The regular meeting was called to order at 7:34 p.m. with a roll call of members.

QUARTERLY DEPARTMENT REPORTS
Presentation of Citations to the North Cumberland Middle School State Championship Girls Cross Country Team
Council President Kinch and Jackie Hooper present Citations to the North Cumberland Middle School State Champion Girls Cross Country Team.
Council President Kinch congratulates the Team and thanks the team for making the Town of Cumberland proud.
Presentation of the Police Department’s Annual Report
Chief of Police Benson presented the Council with the items from the 2022 -2023 report, honor guard recruitment, body camera program, update on tasers, new firearms deployment, detail workforce, and expansion of the fleet of cruisers. Chief Benson updated the Council on the requests for 2024. Chief Benson also spoke about the strategic three-year plan, establishment of the drone program and K-9 plan. Chief Benson also reported that the Department has been awarded $1 million dollars for dispatch from the Federal Government. Chief Benson reported the Professional Standards Unit reported 9 complaints during the year and provided a detail of each complaint. Chief Benson also spoke about classroom time, 60 trainings outside, such as use of force firearms, domestic violence. Chief Benson spoke about the 2023 recruitment and the new hirers. Chief Benson also explained the operations of over 33,000 calls, and the breakdown of the operation calls, including DUI enforcement, reckless driving, breathalyzer tests and refusals, traffic stops, citations and verbal warnings. The Municipal Court Division handled over 1,400 cases, and Chief Benson broke down the cases handled, including parking tickets. Chief Benson also spoke about Domestic Violence calls and arrests, the Juvenile Hearing Board, and the assets received. In 2023 there were more calls of service but less arrests, which is lower than national standards. Notable event section, 2023 a DNA case, First Patch fundraiser, and each fundraiser programs, the torch run, a bicycle give-away and donation for kids in the community, deployed internal investigative records, back to school event with target to donate to kids in the community and other events that have been on social media for the community.
Council President Kinch thanked Chief Benson for the updates.

A. CLAIMS
Council President Kinch referred the Claim to the Town Solicitor
1. R-24-100 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to enter into an agreement with Pare Corporation for professional engineering services related to the Ashton and Berkeley Villages Water and sewer pipes in an amount not to exceed thirty-four thousand eight hundred dollars ($34,800).
DPW Director Duarte spoke about the proposal explaining to the Council that it is an early investigative engineer report due to substantial issues over the years with old plumbing and sewer problems from the mills, that have backed up into neighboring homes.
Councilor Shaw questioned the length of time to expect the report from Pare Corporation.
Director Duarte explained it is a third party and should be accomplished by the end of the year.
Council President Kinch thanked Director Duarte.

2. R-24-101 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to enter into an agreement with Pare Corporation for professional engineering services related to the Rawson Pond Dam conceptual design in an amount not to exceed sixty-eight thousand five hundred and thirty dollars ($68,530)
DPW Director Duarte spoke about the project regarding the temporary dam, explaining the timeline for the permanent dam when things should be done, and phases of the project. Director Duarte explained that this phase is a study to allow and determine the soils where the permanent dam will go, geo geo-physical characteristics, especially with climate change and water flow, this study will look at normal storms and the worst storm over a thousand years to create the strongest dam and appropriate structure. Director Duarte explained that this phase will take several months, involving taking soil samples and studying different options to present to the council. Director Duarte explained that there will be a cost to remove the dam and the permitting process with DEM, Wetlands Division and Army Corps of Engineers. This phase is to better understand the project and the costs that will be associated with the project.
Councilor Shaw asked Mayor Mutter if there should be a building committee for the project of the dam and is it too soon to put one together to make decisions if the council would approve it.
Mayor Mutter stated there has not been anyone allocated yet, and too soon to establish, and explained there is not any money allocated for pre-construction.
Solicitor Salvatore added that nothing is being built yet, it is just a study.

3. R-24-102 – A resolution authorizing and empowering Mayor Jeffrey J. Mutter to enter into an agreement with Stoss for Final Design and Construction Oversight services for Valley Falls Heritage Park
Ms. King explained that this was the next step of the process, and the Master Plan. Ms. King appreciated the positive feedback received and the next step was to issue an RFQ to complete the final design, and construction oversight to prepare the bid documents and contracts.
