THE CUMBERLAND BOARD OF LICENSE COMMISSIONERS

WEDNESDAY, JULY 21, 2021 AT 7:30 P.M.

The meeting was called to order at 8:22p.m. by Chairman Metivier

Present via Zoom: Chairman Metivier, Commissioners Shaw and Bradley

Present in-person: Commissioners Kinch, Magill, Beaulieu and Schmitt

 

ACCEPTANCE OF PREVIOUS MINUTES Video

A.  Acceptance of Minutes of the Regular Meeting of June 16, 2021

 

MOTION BY COMMISSIONER KINCH, SECONDED BY COMMISSIONER MAGILL, AND IT IS UNANIMOUSLY VOTED TO APPROVE BY A ROLL CALL.  VOTE 7/0. 

OLD BUSINESS

 

A. CLASS F 1 LICENSE (ONE DAY BEER AND WINE LICENSE) Video

1.   An application for a one-day Class F1 from Maia V. Mata for a Sweet 15th Birthday Party being held at Diamond Hill Park on August 14, 2021 (tabled from June 16, 2021)

Chairman Metivier stated that this application had been withdrawn.

CLASS BNT LICENSE -PRESENTATION & PERMISSION TO ADVERTISE Video

1.  An application for a Class BNT license from Nellie’s Lounge, LLC d/b/a Nellie’s Lounge, 433 Broad Street

 

This application was pending TIPS certification, Insurance Certificate, BCI, final inspection by Fire and Building officials, tentative menu and approval from the DOH.

 

Public hearing opened at 8:26pm.

 

Applicant Anyeli Rivera was present to speak to her application.

 

Chairman Metivier asked if anyone wished to speak in favor or against.

 

Abutter Joao Carvalho, 17 Vineyard Avenue, spoke to past issues at the previous bar and voiced objection to this license.

 

Public hearing closed at 8:28pm.

 

Commissioner Kinch asked Ms. Rivera if she would like to address the objections. Ms. Rivera stated she was planning on improving the appearance of the property and would work with Mr. Carvalho to ensure that his adjoining property would not be affected in any way.

 

Commissioner Schmitt questioned if this was the proper license for this property. There is no kitchen.

 

Discussion ensued with the commissioners and town solicitor regarding the considerations for a BNT license as listed in the town ordinance.

 

Commissioner Kinch asked how quickly Ms. Rivera would be able to sell food.

 

Chairman Metivier reopened the public hearing at 8:47pm to hear further comments and objections from Mr. Carvalho

 

Yamely Alvarez, 113 Sorrento Street, spoke to Ms. Rivera’s character.

 

Closed public hearing at 8:52pm.

 

Commissioner Bradley asked to table the matter in order to get further details.

 

MOTION BY COMMISSIONER BRADLEY, SECONDED BY COMMISSIONER MAGILL, AND IT IS VOTED TO TABLE TO AUGUST 18, 2021, BY A ROLL CALL.  MOTION PASSED.

NEW BUSINESS

CLASS BNT LICENSE - PRESENTATION & PERMISSION TO ADVERTISE Video

1.      An application for a Class BNT license from Aihu Corporation d/b/a Chucky’s Creamery, located at 48 West Wrentham Road

 

This matter will be held until August 21, 2021. The applicant did not make it into the town hall with paperwork due to an illness.
