EXETER ZONING BOARD OF REVIEW

A REGULAR MEETING of the Exeter Zoning Board of Review and the Board of Appeal will be held on Thursday, May 8, 2025, at 7:00 pm, at Town Hall Council Chambers, 675 Ten Rod Road, Exeter, RI, when all persons will be heard for or against the following applications for dimensional variance, use variance, or special permit under the Zoning Ordinance and an appeal under the Exeter Land Development and Subdivision Regulations:

II.            NEW BUSINESS/APPEALS

A.     Asa S. Davis III and Lauren B. Kelly-Davis, Applicants and Owners of property located at 146 Beechwood Hill Trail, Exeter, RI, further identified as Assessor’s Plat 77, Block 6, Lot 24 and Asa S. Davis III, Applicant and Owner of property located at 0 Ten Rod Road/740 Ten Rod Road/50 Estate Drive/85A Hallville Road, Exeter, RI, further identified as Assessor’s Plat 36, Block 2, Lot 2. The issues appealed and grounds for the appeals are set forth by the appellants, as follows:

 

1.       Zoning Map - “The zoning map is required to be updated by the zoning inspector within 90 days of any changes. The Exeter Zoning Map has not been updated for 13 years, although numerous changes have been approved in that period, and errors pre-dating are also evident.”

2.       Lot 36-1-13, 44 Estate Drive, Illegal Frontage – “A lot line along an unimproved, uncertified, and unaccepted street does not and never did meet [the] definition [of frontage]. The zoning certificates [for these two properties] should be revoked.”

3.       Lot 36-1-14, 47 Estate Drive, Illegal Frontage – “A lot line along an unimproved, uncertified, and unaccepted street does not and never did meet [the] definition [of frontage]. The zoning certificates [for these two properties] should be revoked.”

4.       85/87 Hallville Road, Lot 36-3-25, Illegal Use – “Illegal/Prohibited use of property….”

5.       742 Ten Rod Road, Lot 36-2-9, Illegal Berm Diverting Stormwater – “Zoning violations are damaging abutting property and freshwater wetlands.”

6.       169 South County Trail, Lot 62-3-1, Town Garage – “Continued failure to follow special use and groundwater protection requirements….”

7.       146 Beechwood Hill Trail, Lot 77-6-24, Zoning Certificate – “Still have not received correct signed certificates.”

8.       0 Ten Rod Road, Lot 36-2-2, Solicity Zoning Certificate – “Still have not received correct signed certificate.”

9.       Fee Refund – “I appeal the imposition of the fee (and any susequent (sic) legal expenses) to require the town to follow its own ordinances and state statute.”
