The following items of business, having been filed with the Town Clerk under the Rules of the Council, will come before the Council at a special meeting to be held on Monday, May 3, 2021 6;00 P.M. Executive Session; Budget Immediately following; Regular Meeting at 7:00 P.M. - Said meeting will be conducted by telephone conference call/ webinar, in accordance with Executive Order 20-46 issued by Governor Raimondo on April 15, 2020, extended to April 29, 2021, which modifies certain provisions of the Open Meetings Act (“OMA”) and the Access to Public Records Act (“APRA”) as part of the State’s emergency response to COVID-19. The items listed on the Consent portion of the agenda are to be considered routine by the Town Council and will ordinarily be enacted by one motion. There will be no separate discussion of these items unless a member of the Council, requests and the Town Council President permits, in which event the item will be removed from Consent Agenda consideration and considered in its normal sequence on the agenda. All items on this agenda, may be considered, discussed and voted upon in executive session and/or open session.
Pursuant to RIGL §42-46-6(b). Notice – “Nothing contained herein shall prevent a public body, other than a school committee, from adding additional items to the agenda by majority vote of the members. Such additional items shall be for informational purposes only and may not be voted on except where necessary to address an unexpected occurrence that requires immediate action to protect the public or to refer the matter to an appropriate committee or to another body or official.”
Any person not a member of the Council, desiring to address the Council concerning a matter on the docket of the Council, not the subject of a Public Hearing, shall submit a written request to the Town Clerk stating the matter upon which he desires to speak. Persons are permitted to address the Council for a period not to exceed three (3) minutes. Citizens that wish to speak must submit a written request either dropped off at Town Hall or emailed to both wmarshall@middletownri.com and kclancey@middletownri.com . Request must include your information, item number you wish to address and how you will be identified/named on zoom. The request must be filed at least 30 minutes prior to the meeting. If a request is not filed, you will not be able to address the matter.
The Middletown Town Council follows the codification of present-day general parliamentary law as articulated in Robert’s Rules of Order Newly Revised 10th edition (2000), together with whatever rules of order the Council has adopted for its own governance. The motion to reconsider is one of the motions that can bring a question again before an assembly, and is designed to bring back for further consideration a motion which has already been voted on:
If, in the same session that a motion has been voted on, but no later than the same day or the next day on which a business meeting is held, new information or a changed situation makes it appear that a different result might reflect the true will of the assembly, a member who voted with the prevailing side can, by moving to Reconsider [RONR (10th ed.), p. 304-321] the vote, propose that the question shall come before the assembly again as if it had not previously been considered. Councillor Flynn recused herself from acting on the following motion, due to a possible conflict of interest.

2. Review of Fiscal Year 2022 Operating Budget.
On motion of Vice President Welch, duly seconded, it was voted unanimously to begin review of Fiscal Year 2022 Operating Budget.
Town Administrator Shawn Brown reviewed following:
Mr. Brown noted this is a good budget and there will be a review of the Department Budgets on Saturday, May 8, 2021.

On motion of Vice President Welch, duly seconded, to adopt the Fiscal Year 2022 Budget Meetings.
Council President Rodrigues noted that on Saturday, May 8, 2021 the meeting will begin at 8:00 am, explaining the Council will recess the meeting at 9:30 am and reconvene at 11:00 am after Church services for the Town Administrators bother.
A vote was taken at this time.
On motion of Vice President Welch, duly seconded, it was voted unanimously to adopt the Fiscal Year 2022 Budget Meetings.
4. Pursuant to Rule 25 of the Rules of the Council, Citizens may address the town on one (1) subject only, said subject of substantive Town business, neither discussed during the regular meeting nor related to personnel or job performance. Citizens may speak for no longer than five (5) minutes and must either dropped off a public participation request at Town Hall or emailed to both wmarshall@middletownri.com and kclancey@middletownri.com at least 30 minutes prior to the start of the meeting. Discussion centered around that the property is not within 200 feet of the school, how close the patio is to the abutting neighbors, the patio will only be used seasonally, the employees will monitor outdoor service of alcohol on the patio, hours of operation for the establishment and the establishment will be open for breakfast.

Mr. Lynch noted the dba of the establishment has been changed to “The Beach Bar”.
Discussion centered around hours of operation, the Council may put conditions on licenses, operating times of other restaurants in the area and outdoor waiting area is not for outside service.
Scott Lyons, representing Beach Wine and Liquors, abutting the property addressed the Council noting concern with parking capacity for the restaurant.
Discussion centered around the approval for existing seating and parking at the establishment has been through the zoning process.

Town Planner Ronald Wolanski reviewed a powerpoint presentation, which is on file in the Office of the Town Clerk.
Theresa Spengler, 1111 Wapping Road, addressed the Council inquiring about spotlights, explaining in her area there are many coyotes and the need for bright lighting at night. Ms. Spengler noted this is a safety issue for residents and their pets and suggests the Council consider where people live.
Discussion centered around if the Planning Board developed this ordinance by zone, all standards may not apply to all areas in town and the Town Council forwarding this ordinance back to the Planning Board for further review.

