MINUTES OF THE REGULAR MEETING OF THE CUMBERLAND TOWN COUNCIL
WEDNESDAY, JUNE 21, 2023, at 7:30 P.M.

CALL TO ORDER 
The regular meeting was called to order at 7:33pm with a roll call of members.
MEMBERS PRESENT:
In person: President Kinch, Councilors Bradley, Shaw, Magill, Metivier, Schmitt and Beaulieu.
Also present—Mayor Jeffrey J. Mutter; Assistant Town Solicitor Peter Skwirz; Town Clerk Sandra M. Giovanelli
PLEDGE OF ALLEGIANCE
GENERAL ANNOUNCEMENTS
Councilor Beaulieu asked for a moment of silence for David Ayick, whose wife Holly Ayick is leader of the Town of Cumberland’s municipal employee credit union; and school committee member John Gibbons.
Councilor Schmitt commended the Cumberland High School boys’ varsity team for capturing the division one state championship for the first time in 30 years.
President Kinch congratulated Cumberland High School Salutatorian Susanna Henderson and Valedictorian Orion Le. The President also stated that on top of the CHS baseball champions, Cumberland has Tyler Kolek, the Big East Player Of The Year, and now Mary Malloy has become Miss USA.

B. Update from the School Committee
School Committee member Denis Collins, 5 Wedgewood Drive, acknowledged the Baseball Team Champions and the Valedictorian and Salutatorian of the Cumberland High School Graduating class.
He reported that school construction for Community and Ashton Schools is on schedule; at Garvin, the roof is going up, windows and rough plumbing is being installed.
C. Report/update from Fire Committee on utilization of ARPA funds
Fire Committee Chairperson Timothy Hogan and Fire Chief Nicholas Anderson thanked the town for thinking of them when they were allocating ARPA funds. The funds will be used to replace the failing fire apparatus floor at the Cumberland Hill station at 3502 Mendon Road. The funds will not cover the entire cost, they will also look at their capital improvements fund.
Mayor Mutter outlined the steps for the fire department to follow for to go through the procurement process. The town is responsible for keeping records of spending any ARPA funds.

1. R-23-48 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to purchase playground equipment for Community Elementary School from M.E. O'Brien and Sons in an amount not to exceed three hundred and sixty-six thousand six hundred and twelve dollars and sixty-two cents ($366,612.62)
PTO President Lisa Goldstein, 93 Windsong Road, asked for Council support to upgrade the playground.
Megan O’Brien, President of M.E. O’Brien and Sons responded to questions about the upgrades from the Council.
School Committee member Denis Collins spoke in support.
MOTION BY COUNCILOR SHAW, SECONDED BY COUNCILORS MAGILL & SCHMITT, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0.
2. R-23-49 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to enter into an agreement with Wright-Pierce for a sewer rate study in an amount not to exceed twenty-five thousand dollars ($25,000)
Mayor Mutter gave a synopsis of the study and the funding source.
MOTION BY COUNCILOR BEAULIEU, SECONDED BY COUNCILOR METIVIER, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0.
3. R-23-50 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to approve payment to Haluch Water Contracting for the Water Line Replacement Work at the Grants Mill Bridge using ARPA Funds in an amount not to exceed one hundred and forty-nine thousand two hundred and sixty-five dollars and fourteen cents ($149,265.14)
Water Superintendent Romeo Mendes was present via Zoom to review the project and answer questions from the Council.
MOTION BY COUNCILOR BEAULIEU, SECONDED BY COUNCILOR METIVIER, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0.
4. R-23-51 – A resolution ratifying a tentative agreement and authorizing Mayor Jeffrey J. Mutter and the President of the Town Council to amend the Collective Bargaining Agreement with the General Teamsters Local 251
Mayor Mutter spoke briefly about the resolution and asked for Council support.
MOTION BY COUNCILOR METIVIER, SECONDED BY COUNCILOR SHAW, AND IT IS UNANIMOUSLY VOTED TO APPROVE. VOTE 7/0.
5. R-23-52 – A resolution ratifying a tentative agreement and authorizing Mayor Jeffrey J. Mutter and the President of the Town Council to amend the Collective Bargaining Agreement with the International Brotherhood of Police Officers, Cumberland Local 640
