            Regular meeting of the City Council was called held on Monday, April 26, 2021 via ZOOM Webinar.

 

            The meeting was called to order at 7:02 P.M. by the Council President.

        

Roll call showed the following members present:  Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain, Councilmen Donegan, Reilly, Council Vice-President Brady and Council President Paplauskas -9.

 

            Also Present:  Anthony Moretti, Director of Administration; Christopher Millea, City Solicitor; John Verdecchia, Assistant City Solicitor; David Dimaio, City Council Budget Analyst; Stephen Angell, City Council Legal Counsel; Robert Strom, Director of Finance.

 

                                                                                               

           

            On motion by Councilman Ferri, seconded by Council Vice-President Brady, it was voted to dispense with the reading of the minutes of the last meeting and they stand approved as recorded.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”: Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain, Councilmen Donegan, Reilly, Council Vice-President Brady and Council President Paplauskas -9.

II.               PUBLIC HEARINGS & PUBLIC COMMENT ON DOCKETED ITEMS RESOLUTIONS

 

 

            Douglas Doe, 178 Lippitt Ave., President of West Bay Land Trust, appeared to speak and thanked the City Council for adding the language to proposed Ordinance 3-21-05 specifically to line #28 adding “protected conservation areas, land and trails in the City of Cranston”.

 

            Daniela Fairchild, 11 Jackson Ave., Riverside, member of RI Commerce, appeared to speak and asked that she would like to share with the Council information regarding the State’s Small Business Relief Program” that is available and the City can share as needed with local business community.  She stated that this is a $5,000 Grant to support businesses in Rhode Island that took in less than $1 million in gross receipts and sales in 2020.  She also stated that there are a few limitations on eligibility, such as child care providers and real estate businesses, that are not eligible.  Application is available on commerceri.com\relief grant and it is open on a first come basis and open through Friday.

RESOLUTION OF THE CITY COUNCIL URGING THE CITY COUNCIL TO RECOGNIZE APRIL AS ‘CELEBRATE DIVERSITY MONTH’

 

            On motion by Council Vice-President Brady, seconded by Councilman Donegan it was voted to approve the above Resolution.

 

Under Discussion:

            Councilwomen Marino, Renzulli, Vargas, Councilman Ferri, Council Vice-President Brady and Council President Paplauskas asked to be added as co-sponsors.

 

            On motion by Councilwoman Vargas, seconded by Councilwoman Renzulli, it was voted to amend the above Resolution as follows:  after “”Latino”, delete “and”; after “People of Color”, add “LBGTQ+ community and people with disabilities”.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:   Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain, Councilmen Donegan, Reilly, Council Vice-President Brady and Council President Paplauskas -9.

ORDINANCE COMMITTEE OF APRIL 15, 2021

3-21-01           ORDINANCE IN AMENDMENT OF TITLE 10.32 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED ‘MOTOR VEHICLES AND TRAFFIC’ (Baldwin Orchard Drive & Russet Way – 3 way stop)  

 

            On motion by Councilman Ferri, seconded by Councilwoman Germain, it was voted to approve the above Ordinance.

 

 

            Councilwoman Marino stated that this Ordinance was pending traffic report.  She asked if that report has been provided.  Clerk indicated that she did not receive a report yet.

 

            Council President Paplauskas stated that the Council can continue this Ordinance for one more month for report.  We are supposed to give the Traffic Engineer 90 days per the Code.

 

Motion and second were withdrawn.

 

            On motion by Councilman Donegan, seconded by Councilwoman Marino, it was voted to continue this Ordinance for one month.  Motion passed on a vote of 9-0.  The following being recorded as voting “aye”:   Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain, Councilmen Donegan, Reilly, Council Vice-President Brady and Council President Paplauskas -9.

 

3-21-05           ORDINANCE IN AMENDMENT OF TITLE 10 OF THE CODE OF THE CITY OF CRANSTON, 2005 ENTITLED ‘MOTOR VEHICLES AND TRAFFIC’ (Riding of Mini-Bikes, Etc on Public Property)

 

             On motion by Councilman Reilly, seconded by Councilwoman Renzulli, it was voted to approve this Ordinance.

 

 

            Council President Paplauskas stated that this Ordinance strengthens the law we have on the books regarding minibikes and ATVS on public roadways and also adds a clause protecting conservation land and trails, which we have been having problems with ATVS on the trails.  He also stated that this Ordinance mirrors what Providence has on the books. 

 

            Councilman Donegan stated that if this Ordinance were to pass as is with the money going directly to the Police Department, he asked if that would be reflected in the budget and would there be a line item for that.  Director Strom stated that we could set up a line item in the forfeiture account if that is where you would like it to go or we have revenues in the General Fund for various categories as well.  He would like to do a little research and have further discussion with the Police and if the City Council would like to join him on that, that is fine.

 

            Councilman Donegan stated that if line items #112-114 were deleted and we did not put that language in the Ordinance, he asked where that revenue would go, would it be assumed that that money would go into the Operating Budget?  Director Strom stated, yes.  It could also go into the Municipal Court as well since it is a fine or fee.  This could be considered as well.