22. Application for Special Event Permit from Newport Film for Newport Film Outdoor Documentary Film Screening of “Playing With Sharks” to be held on Thursday, June 17, 2021, 6:00 p.m. – 10:00 p.m. at the Second Beach Parking Lot.
On motion of Vice President Welch, duly seconded, to grant said Special Event permit.
Rebecca Bertrand, 29 Carey Street, Newport, representing Newport Film, addressed the Council noting they have insurance, and are working with Department of Business Regulation to meet COVID standards, there will be no food vendors, seating will be in pods and participants are required to register in advance for the event.
Discussion centered around the size of the event, number of participants for the event and no dogs are allowed at the beach.

23. Application for Special Event Permit from Sweet Berry Farm, 915 Mitchell’s Lane, for the Rozanski/Mello Wedding to be held on Saturday, June 26, 2021 from 5 pm to 10:00 pm.

Councillor Flynn inquired if there would be fireworks at the wedding.

Memorandum of Superintendent, re: Gaudet School Track.
Superintendent of Schools Rosemarie Kraeger and School Committee Chair Theresa Spengler joined by zoom to answer Council questions.
Discussion centered around the project is not eligible for housing aid reimbursement, the cost of a track renovation verses a new track, the current track is beyond its useful life, getting a quote for full replacement of the track, cost of disposing current track materials, the current track was resurfaced in 2009, the original track was installed in 1983 and resurfaced in 2001, the renovations to the track are due to safety issues and the Town Administrator and Superintendent of Schools will request a quote from the vendor for full track replacement.
25. Communication of John Ceglarski, President, Middletown Athletic Boosters, re: Request for support – Middletown Athletic Boosters Senior Sports Banquet.
On motion of Vice President Welch, duly seconded, it was voted unanimously to receive said communication.
Council President Rodrigues reviewed the communication above.
On motion of Vice President Welch, duly seconded, it was voted unanimously to authorize a civic appropriation in the amount of $2500.00 to be appropriated from the Council President’s Discretionary Fund.
26. Email Communication of Michael Falcone, Director of Baseball Operations, Newport Gulls Baseball Club, re: Middletown Appreciation Night – Newport Gulls.
On motion of Vice President Welch, duly seconded, it was voted unanimously to receive said communication.
Town Administrator Shawn Brown noted that the Town Council has sponsored Middletown Night in prior years.
On motion of Vice President Welch, duly seconded, it was voted unanimously to authorize funding for a Middletown Appreciation Night – Newport Gulls in the amount between $2,500 and $4,000 to be appropriated from the Council President’s Discretionary Fund.
27. Memorandum of Councillor VonVillas and Vice President Welch, re: West Main Road Development.
On motion of Vice President Welch, duly seconded, it was voted unanimously to receive said memorandum.
Councillor VonVillas reviewed the memorandum above.
Vice President Welch noted support for this request.
On motion of Vice President Welch, duly seconded, to authorize the Town Administrator, with the assistance of 4th Economy, to reissue the request for information (RFI) for developers to provide information and interest on redevelopment options for the West Main/Coddington Center.
Discussion centered around getting a Request for Information for the West Main Road Development, looking for additional data, the need for affordable housing, there being plenty of open space on the east side of town, very little open space on the west side of town and this is a revenue opportunity for the town.

On motion of Vice President Welch, duly seconded, it was voted unanimously to authorize the Town Administrator, with the assistance of 4th Economy, to reissue the request for information (RFI) for developers to provide information and interest on redevelopment options for the West Main/Coddington Center.

Memorandum of Town Administrator, re: Beach Operations Plan - Update.
On motion of Vice President Welch, duly seconded, it was voted unanimously to receive said memorandum.
Town Administrator Shawn Brown reviewed the memorandum above.
Mr. Brown noted that the beaches may open at full capacity, which came about after the memorandum above. Town Administrator Shawn Brown explained that he, Facilities Director Will Cronin and the beach staff are working on an opening plan for the beach.
Discussion centered around Surfers End at Second Beach will be for residents, Triangle A is where non-resident may park at Surfers End, RIPTA bussing people to the beaches, collecting cash at the beach, campground upgrades and there will be no free Third Beach stickers for residents.
Lawrence Frank, 8 O’Donnell Road, provided the following comments he presented to the Council as part of the record.
Climate change often creeps up on us, a little bit at time, hardly noticeable. Here in Middletown it is more than noticeable. At Second Beach each high tide is a reminder of the environmental consequences. The beach is disappearing. Based on current information, sea level rise for Newport and Middletown will be 15 inches by 2050, less than 30 years from now. Second Beach will no longer be a place for people to sit in warm sand during the summer.

