The regular meeting was called to order at 7:33pm with a roll call of members.

C. An update on Cumberland’s amended Zoning Ordinance 
Town Planner Glenn Modica shared a revised presentation put together by the Planning department, the town solicitor and consultant Weston and Sampson. This report will be in front of the Planning Board tomorrow evening, November 2, 2023. Discussion ensued with the Council on the new state requirements all towns must comply with.
2023-2024 LICENSE RENEWALS 
President Kinch announced that the Council would vote on the renewals by type. If there are any concerns or questions relating to a specific license, it can be removed from the list prior to taking a vote. All licenses are approved pending payment of outstanding taxes, fire department approval, Department of Health approval and certificate of good standing, when applicable.
President Kinch asked for a motion to remove #26, Slam Associates, from the 1st Class Victualling House licenses.

Solicitor Morris-Salvatore stated that she had spoken today to the DOT attorney; subsequently, she wants to clear up some questions with the RI Interlocal Trust that are not concluded. The solicitor asked to continue for two weeks.

3. R-23-96 – A resolution authorizing Mayor Jeffrey J. Mutter to execute a bill of sale to sell the communications tower located at 1380 Diamond Hill Road for twenty thousand dollars ($20,000.00) and to provide an easement for maintenance to the communications tower (tabled last from October 18, 2023)
Solicitor Kelley Morris-Salvatore reported that today she today received the license agreement that Councilor Bradley had brought up two meetings ago – concerning whether the town could leave its own equipment on the tower without paying rent. She summarized the concerns she had requested answers to, and brought the Council up to date. Discussion ensued.

4. R-23-99 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to purchase a portable air compressor for the Cumberland Water Department from Phoenix Contracting LLC in an amount not to exceed Twenty-Five Thousand Three Hundred and Twenty-Four Dollars ($25,324) (tabled from October 18, 2023)
Water superintendent Romeo Mendes reviewed this resolution. He related speaking to four vendors on the MPA list at Councilor Bradley’s suggestion. Discussion ensued on further details.
Mayor Mutter suggested voting the resolution down, review it further and go out for competitive bid on the Master Price Agreement.
Resident Ted Vecchio, 584 Bound Road, Woonsocket, stated that he had spoken to ATS; they are a family-owned business and not on the MPA; equipment is in stock, they do full warranty work, pre-service, training.
Solicitor Morris Salvatore stated for the record that the water department had gone out to a public bid. Anyone could have bid on the compressor, even those on the MPA. The town had received one bid only - a legitimate bid - with a warranty and a nearby location. It concerned her that the town went out for public bid, and is discussing throwing out the one bid received, going to someone else and paying more money.
Mayor Mutter commented that he thought it would have been appropriate to vote the resolution down originally. The fact that some individuals have directly called other vendors when you had already received one bid, that’s when you’re getting inappropriate.

1. R-23-100 – A resolution authorizing Mayor Jeffrey J. Mutter to enter into an agreement with Pare Corporation for professional engineering services related to the Cumberland Hill Fire Station repairs in an amount not to exceed thirty thousand three hundred and sixty dollars ($30,360)
Mayor Mutter spoke to the resolution and the funding source. Chief Anderson stated the fire station is in the Cumberland Hill section – the apparatus floor replacement requires a study to assess the needed repairs or replacement in order to move forward.

5. R-23-104 – A resolution authorizing Mayor Jeffrey J. Mutter to execute a net metering credit agreement with Southern Sky Renewable Energy RI-Alton Rd – Hopkinton, LLC and a net metering credits agreement (one-time transfer) with Care New England
Mayor Mutter explained this was a result of the snafu with the school paying BVP’s electric bill – and the net metering credits rate has been so good we can’t use them all. This is a one-time revenue source – the likelihood of having another unbudgeted revenue is slim to none. The one we have now is not going to be allowed again to be able to take advantage of it.
