The Cumberland Board of License Commissioners meeting was called to order at 7:31 PM on August 20, 2025 by Chairman Shaw.  Commissioner Bradley arrived at 7:35 pm.

 

Absent:  Commissioner Beaulieu and Commissioner Sweet

 

ACCEPTANCE OF PREVIOUS MINUTES

A.    Acceptance of Minutes of the regular meeting of July 16, 2025.

 

MOTION BY COMMISSIONER KINCH, SECONDED BY COMMISSIONER MAGILL TO APPROVE.

VOTE 4/0.

 

OLD BUSINESS

CLASS BNT – PUBLIC HEARING

A.  An application for a Class BNT from Vindu Foods LLC d/b/a Vindu located at 356 Mendon Road.

 

Public Hearing Opened at 7:32 pm.

 

Chairman Shaw inquired if anyone from Vindu Foods was present, but no representative appeared either in person or via Zoom.

 

Chairman Shaw noted that this application was subject to a pending certificate of insurance, if approved, and asked the Town Clerk if they had been in contact with the applicant regarding the certificate, to which the clerk indicated they had not received the proper documentation.

 

Solicitor Kelley Morris Salvatore was consulted about whether the board could approve the license contingent upon receiving the proper insurance certificate. The solicitor confirmed this was acceptable, stating "subject to the appropriate certificate of insurance" and noted that the license wouldn't be issued until the correct coverage was provided.

 

Chairman Shaw explained that the issue was simply a matter of communication needed with the applicant regarding coverage requirements, as the submitted coverage wasn't correct. He expressed his opinion that there was no need to delay the application since it would be held until the certificate was corrected anyway.

 

The public hearing was closed at 7:33 PM.

 

MOTION BY COMMISSONER KINCH, SECONDED BY COMMISSIONER MAGILL TO APPROVE PENDING RECEIPT OF INSURANCE CERTIFICATE.  VOTE 4/0.

 

 

NEW BUSINESS

A.  CLASS F LICENSE

1.   An application for a Class F license from the Cumberland Beagle Club, 425 Nate Whipple Highway, for Layla’s Dream Fundraiser on Saturday, September 13, 2025, with a rain date of Sunday, September 14, 2025.

 

Public Hearing Opened at 7:34 pm.

 

Paul Koussa representing the Beagle Club was present on Zoom and explained that this was their annual Layla's Dream fundraiser that they have been doing for 6+ years.

 

Chairman Shaw expressed familiarity with the event and gladness that they were continuing it.  The board confirmed that everything was in order for the applicant's request.

B.  CLASS F1 LICENSE

1.   An application for a Class F1 license from the Cumberland Beagle Club, 425 Nate Whipple Highway, for a CBC Game Dinner on Sunday, September 21, 2025.

 

Public Hearing Opened at 7:36 pm.

 

Paul Koussa was also present on Zoom to comment that this is their yearly fundraiser for the actual club.

2.   An application for a Class F1 license from Bev Voyage LLC for the 2025 CYSA Fall Recreation Soccer Opening Day Celebration on August 22, 2025

 

Public Hearing Opened at 7:37 pm.

 

The public hearing was called open at 7:37 PM for the Class F1 license application from Bev Voyage LLC for the CYSA fall recreation soccer opening day celebration. The chair noted there was a pending question regarding insurance and asked if the clerk had received clarification.

The discussion centered on whether Bev Voyage LLC needed to have their own insurance or if they could be added to CYSA's insurance policy. The solicitor clarified the insurance requirements, stating they have to have their own insurance if they are serving liquor.

The board confirmed that no insurance documentation had been received from Bev Voyage. If approved, the vendor would need to submit their own insurance certificate prior to the event, which was scheduled for Friday, August 22, 2025.

Jacqueline Kalina from CYSA joined via Zoom to provide details about the event, which is celebrating its 35th year as an organization. To celebrate, they are holding a community event not only for soccer families, but open to the public. It's a free event similar to the food truck events at Diamond Hill with music.  The organization will be honoring their sponsors and vendor partners. The Revolution soccer team, RAFC, and Bryant College will be there with their soccer players.

The event will take place around the stage at Diamond Hill Park.  Chairman Shaw asked if this had been previously approved by the council, and it was confirmed that it had been.

The public hearing was closed at 7:42 PM.

Jacqueline acknowledged the insurance requirement stating that she believes that the vendor was added on their certificate of insurance just in case it was needed and will provide any additional information that may be needed.

Chairman Shaw reassured her that while having CYSA's insurance was nice as secondary coverage, Bev Voyage's insurance would need to be the primary coverage and expressed confidence in her efficiency in obtaining it.

The chair congratulated CYSA on their 35th anniversary.

 

MOTION BY COMMISSIONER KINCH, SECONDED BY COMMISSIONER MAGILL TO APPROVE PENDING PROPER INSURANCE DOCUMENTATION.  VOTE 5/0.

 

C.  TEMPORARY OUTDOOR SERVING LICENSE

1.   An application for a temporary outdoor serving license from the Cumberland A.C. d/b/a Cumberland Athletic Club, 30 Hamilton Street, for an event on September 20, 2025.

 

Public Hearing Opened at 7:43 pm.

 

Jim Murnighan spoke about the organization mentioning fundraising and donations to charities and the involvement of family and friends.

Chairman Shaw noted that he had spoken with the applicant earlier that day to clarify the time of the event, as no time was listed on the application. The event was confirmed to be on Saturday, September 20^th from 1-7 pm.

Commissioner Kinch asked for clarification if the event is just a basic cookout, in which Mr. Murnighan stated that was correct.  Commissioner asked if there would be music, and Mr. Murnighan responded no.

Commissioner Metivier asked if they had held this event in the past which was noted that it was held at another location but wanted to keep within Cumberland.   The location was confirmed that it will take place on the lawn area that's in the back.
