MINUTES OF THE REGULAR MEETING OF THE CUMBERLAND TOWN COUNCIL
WEDNESDAY, APRIL 6, 2022 AT 7:30P.M.

The regular meeting was called to order at 8:11pm with a roll call of members
MEMBERS PRESENT:
In person: President Kinch, Councilors Bradley, Magill, Shaw, Metivier, Beaulieu and Schmitt.
Also present—Mayor Jeffrey J. Mutter; Outreach Coordinator Sarah King; Town Clerk Sandra M. Giovanelli;
Town Solicitor Kelley Morris Salvatore.


Mayor Mutter recognized the Planning Department for their work in obtaining two infrastructure bank grants: $250,000.00 for the urban forestry plan; $500,000.00 for drainage improvement at Industrial Road.

B. COMMUNICATIONS
1. C-22-17 – A Revised Figure Set to the March 4, 2022 Siting Report included with the Notice of Intent Application from Narragansett Electric for the V148S 115kVTransmission Line Asset Condition Refurbishment Project.
2. C-22-18 – A resolution from the City of Woonsocket in opposition to Senate Bill S-2557 and House Bill H-7829 Mandatory Translation Services

President Kinch paused for public comments. There were none.
A. ENTERTAINMENT LICENSE
1. An application for a Special Event Entertainment license from Joel Marrero for a Car Show to be held at Diamond Hill Park on July 2, 2022 (tabled from March 16, 2022) 
Pending lease agreement, police approval, EMS, Insurance and Promoter’s permit
Mr. Boneja was present on behalf of Mr. Marrero was present and outlined the event. Mr. Marrero has had two previous events in Woonsocket. They would like to have a music competition based on of the quality and volume of each vehicle’s speakers, limiting each contestant to play only portions of two songs per vehicle.
Concerns over the decibel levels and previous complaints about noise at the park were discussed.
MOTION BY COUNCILOR SCHMITT, SECONDED BY COUNCILOR SHAW, AND IT IS UNANIMOUSLY VOTED TO APPROVE WITH THE STIPULATION THAT THERE BE NO MUSIC COMPETITION.
VOTE 7/0.
2. An application for a Special Event Entertainment license from Brian Andrade for a Boys and Girls Club Northern Rhode Island Flag Football Tournament to be held at Diamond Hill Park on July 23, 2022 and July 24, 2022

A. Report of Executive Session vote(s), as may be necessary. There were none.
B. Communication regarding the salary ordinance relating to the Animal Control 
Mayor Mutter advised the Council that at the time this ordinance was passed, although the position of Deputy Animal Control Officer was written into the ordinance, he had neglected to state it verbally while reading the positions listed; and wanted to make the Council aware.
Kyle Connors from Marcum Accountants and Advisors gave a presentation of the audit to the Councilors.
D. Update on RFQ Parks and Recreation consolidated workplan/ARPA spending
Councilor Beaulieu informed the Council that Parks and Recreation Director Mike Crawley is creating an RFP of necessary projects – a Parks and Rec work plan - so that there is an understanding of what will be needed in the future.
Perhaps some of the ARPA funding could be contributed to these projects.

1. #22-05 – An ordinance in amendment of the Code of Ordinances of the Town of Cumberland, Rhode Island, as amended amending the Ordinance and map thereof with reference to Cumberland Assessor’s Plat 016, Lot 0893
Councilor Schmitt asked for a motion to table to allow time for a Planning Board recommendation.
MOTION BY COUNCILOR SCHMITT, SECONDED BY COUNCILOR BEAULIEU, AND IT IS UNANIMOUSLY VOTED TO TABLE TO MAY 18, 2022. VOTE 7/0.
2. #22-08 – An ordinance relating to the appointment of liaisons to Boards, Committees and Community Groups
MOTION BY COUNCILOR SHAW, SECONDED BY COUNCILOR MAGILL, AND IT IS UNANIMOUSLY VOTED TO TABLE TO APRIL 20, 2022. VOTE 7/0.
3. #22-09A – An ordinance relating to the appointment of ex officio members of the Parks & Recreation Commission 
MOTION BY COUNCILOR SHAW, SECONDED BY COUNCILOR MAGILL, AND IT IS UNANIMOUSLY VOTED TO TABLE TO APRIL 20, 2022. VOTE 7/0.
A. RESOLUTIONS
1. R-22-21 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to purchase a Traffic Sign and Design System from URW America for the Highway Department in an amount not to exceed fifteen-thousand two-hundred and ninety-nine dollars ($18,799)
MOTION BY COUNCILOR SHAW, SECONDED BY COUNCILOR MAGILL, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0.
2. R-22-22 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to purchase a vehicle lift for the Cumberland Highway Department from Gary Bloom Sales, Inc. in an amount no to exceed eight-thousand seven-hundred and eighty-nine dollars ($8,789.00)
MOTION BY COUNCILOR MAGILL, SECONDED BY COUNCILOR METIVIER, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0.
3. R-22-23 – A resolution establishing assigned fund balances
Library Director Celeste Dyer spoke to the library fund created to accommodate repairs.
MOTION BY COUNCILOR BEAULIEU, SECONDED BY COUNCILOR METIVIER, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0.
4. R-22-24 – A resolution recognizing April 24, 2022, as “Armenian Genocide Remembrance Day” to commemorate the Armenian Genocide of 1915 to 1923, and in honor of Armenian Americans 
MOTION BY COUNCILOR BEAULIEU, SECONDED BY COUNCILOR SHAW, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0
5. R-22-25 – A resolution adopting unsynchronized tax levy for portions of Fiscal Year 2022 and Fiscal Year 2023
Mayor Mutter presented slides of the projected expenses and collection rate scenarios.

6. R-22-26 – A resolution to ratify the contract executed by Mayor Jeffrey J. Mutter with Department of Human Services to accept payments under the 2022-2023 Low Income Household Water Assistance Program for Water and Sewer Bills
