The Regular Meeting of the Exeter Town Council was called to order at 7:01 p.m., on Monday, December 2, 2024, in the Program Room, Exeter Public Library, 773 Ten Rod Road, Exeter, Rhode Island.

D. RECOGNITION OF NEARLY THREE DECADES OF SERVICE TO THE
TOWN OF EXETER: JAMES P. MARUSAK, ESQ., TOWN SOLICITOR:
Mr. Patterson: Regrettably noted that Attorney Marusak is retiring. He has worked with
Attorney Marusak for 12 enjoyable years. Because they both love history, Mr. Patterson
presented Attorney Marusak with a copy of Documents of Revolution, Common Sense,
Complete Federalist, and Anti-Federalist Papers.
Mr. Ellis: Thirty years ago, he was sitting as a Council Member. There was the need to hire a new solicitor. Attorney Marusak applied. Council was most impressed and hired him and his firm. Attorney Marusak’s representation has been nothing short of exemplary. He has supported the Town and provided for it over and over again and again. It is most fortunate that the Town has had him. Towns do not, as a matter of course, retain solicitors for very long. Attorney Marusak’s consistency with the Town is remarkable. He will be greatly missed. One of Attorney Marusak’s accolades during his tenure was that he was instrumental in retrieving Exeter’s copy of the Declaration of Independence from the auction block. When it was drafted in 1776, originals were made for and distributed to all the colonies. Exeter’s went missing.
Because of Attorney Marusak’s efforts and perseverance, the original is now securely kept
at the John Carter Brown Library, Brown University Campus, Providence. Exeter Residents
can view the document by appointment. A framed copy hangs at Town Hall. A framed copy
was presented to Attorney Marusak tonight in appreciation of his years of service.
Past Council President Kevin McGovern: For the four years he served, Mr. McGovern appreciated being able to bounce ideas off Attorney Marusak and appreciated Attorney Marusak’s insight and guidance. He thanked Attorney Marusak for his years of service
to Exeter and wished him good luck in his future.
Past Council President Richard Kenyon: Credited Mr. Ellis with bringing Attorney Marusak to Town. Attorney Marusak’s service has been invaluable. He has done so much for the Town.
It was a privilege and honor to sit at Council table with him. In 2000, Council with Attorney Marusak was addressing a new library, playground, and tower, and the discovery of the Declaration surfaced. Brown university wanted it. Council wanted it. Attorney Marusak
went after it, obtained it, and deserves 110% of the credit for securing that document for the Town.
Attorney Marusak: Thanked everyone for the gifts. They mean so much. It has been the honor of a lifetime to serve with the people that Exeter has the good fortune to have. Not only the people in the room tonight, but every single Council person and employee over the years, have done and do tremendous jobs. All are underpaid, underappreciated, and “kicked in the teeth at times.” There has never been a single Town Council person or employee, no matter their politics, philosophy, or cause, that did not have the best interests of the Town in their hearts. There have been arguments from time to time, but he never doubted a single person’s motivation and purity of heart. He means all this with sincerity and without equivocation. He tried to “stay in his lane.” He did not try to usurp powers that he should not have or was not granted. He always believed the way to serve the Town as Town Solicitor was to never play politics and
call it the way he saw it. He liked this job and helping the Town and stayed this long for those reasons. It has been a pleasure. He defended the Town with all his heart. He is leaving the Town in good hands with his firm. And, finally, he offered personal advice for the first time:
When things get hot and there are contentious issues on opposite sides, always take a second
to place yourself in the other person’s shoes. If you can, you will have a mile lead on them.

A. VACANCIES:
1. PERSONNEL BOARD (5 MEMBERS NEEDED): Letters of Interest are being accepted. Those received are being held. Once five are received, this Board will be
activated. These vacancies will continue to post.
2. CONSERVATION COMMISSION: The question on the ballot on November 5, 2024,
to reduce the number of members needed from seven to five passed. Council has six letters of interest. The Clerk will write those six to inquire if they are still interested in serving.
3. BOARD OF TAX ASSESSMENT AND REVIEW MEMBER: As he was recently elected as a Councilman, Raymond Morrissey, resigns. This vacancy will be posted.
B. RESIGNATIONS:
1. ETHAN JUDD, ANIMAL CONTROL OFFICER: Mr. Judd’s schedule as an
Animal Control Officer is conflicting with his school schedule. He will stay on as a
floater.
MOTION made by Mr. Patterson to accept the resignation of Ethan Judd as Animal Control Officer with regret; seconded by Ms. Allen; and voted unanimously in the affirmative.

4. PUBLIC WORKS WORKER: Director of Pubic Works Robert Shappy recommends
Stephen Sylvia, who has been working in public works and is very qualified.

