MINUTES OF THE REGULAR MEETING OF THE CUMBERLAND BOARD OF LICENSE COMMISSIONERS

WEDNESDAY, JUNE 5, 2024 AT 7:30P.M.

CALL TO ORDER Video

The meeting was called to order at 7:30p.m. by Chairman Metivier

Present: Chairman Metivier, Commissioners Kinch, Bradley, Magill, Shaw and Schmitt

Arrived late: Councilor Beaulieu

ACCEPTANCE OF PREVIOUS MINUTES Video

A.  Acceptance of Minutes of the May 15, 2024 special meeting.

 

MOTION BY COMMISSIONER KINCH, SECONDED BY COMMISSIONER SHAW, AND IT IS UNANIMOUSLY VOTED TO APPROVE.  VOTE 6/0.

OLD BUSINESS  

A.  CLASS BNT Video

      1.  An application for a Class BNT License from JC Sleepy Hollow LLC dba The Dugout located at 7 Cray Street

 

Pending certificate of insurance.

Public hearing opened at 7:30pm

 

Applicants Christopher McComisky and Jerry Podgursky were present to speak to their plans of leasing the basement at
7 Cray Street and opening The Dugout.

Chairman Metivier noted that the business “7 Cray Street” had changed their own footprint to occupy only the first floor of the building.

 

Councilor Schmitt asked if the type of license had any serving restrictions or if they could serve seven days a week. He questioned having two liquor licenses in one building, asking how the applicant plans on competing with the bar upstairs; and are they allowed to serve outside even if they don’t intend to at this time.

 

Solicitor Morris-Salvatore responded that there was nothing prohibiting having two licenses in one building. The upstairs establishment also doesn’t operate every day. We made sure that 7 Cray Street changed their footprint and put that on file in Town Hall. She discussed the use codes with Councilor Schmitt.

 

Councilor Shaw discussed potential parking issues with the applicants.

It was noted that the license had been improperly listed on the agenda as being on for presentation only and would have to be tabled. The Council agreed to meet again on Monday June 10, 2024 at 6:00pm to vote on the license.

MOTION BY COMMISSIONER KINCH, SECONDED BY COMMISSIONER SHAW, AND IT IS UNANIMOUSLY VOTED TO TABLE TO JUNE 10, 2024 AT 6:00PM.  VOTE 7/0.

NEW BUSINESS

A.  TEMPORARY OUTDOOR SERVING LICENSE Video

      1.  An application for a temporary outdoor serving license from Club Lusitana for their annual feast on Friday, June 21st and Saturday, June 22nd,. 2024

Commission Chair Metivier recused himself from this discussion and vote; Vice Chair Magill opened the public hearing.

 

Public hearing opened at 7:47pm

Club representative Antonio Costa, 18 Plantation Drive, was present. He reported that the Club has a security meeting with Public Safety scheduled for the next day to review the event.

 

Councilor Bradley asked if there had been any issues at the Club, and would there be a review in July?

Mayor Mutter stated he had recently met with the Club. There have not been any incidents so they expect the Council to see something soon in way of a review.

MOTION BY COMMISSIONER SHAW, SECONDED BY COMMISSIONER KINCH, AND IT IS UNANIMOUSLY VOTED TO APPROVE.  VOTE 7/0.
