MINUTES OF THE SPECIAL MEETING OF THE CUMBERLAND TOWN COUNCIL
TUESDAY, AUGUST 4, 2020 AT 6:00 P.M.
VIRTUAL - OPEN SESSION
The regular meeting was called to order at 6:00pm.
MEMBERS PRESENT:
President Dwyer, Councilors Bradley, Gemski, Kinch, Shaw, and Schmitt
Absent: Councilor Beaulieu
Also present— Mayor Mutter; Town Clerk Sandra M. Giovanelli; Town Solicitor Kelley Morris Salvatore
President Dwyer read the following:
“To protect the health and well-being of our citizens, and in accordance with Governor’s Raimondo’s Executive Order
20-25 (relaxing the Open Meetings Act requirements) this meeting will be available to the public by video or telephone conference. All members of the Town Council will be participating remotely. Members of the public can listen and/or participate by clicking on the links posted on the agenda.
Comments can be emailed to publiccomments@cumberlandri.org including your name, address, and statement. Only comments including all required information will be read into the record.

OLD BUSINESS
A. ORDINANCES FOR PUBLIC HEARING
1. #20-18 – An ordinance regarding temporary stop signs (Presented by the Council President on behalf of the administration)
Councilor Schmitt stated that this ordinance serves to save time in various situations, such as at locations undergoing construction, by allowing the traffic management group to put up a temporary sign quickly rather than waiting to come before the Council.
The Ordinance Sub Committee had voted 3-0 to recommend inserting the following language on line 19: “The Town Council may authorize a temporary stop sign for a period longer than 90 days by resolution, but in no case for longer than 180 days”; and asked the Council to adopt this as 20-18A in place of 20-18.
MOTION BY COUNCILOR SCHMITT, SECONDED BY COUNCILOR SHAW, AND IT IS VOTED TO APPROVE 20-18A IN PLACE OF 20-18 BY A ROLL CALL VOTE. VOTE 5/1.
NAY: COUNCILOR BRADLEY
Councilor Shaw verified that this is the same resolution referenced in the Traffic Calming Committee meeting, where
these signs can be used for issues with traffic patterns without having to put it on an ordinance; and if it is shown to have a positive effect on speeding etc., a permanent sign could be authorized through an ordinance.
Public hearing opened at 6:10pm.
Councilor Bradley commented that he felt this was unenforceable.

President Dwyer asked if anyone wished to speak in favor or against.
Mayor Mutter confirmed that it would be incumbent on the Traffic Management group to keep track of all temporary stop signs installed and/or removed and report to the Council at their regularly scheduled meetings.
Lisa Foster, 101 Hines Road, thanked the Council for the signs currently put in place to curb speeding in her area and said she could promise that if these signs don’t work, we will call you.

NEW BUSINESS
A. RESOLUTIONS:
1. R-20-95 – A resolution establishing a temporary committee to review and approve applications for large gathering and events
Town Solicitor Kelley Morris-Salvatore stated that this resolution was being presented due to a new requirement by the Department of Business Regulations. That department is being inundated with large gathering requests that need to be reviewed by them. Guidance put out by the Governor’s office and the Department of Health requires that either the municipality or the DBR must review these large gathering plans to ensure that all social distancing and sanitizing requirements are met. She was advising the Town Council to put together a small committee to review these gatherings as necessary and work with the applicants to provide a safe environment. The EMS Director would be the best person to lead this group along with the Parks & Recreation director, who would normally review all gatherings on town property, plus the solicitor’s department.

Two typographical changes were requested to correct line 14 to reflect “municipality” rather than “municipal”, and correct the EMS title on line 31 to read “Chief of Emergency Medical Services”.
MOTION BY COUNCILOR SHAW, SECONDED BY COUNCILOR KINCH, AND IT IS UNANIMOUSLY VOTED TO APPROVE R-20-95 WITH TWO TYPOGRAPHICAL CHANGES, BY A ROLL CALL VOTE. VOTE 6/0.