A. PROPOSED AMENDMENT TO EXETER CODE OF ORDINANCES:
AN ORDINANCE TO AUTHORIZE THE APPOINTMENT OF ONE OR MORE DEPUTY ZONING INSPECTORS: CHAPTER 2, ADMINISTRATION; ARTICLE III, OFFICERS AND EMPLOYEES; DIVISION 6, DEPUTY ZONING INSPECTOR(S);
SECTION 216, DEPUTY ZONING INSPECTOR(S):
MOTION made by Mr. Morrissey to open the Public Hearing; seconded by Ms. Allen;
and voted unanimously in the affirmative.
Attorney Sylvia: In August, Zoning Inspector Hal Morgan was injured and incapacitated.
In September, an emergency ordinance for an Acting Zoning Inspector was accepted by
Council. Two were appointed. Mr. Morgan passed away in early October. At its Regular Meeting, Council extended the emergency ordinance. It will expire the first of the year. This ordinance will allow the two Acting Zoning Inspectors to continue until the position of Zoning Inspector is addressed. Council has a revised version of the amendments provided today that has changes to form not substance.
Mr. Ellis: Until the position is addressed, it is good to have the position filled and not vacant.
Katrina Thornley, 44 Bates School House Road: What happens if there is another person on
the ballot running for Zoning Inspector?
Attorney Sylvia: Under the State Constitution, whoever gets the most votes is declared elected. According to the Charter and State statute, Council has the authority to declare a vacancy and fill the position for the remainder of the term. If a Council Member is unable to serve, the Charter is clear in that for Council Members the next highest vote getter would fill the position.
Tom McMillan, 20 Cobblestone Hill Road: It is important to fill the position with a person who
has significant knowledge and experience.
Asa Davis, 146 Beechwood Hill Trail: The right of way to his property from Hallville Road was on the deed when he bought his property and still is today. Somehow, it is no longer on the DeFrancesco’s deed. Map 681 is new and conflicts with former Director of Public Works’ sworn statements but agrees with Council meeting minutes of 2009. There is and has been ongoing issues with zoning enforcement. The previous Zoning Inspector was aware of issues
of an illegal gun shop Route 2, DEM clean water violations at the Town garage, short frontages all over town, and the DeFrancesco wood working shop. The zoning map has not been updated in 13 years. It is supposed to be updated within 90 days of any changes. He suggested that Zoning Inspector be changed from elected to appointed at the next election in order that qualifications for the job can be required and enforced. He hopes that going forward, zoning
as written, is applied and enforced as written on everyone.
MOTION made by Ms. Allen to close the Public Hearing; seconded by Mr. Morrissey;
and voted unanimously in the affirmative.
MOTION made by Mr. Patterson to approve proposed amendments to Exeter Code of Ordinances authorizing the appointment of one or more Deputy Zoning Inspectors under Chapter 2, Administration, Article III, Officers and Employees, Division 6, Deputy Zoning Inspector(s), Section 216, Deputy Zoning Inspector(s); seconded by Ms. Allen; and voted unanimously in the affirmative.
Grace Gouin, 41 Dolly Pond Road: New to Exeter. Happy to be here. Her neighbors ride
dirt bikes and ATVs day and night, sometimes six vehicles at once. The noise level is incredibly loud and disturbing. They were working with Zoning Inspector Hal Morgan to enforce the noise ordinance. They approached the neighbors but were told nobody else cares and they cannot be stopped. She respects their right to do what they want on their property, but it should not affect her family’s lives. She requested Council to take steps to enforce the noise ordinance.
Gregg Casey, 41 Dolly Pond Road: Regarding the ATV noises from his neighbor, he has contacted Town Sergeant Scote Miller, staff at Town Hall, and the Acting Zoning Inspector.
The State Police said there is nothing they can do. The activities take place 50 feet from his property line and front door. It is really, really loud.
Marybeth Cournoyer, 45 Dolly Pond Road: Mr. Casey and Ms. Gouin are her neighbors.
They have not in the least exaggerated. The loudness and dirt. It is fine for them to have
fun for an hour or two, but it goes on all day. The noise impacts all the neighborhood.
She asked Council to look at parameters that would be suitable to all the neighbors.
A. RECONSIDERATION: REQUEST OF TOWN STAFF TO CLOSE ALL TOWN OFFICES AND DEPARTMENTS ON MONDAY, DECEMBER 23, 2024:
Mr. Morrissey’s wife is a staff member. He recused himself and left Council table.
