital money and cannot be transferred over to the Operating Budget.

 

            Councilmember Brady stated that Director Liberatore and his staff are doing a tremendous job with our Parks and Recreation and does agree we need to be equitable of what we do for Cranston High School West we should do for Cranston High School East.  This is a hard decision.

 

            Councilmember Donegan stated that when he made the motion, his intent was to move it to next year and not eliminate it all together.  He thinks that the players and teams at Cranston High School East deserve more.

 

Councilmember Donegan withdrew his motion.

            Councilmember Donegan motioned to add a line item under “Recreation” entitled “Splash Pad Ward 3” in the amount of $150,000.  Councilmember Brady seconded the motion for discussion purposes.

 

Under Discussion:

            Councilmember Donegan stated that if this passes, he will forward an Ordinance to the Clerk to request the expense of $125,855 for Recreation Eastern Impact Fees and $24,145 would be paid through the Capital Bond money.  This would increase recreational space. 

 

            Councilmember Brady stated that he supports this, but these are very difficult times to ask voters to support this.

 

            Director Liberatore stated that the amount seems fine.  What needs to be looked at is availability of water lines and logistics.  There is a lot more planning that needs to be done.

 

            Councilmember Paplauskas stated that he likes the idea and would love to have one in Ward 5.  The question is, is this a nice to have or a need to have. 

 

            Councilmember Donegan stated that there is no debt service and this is bond money we already have.

 

            Council Vice-President Favicchio asked if this will deplete the Eastern Recreation fund.  Councilmember Donegan stated, yes, it would.

 

            Councilmember Brady stated that this is something he feels that we can hold off until next year.

 

            Council President Farina stated that he agrees that recreational space is important.  He will vote in favor of this.  There are funds available solely to be for recreation.

 

            Councilmember Stycos stated that this is what Impact Fees were intended for.  He is concerned about the current situation of the COVID and going forward, we need to watch that so we do not have a site that cannot be used.

             On motion by Councilmember Donegan, seconded by Councilmember Brady, it was voted to amend line item #52752 “Economic Development – Marketing” and rename that line item “Agreement with Providence Convention and Visitors Bureau”.

 

Under Discussion:

            Councilmember Donegan stated that this would show a commitment to them and would benefit the City greatly.

RESOLUTION ADOPTING THE OPERATING BUDGET AND THE ATTACHED SALARY SCHEDULE FOR THE GENERAL FUND, THE SEWER FUND, THE INSURANCE FUND AND THE CAPITAL BUDGET FOR THE FISCAL YEAR COMMENCING JULY 1, 2020 AND ENDING JUNE 30, 2021 AND ADOPTING THE CAPITAL IMPROVEMENT PROGRAM FOR THE FOUR SUCCEEDING YEARS

 

            On motion by Council Vice-President Favicchio, seconded by Councilmember McAuley, it was voted to adopt the above Resolution as amended.

 

Under Discussion:

            Councilmember Stycos asked Administration what they see as the Council’s role from here on, if any, given that no appropriation can be started without the Mayor’s initiation.  Director Parrillo stated that it is pretty clear that the Mayor sends the City Council an update daily.  He does not think there is anything that the Mayor is going to do outside of the City Council or getting the City Council involved in the decision making.

 

            Council President Farina stated that this has been a very difficult budget process.  He thanked Council Vice-President Favicchio, Director Strom and the Administration for all their hard work and is hopeful that the School funds will be reinstated by the State.

 

Roll call was taken on above motion and motion passed on a vote of 5-4.  The following being recorded as voting “aye”:  Councilmembers Hopkins, McAuley, Brady, Paplauskas and Council Vice-President Favicchio -5. The following being recorded as voting “nay”; Councilmembers Stycos, Vargas, Donegan and Council President Farina -4.

 

ORDINANCE MAKING ANNUAL APPROPRIATION FOR THE CITY OF CRANSTON FOR THE FISCAL YEAR COMMENCING JULY 1, 2020 AND ENDING JUNE 30, 2021

 

            On motion by Council Vice-President Favicchio, seconded by Councilmember McAuley, it was voted to adopt the above Ordinance as amended.  Motion passed on a vote of 8-1.  The following being recorded as voting “aye”:  Councilmembers Stycos, Hopkins, Vargas, McAuley, Donegan, Brady, Paplauskas and Council Vice-President Favicchio -8.  The following being recorded as voting “nay”:  Council President Farina -1.

 

RESOLUTION AUTHORIZING THE ASSESSMENT OF VALUATIONS AND LEVY OF TAXES

           

            On motion by Councilmember McAuley, seconded by Councilmember Brady, it was voted to adopt the above Resolution.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:  Councilmembers Stycos, Hopkins, Vargas, McAuley, Donegan, Brady, Paplauskas, Council Vice-President Favicchio and Council President Farina -9.

 

ORDINANCE FIXING THE DATE WHEN TAXES ARE ASSESSED AS OF DECEMBER 31, 2019 WILL BE DUE AND PAYABLE AND THE DATE WHEN UNPAID TAXES WILL CARRY A PENALTY

 

            On motion by Council Vice-President Favicchio, seconded by Councilmember McAuley, it was voted to adopt the above Ordinance as amended.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:  Councilmembers Stycos, Hopkins, Vargas, McAuley, Donegan, Brady, Paplauskas, Council Vice-President Favicchio and Council President Farina -9.