 

            On motion by Councilman Donegan, seconded by Councilwoman Germain, it was voted to amend the above Ordinance as follows:  strike lines #112-114.

 

 

Councilman Donegan stated that any revenue that is generated through this go into the regular budgetary process rather than earmarked specifically for this.

 

            Councilwoman Vargas stated that when the City has a public auction, she asked if the funds would go to the General Fund or does that get allocated to a specific department.  Director Strom stated that it depends on what the public auction is for, but it does go into the General Fund in some category.

 

Roll call was taken on motion to amend the above Ordinance and motion passed on a vote of 6-2.  The following being recorded as voting “aye”:   Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain and Councilmen Donegan -6   The following being recorded as voting “nay”:  Councilman Reilly and Council President Paplauskas -2.  Council Vice-President Brady was not present for roll call vote.

3-21-02           ORDINANCE IN AMENDMENT OF TITLE 2 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED ‘ADMINISTRATION AND PERSONNEL – DIVERSITY COMMISSION’

            On motion by Councilman Donegan, seconded by Councilwoman Germain, it was voted to approve the above Ordinance.

 

            On motion by Councilwoman Marino, seconded by Councilman Donegan, it was voted to amend the above Ordinance as follows:  line #52, delete “thirteen (13)” and add “nine (9)”; line #54(C1), amend “one (1)” to “two (2)” and delete “appointed by the mayor, one (1)”; line #55, delete “one (1) and add “two (2)” and delete lines #56 & 57; and delete lines #66 & 67 C(7 & 8).

 

            Councilwoman Renzulli questioned the reason for removal of lines #56 & 57.  Councilwoman Marino stated that the community sentiment was repeated that the Council members already have a voice and it was important that this Commission be represented more of a community then City Council members and as part of this Ordinance, the Commission in their report will be providing their advisory report to both the Mayor and City Council.

 

Roll call was taken on motion to amend the above Ordinance and motion passed on a vote of 6-2.  The following being recorded as voting “aye”:   Councilwoman Marino, Councilman Ferri, Councilwomen Vargas, Germain, Councilman Donegan and Council President Paplauskas -6   The following being recorded as voting “nay”:  Councilwoman Renzulli and Councilman Reilly -2.  Council Vice-President Brady was not present for roll call vote.

 

On motion by Councilwoman Germain, seconded by Councilwoman Marino, it was voted to amend the above Ordinance as follows:  line #71, after “director”, add “A vice-chairperson will be selected by a majority vote of the commission members.” And delete “In absence of the chairperson, the commission by majority vote of those members present shall elect a temporary chairperson for the meeting”.  Motion passed on a vote of 8-0.  The following being recorded as voting “aye”:  Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain, Councilmen Donegan, Reilly and Council President Paplauskas -8.  Council Vice-President Brady was not present for roll call vote.

V.               PUBLIC COMMENT FOR UN-DOCKETED ITEMS

 

Suzanne Arena, 88 Lakeland Rd., appeared to speak and stated that she had some issues in the City with loose dogs.  She thanked Councilman Reilly and Councilwomen Renzulli and Marino for helping out very quickly to their aid.  Her dog has, for the second time, been attacked by a neighbor’s dog who continues to keep his dog off the leash.  It is a serious issue and it really needs to be changed this year.  It needs to have serious consequences for the people that do not follow the law.  She is not happy the way the Police have handled it, but they can only do so much with the laws on the books.  She is moving out of Cranston because of the threats against her and her family for the last year and a half.  She would like to see support of this City Council and at the State level with a Resolution.  The Resolution is going to entail that just in a case of a car accident, you treat animals like they are property.  In a car accident, you have to have exchange papers, the Police should make people that are attacked or have property damaged, they should make that owner give the other person the insurance that they have for their homeowner’s insurance.  The burden should not be on the people.  In areas of the City, people let their dogs run a ruckus.

VIII.    EXECUTIVE COMMUNICATIONS

       

 

Councilwoman Marino stated that some of the fees are rather substantial.  She would like to go into Executive Session to discuss what those expenditures are for. 

 

Solicitor Millea stated that he would be more than happy to discuss this in Executive Session.

 

Council President Paplauskas stated that he believes the way Zoom is set up, we are not able to go into Executive Session this evening.

 

            Councilwoman Renzulli asked if we could hold the Executive Session at the end of the meeting.  Council President Paplauskas asked Attorney Angell’s opinion.  Attorney Angell stated that you would handle it in a normal course of events as you would with any Executive Session except you should entertain a motion to take the agenda out of order and take this issue last.  He also stated that he does not pass judgment on what the technological capabilities are of the City, but you need to ensure that that meeting is private and among the Council Members.

On motion by Councilman Reilly, seconded by Councilwoman Marino, it was voted to take the agenda out of order and discuss the above item at the end of the meeting in Executive Session. IX.            COUNCIL PRESIDENT COMMUNICATIONS 

 

 

Tomas Avila and Daniela Fairchild appeared to speak. 