Last month, Council denied this request. Mr. Ellis put it back on. Council has the
request from most of the staff members. Most of the staff will be taking it off. If
the Town is not closed, they will use vacation time. If it is closed, they do not have
to. There will be very few departments staffed so most Town offices and departments
will be closed anyway. He voted in favor of the request last month. He believes such
a gesture to be a morale booster.
MOTION made by Mr. Ellis to honor the request of the staff that Town offices and departments be closed Monday, December 23, 2024; seconded by Ms. DeFrancesco.
Discussion: The Clerk reiterated: A number of the staff will be taking the day off either way. The staff is underpaid. The Town gets a lot more than they pay for from each one. Giving them a day off with pay would be recognition of the work they do, most appreciated, and a bit of a morale booster.
Back to the Motion: Voted unanimously in the affirmative.
Mr. Morrissey rejoined the meeting.
B. DEPARTMENT OF PUBLIC WORKS: REQUEST TO GO OUT TO BID:
STATIONARY FUEL TANK: The Department is getting away from diesel. It would
be handy to have fuel on site, especially during storms. The unit will be 1000 gallons, encased, above ground, contained. The nearest gas for Town vehicles is at the Veterans’ Cemetery and
is open only during business hours. Otherwise, the trucks have to go to Coventry or Richmond for refueling.
MOTION made by Mr. Patterson to go out to bid for a Stationary Fuel Tank for the Department of Public Works; seconded by Mr. Ellis; and voted unanimously in the affirmative.
C. DEPARTMENT OF PUBLIC WORKS: AWARDING OF BID: PENETRATING
SURFACE TREATMENT OF ASPHALT PAVEMENTS UTILIZING MALTENES
REPLACEMENT TECHNOLOGIES (“MRT”): One bid was duly received and opened and is recommended by Public Works Director Robert Shappy. MRT is a rejuvenator and part of the Pavement Preservation Program. It saves roads, is economical, gives longevity to roads, penetrates the asphalt and binds it, is a phenomenal product, and has been used in Town for years. This step is under chip seal and keeps working beneath the surface It is part of the reason the Town received a 80% overall in the Program.
MOTION made by Mr. Patterson to award bid for MRT to Felix A. Marino Co., Inc., for the upcoming paving season in the amount of $13,135.85; seconded by Ms. DeFrancesco; and voted unanimously in the affirmative.
D. DEPARTMENT OF PUBLIC WORKS: AWARDING OF BID: WOOD CHIPPER:
One bid was duly received and opened and is recommended by Public Works Director Robert Shappy. This piece of equipment is not needed at the moment. The Department has an older one that has issues. The parts are harder and harder to get. If the new one cannot be bought with American Recovery Funds, it could be bought in some other way to be determined.
MOTION made by Mr. Patterson to award bid for Wood Chipper to United Construction & Forestry in the amount of $81,750.00 pursuant to funding being available; seconded by Mr. Morrissey; and voted unanimously in the affirmative.
E. REQUEST TO REDUCE SPEED LIMIT: SCHOOL LAND WOODS ROAD:
As there were no speed limit signs on the road, Public Works installed the regulation 25 miles
per hour. The residents are requesting the speed limit be reduced. The road is dirt; 25 mph
is too fast; some sections of the road are narrow. Public Works Director Rob Shappy suggests that the speed limit be 20 mph; 15 mph would be too slow. Mr. Ellis suggested caution signage, such as “Hidden Driveway,” be added.
MOTION made by Mr. Patterson to grant the Director of Public Works’ request to
reduce the speed limit on School Land Woods Road to 20 mph and add any signage
needed; seconded by Ms. Allen; and voted unanimously in the affirmative.
F. HAYING CONTRACT: REQUEST OF CURRENT HOLDER TO RELINQUISH
REMAINING TWO YEARS OF CONTRACT: The current renters have not found haying
the Town Farm profitable.
MOTION made by Mr. Patterson to rescind Patrick McNiff from Years 2 (December 1, 2024, to November 30, 2025) and Year 3 (December 1, 2025, to November 30, 2026) of
the Haying Contract for the Town Farm; seconded by Ms. Allen; and voted unanimously
in the affirmative.
MOTION made by Mr. Patterson to post three-year contract for haying contract for
the Town Farm; seconded by Ms. Allen:
Discussion: The Clerk will write the current contract holders and previous contract
holders to let them know that the contract is being re-posted.
Back to the Motion: Voted unanimously in the affirmative.
G. AWARDING OF REQUEST FOR PROPOSALS: TOWN HALL ARCHI-TECTURAL SERVICES: Four bids were duly received and opened. More time is
needed to review before awarding. This matter continued to Unfinished Business on
Council’s January Regular Meeting Agenda.