This is also a warning of the economic damage that that the town will suffer in the years ahead. The beach is an economic resource for Middletown. Besides the fees collected from parking and concessions, the tourist industry relies on the beaches act as a driver of visitors and dollars to the town. Hotels, restaurants, sports stores, all rely on these visitors to sustain them. For better or worse, Middletown has put it economic viability in the hands of those who do not live here.
How do we prepare for that? Beach restoration is possible. “Beach restoration involves the placement of sand on an eroded beach for the purposes of restoring it as a recreational beach and providing storm protection for upland properties. Restoration is generally accomplished by bringing sand to the beach from inland sites or adjoining beach segments, or by hydraulically pumping sand onshore from an offshore site.”(Widecast.org)
“In many coastal areas, the economic impacts of a wide beach can be substantial. Since 1923, the U.S. has spent $9 billion to rebuild beaches. One of the most notable example is the 10 miles long shoreline fronting Miami Beach, Florida, which was replenished over the period 1976–1981. The project cost approximately $64,000,000 and revitalized the area's economy. Prior to nourishment, in many places the beach was too narrow to walk along, especially during high tide.”(Wikipedia)
Now would be a good time to make plans to address this. Not only for the recreational benefits for Middletown residents, but for the long range economic survival of our town.

On motion of Vice President Welch, duly seconded, it was voted unanimously to receive said memorandum.

Discussion centered around the bid is less than the prior vendor, there were no bids for food trucks at the beach, Council was unsure of tying into a five year contract and the Administration reaching out to the bidder to reduce the years of the contract.

On motion of Councillor Flynn, duly seconded, it was voted to reappoint John Terlisner, appoint Matthew Sams and appoint Jen Huber as Regular Members; Steven Rodrigues and Audrey MacLeod Pfeiffer to the Juvenile Hearing Board for terms expiring April 2024; Councillor Flynn, Councillor Logan and Councillor Turano voted YES; Council President Rodrigues, Vice President Welch, Councillor Santos and Councillor VonVillas voted NO to said motion; MOTION FAILED TO PASS.

42. Appointment of one (1) member to Middletown Economic Development Advisory Committee for a term expiring January 2024.
Councillor Santos nominated Henry Lombardi, duly seconded.
At vote was taken for Henry Lombardi as a member to the Middletown Economic Development Advisory Committee for a term expiring January 2024; Council President Rodrigues, Councillor Santos and Councillor VonVillas voted YES; Vice President Welch, Councillor Flynn, Councillor Logan and Councillor Turano voted NO to said motion; MOTION FAILED TO PASS.
Councillor Flynn nominated Valarie Gelb, duly seconded.
At vote was taken at this time, to appoint Valarie Gelb as a member to the Middletown Economic Development Advisory Committee for a term expiring January 2024; Council President Rodrigues, Vice President Welch, Councllor Flynn, Councillor Logan, Councillor Turano voted YES; Councillor Santos and Councillor VonVillas voted NO to said motion.
43. Appointment of one (1) member to the Open Space and Fields Committee; one (1) vacancy, term expiring November 2023 and two (2) vacancies, to complete terms expiring November 2021.
On motion of Councillor Flynn, duly seconded, it was voted unanimously to appoint Erin Gauch to the Open Space and Fields Committee for a term expiring November 2023.
44. Appointment of one (1) member to the Pension Trust Fund Committee for a term expiring February 2024.
On motion of Councillor Flynn, duly seconded, it was voted unanimously to appoint Andrew Reilly to the Pension Trust Fund Committee for a term expiring February 2024.
45. Appointment of one (1) member to the Personnel Review Board- Bi-Partisan Board, Democrat or Republican Representative, two (2) vacancies, terms expiring June 2024.
On motion of Councillor Santos, duly seconded, it was voted unanimously to reappoint Manuel M. Marques to the Personnel Review Board (Democratic Representative) for a term expiring June 2024.
46. Appointment of one (1) member to the Senior Affordable Housing Committee- Newly Established Committee.
On motion of Council President Rodrigues, duly seconded, it was voted unanimously to appoint Alicia Hicks to the Senior Affordable Housing Committee.
47. Appointment of one (1) member to the Senior Citizens Board of Directors; one (1) vacancy, term expiring January 2024 and one (1) vacancy, to complete a term expiring January 2022.
On motion of Council President Rodrigues, duly seconded, it was voted unanimously to readvertise for the positions on the Senior Citizens Board of Directors.
48. Appointment of four (4) members to the Zoning Board of Review; one (1) vacancy, Regular Member, term expiring April 2026, one (1) vacancy, First Alternate, term expiring April 2022, one (1) vacancy, Second Alternate, term expiring April 2022, and one (1) vacancy, Third Alternate, term expiring April 2022. (Council may waive the requirement for reappointments; all new applicants shall be interviewed prior to appointment.)
On motion of Councillor Flynn, duly seconded, to appoint Adam Souza a Regular Member, Olin Gambrell as first alternate and Christopher Sousa as second alternate to the Middletown Zoning Board of Review.
Discussion centered around interviewing applicants and re-advertising to get enough applicants for the positions (current applications will be kept on file).
On motion of Councillor Flynn, duly seconded, it was voted unanimously to withdraw the above motion.
On motion of Councillor Santos, duly seconded, it was voted unanimously to adjourn said meeting at 10:46 p.m.