 

Mr. Avila stated that he is present on behalf of Governor McKee and spoke regarding the Grant that was opened a week go and goes until the 30th of this month.  It is a $20 million Grant that was put out for small businesses that have been affected by COVID and it is up to $5,000 to any business except any corporations and real estate offices and also has to be a small business under $1 million.  Also, there is still money available in the Paycheck Protection Program Fund and it is also extended to May 30th by President Biden and also available for small businesses that initially could not get access and that is why it has been extended.

 

            Ms. Fairchild stated that the program is available at commerceri.com\relief grant and for the PPP, if businesses need help, they can e-mail Commerce RI at info@commerceri.com or call 521-help and they have technical support people who can help them.

 

 

X.               COUNCIL MEMBER COMMUNICATIONS

 

COUNCILWOMAN MARINO:


Councilwoman Marino
stated that at the April 12th Finance Committee meeting, Council Vice-

President Brady had an exchange with Public Works Director Mason and he had a specific reference to the Department of Public Works independent study providing a list of priority streets needed of repairs and improvements in the City.  Given that there was specifically referenced this is her inquiry to the Administration to the department as to how the Council can make that list accessible and transparent for the benefit of our residents.  Solicitor Millea stated that he believes that during that conversation, there was mention of priority of streets and/or avenues within the City by Mr. Mason and any such mention of that list, he believes through his research, would be a privilege list based on work product.  He thinks that the proper way to address it would be in Executive Session based on current State Statute. 

 

            Councilwoman Marino stated that the precise terminology that was sued at that meeting was that there was in fact an independent study of exactly what she just referenced and that is where it came from.  She does not see how an independent study that the City paid for with tax dollars would be considered work product and deemed confidential, but we can explore that in Executive Session.  She

asked Solicitor Millea if there is a specific State Law that he is referring to.  Solicitor Millea stated that under the Open Meetings Law, there is a specific section that deals with any type of contract.  He asked Assistant Solicitor Verdecchia to address this.  Assistant Solicitor Verdecchia stated that Section 38-2-2 talks about the types of records which can be made public and it is subject to interpretation. The two provisions that he thinks strikes closest to home here would be under Section 38-2-2 (k & n).  He does not know what Director Mason meant when he talked about independent study, but out of abundant of caution, this should probably be discussed in Executive Session first.

 

 

Councilwoman Marino stated that a concern she has with this Executive Order is that the goal it

is seeking to accomplish is a good goal, but it is how we get there that is very important and there are concerns with respect to these Orders.  We are a self-insured City and we need to be certain that we are taking certain precautions.  When we are seeking throughout this Order to allow expanded outdoor dining and there is a fee waived and also an indemnification clause that is signed by these businesses, however, what happens is if there were to be some type of accident, which has happened in the past, the company or owner that has indemnified us is just simply going to claim bankruptcy and then we, the City, could be left flipping the bill and that is a concern for all taxpayers and we owe it to the taxpayers of the City to take a second look at this and take a more comprehensive and more careful approach because the way this is drafted we are potentially really exposing ourselves.  This is something that she would definitely like to have an Executive Session to discuss these concerns.

 

COUNCILWOMAN VARGAS:

 

Councilwoman Vargas stated that the One Cranston Youth Opportunity Zone had approached

her regarding the completion of the survey they had done to parents here in the City asking about the needs of summer programs in the City of Cranston.  The survey has concluded and she has asked Caitlyn Blankenship to speak about this survey.

 

            Caitlyn Blankenship appeared to speak and stated that also with her on the call this evening is Roberto Catoni.  She stated that this organization focuses on expanding opportunities for all youth and they did a summer survey of the Cranston families to get an idea of what they need this summer for camp options for our youth.

 

            Roberto Catoni, Co-Chair of the Youth Opportunity Zone, appeared to speak and shared his screen of the survey results and gave a presentation regarding the survey.

Present in Executive Session:  Councilwoman Marino, Councilman Ferri, Councilwoman Renzulli, Vargas, Councilmen Donegan, Reilly, Council Vice-President Brady and Council President Paplauskas; Daniel Parrillo, Director of Personnel; Christopher Rawson, Assistant City Solicitor; John Verdecchia, Assistant City Solicitor; David Dimaio, City Council Budget Analyst.

 

            On motion by Councilman Donegan, seconded by Councilwoman Germain, it was voted to come out of Executive Session.  Motion passed on a vote of 8-0.  The following being recorded as voting “aye”:  Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain, Councilmen Donegan, Reilly and Council President Paplauskas -8.  Council President Brady was not present for roll call vote.

 

The meeting came out of Executive Session at 9:39 p.m.

 

On motion by Councilman Donegan, seconded by Councilwoman Marino, it was voted to seal the minutes of Executive Session.  Motion passed on a vote of 8-0.  The following being recorded as voting “aye”:  Councilwoman Marino, Councilman Ferri, Councilwomen Renzulli, Vargas, Germain, Councilmen Donegan, Reilly and Council President Paplauskas -8.  Council President Brady was not present for roll call vote.