H. CONSIDERATION AND POSSIBLE APPOINTMENT OF CURRENT ACTING
ZONING INSPECTORS AS DEPUTY ZONING INSPECTORS IF THAT POSITION
IS ESTABLISHED: Karen Ellsworth and Joshua Chase have been serving as Acting Zoning Inspectors under the recent ordinance enacted to allow them to do so. Based on Council’s
action under Agenda Item No. 7A this evening, the following motion entered:
MOTION made by Mr. Ellis to appoint Karen Ellsworth and Joshua Chase to continue
as Deputy Zoning Inspectors; seconded by Mr. Morrissey; and voted unanimously in
the affirmative.
A. EXETER CLERK’S OFFICE: AWARDING OF BID: BASEMENT WATER
MITIGATION: Council President Dan Patterson, Public Works Director Robert Shappy,
and Public Works Supervisor William Brown met with the only bidder, Dry Zone Basement Systems. Their questions were satisfactorily answered. Considering that the winter is
imminent, it will be better to have the work done in the Spring. Discussion ensued regarding
logistics: the work DryZone will perform, cleaning out the basement, storage of records,
staffing while the work is being performed, etc.
MOTION made by Mr. Patterson to award Dry Zone Basement Systems the bid for
Basement Water Mitigation at the Town Clerk’s Office in the amount of $40,202.50;
seconded by Ms. Allen; and voted unanimously in the affirmative.
B. SOLID WASTE AND RECYCLING SERVICES AGREEMENT BETWEEN
THE RHODE ISLAND RESOURCE RECOVERY CORPORATION AND THE MUNICIPALITY: Public Works Director Robert Shappy has reached out to get
answers to questions concerning the agreement. He has had no response. The Clerk
will write Resource Recovery to tell them that Council cannot move forward on the
Agreement until Mr. Shappy is contacted and the questions answered.
C. STATUS: WELCOME SIGNAGE IN AND OUT OF TOWN: Mr. Findlay
has not heard back from the sign company.
D. DIRECTOR OF PUBLIC WORKS: DAMAGE TO TOWN PROPERTY:
MAIL ROAD: The company that damaged the road has satisfactorily made the
repairs.
MOTION made by Mr. Patterson to remove Agenda Item No. 10D, Damage to
Mail Road; seconded by Ms. DeFrancesco; and voted unanimously in the affirmative.
E. STATUS: RI250 COMMISSION: EXETER HISTORIC PRESERVATION
COMMISSION: The Committee is planning to display historic posters in the Hall
School on the night of the Tree Lighting. There will be a raffle for a basket. It has
been suggested to hold an Open House/250 Commission Event at the new building,
742 Ten Rod Road.
F. TOWN GOVERNMENT BUILDINGS: USES AND IMPROVEMENT PLANS:
1. 675 TEN ROD ROAD: BASEMENT WATER MITIGATION:
This agenda item was discussed under Agenda Item No. 10A.
It will be left on the agenda for status updates.
2. 742 TEN ROD ROAD: STATUS: Mr. Findlay visits the building weekly
to check on heating and such. The furnace has been serviced. The fire extinguishers
have been updated.
Council has a summary from Town Treasurer Maria Lawler regarding the American
Recovery Fund balance remaining. Mr. Patterson suggested that the remaining balance
be encumbered towards renovation of 742 Ten Rod Road. The State is allowing remaining American Recovery Funds to be encumbered by transferring them to a department or fund.
The remaining funds could be transferred to the New Town Hall Fund to use towards
renovations at 742 Ten Rod Road.
MOTION made by Mr. Ellis to direct Town Treasurer Maria Lawler to place the remaining American Recovery Funds in the New Town Hall Fund to be used for
expenses at 742 Ten Rod Road; seconded by Ms. DeFrancesco; and voted unanimously
in the affirmative.
No. 4 11/12/2024 American Baptist Churches of Rhode Island (ABCORI):
Update - Canonicus Camp and Conference Center Property: Mr. Ellis read from
the communication: “During its August meeting, the Exeter Town Council discussed
the possibility that ABCORI would be selling its Canonicus Camp and Conference Center
Property. I am writing to let you know that ABCORI Board currently is working with
the Rhode Island Department of Environmental Management toward conservancy of
the 300-acre property. Should there be further developments, I will keep you apprised.”

MOTION made by Mr. Ellis to direct the Clerk to write a letter to Ms. Grzybowski thanking her for her offer and letting her know that Council is not in a position at
this point to move forward with a Town Administrator and that her communication
will be held for when the time to discuss a Town Administrator comes; seconded by
Ms. DeFrancesco; and voted unanimously in the affirmative.
Council did not enter into Executive Session.
