MINUTES OF THE SPECIAL MEETING OF THE CUMBERLAND TOWN COUNCIL

WEDNESDAY, APRIL 20, 2020 AT 6:00 P.M.

The regular meeting was called to order at 6:10pm

 

MEMBERS PRESENT:

President Dwyer; Councilors Gemski, Kinch, Shaw, Bradley, Beaulieu and Schmitt

 

Also present— Mayor Jeffrey Mutter; Town Solicitor Kelley Morris Salvatore; Town Clerk Sandra M. Giovanelli; Chief of Staff Linda Teel; Tax Assessor Ken Mallette

GENERAL ANNOUNCEMENTS

President Dwyer read the following:

 

“To protect the health and well-being of our citizens, and in accordance with Governor’s Raimondo’s Executive Orders 20-05 (relaxing the Open Meetings Act requirements) and 20-13 (restricting gatherings to five (5) people or less), this meeting will be available to the public by video or telephone conference.  The matters on this agenda have been determined to be for an essential purpose as defined in EO 20-05.”

1.  An application for a Municipal Mobile Food Establishment permit from Haven Brothers Mobile, LLC d/b/a Haven Brothers Mobile

 

 Public hearing opened at 6:12p.m. Everything was in order with this application.

2.  An application for a Municipal Mobile Food Establishment permit from Shishkaberry’s of New England d/b/a Shishkaberry’s of New England

 

Public hearing opened at 6:14p.m.

OLD BUSINESS

A.     ORDINANCES FOR PUBLIC HEARING:

1.  #20-08A – An ordinance amending the Operating Budget for the Town of Cumberland’s General Fund for Fiscal Year 2019-2020

 

Public hearing opened at 6:20p.m.

 

President Dwyer reminded the Council that they had accepted #20-08A in place of #20-08 at the previous meeting and read the totals into the record.

MOTION BY COUNCILOR SHAW, SECONDED BY COUNCILOR KINCH, AND IT IS UNANIMOUSLY VOTED TO APPROVE BY A ROLL CALL VOTE. VOTE 7/0.

 

       2. #20-09 – An ordinance setting certain tax exemptions on Real and Personal property.

 

Tax Assessor Ken Mallette explained that by State law, residents are allowed the same adjustments even when the tax rate has changed, in order to maintain the same level of exemption they previously held.

NEW BUSINESS

A.  RESOLUTIONS:    

1.  R-20-49 – A resolution ratifying Mayor Jeffrey J. Mutter’s Supplemental Declarations of State of Municipal Emergency, EO 20-03

 

Public hearing opened at 6:41p.m.

 

Mayor Mutter stated that State law requires that any Executive Order extending beyond 7 days be approved by the Council.

MOTION BY COUNCILOR BEAULIEU, SECONDED BY COUNCILOR SHAW, AND IT IS UNANIMOUSLY VOTED TO AMEND LINE 30 TO READ “UNTIL MAY 6”, BY A ROLL CALL VOTE. VOTE 7/0.

 

MOTION BY COUNCILOR SHAW, SECONDED BY COUNCILOR BEAULIEU, AND IT IS UNANIMOUSLY VOTED TO APPROVE AS AMENDED BY A ROLL CALL VOTE. VOTE 7/0.

 

B.  ORDINANCES FOR PRESENTATION AND PERMISSION TO ADVERTISE:

1.  #20-11 – An ordinance relating to Municipal Mobile Food Establishment permits (Presented by the Councilor President on behalf of the Administration)

 

Referred to the Ordinance Sub Committee meeting to be held on Wednesday, April 22, 2020 at 6:00 p.m.
