MINUTES

Administrative:
1. Roll call: Roll call. The Zoning Board of Review was called to order at 6:00 pm. The board members present: Thomas Silveira (vice chairman/acting chairman), Eric Kirton, Stephen Huttler, and Antone Viveiros, and Thomas Heaney (secretary). Absent: James Miller (chairman), Judith Rosenthal, and Mark Donahue. Unless otherwise indicated the voting members for this meeting were: Thomas Silveira, Eric Kirton, Stephen Huttler, Antone Viveiros, and Thomas Heaney.
2. The Middletown Solicitor, Attorney Peter Regan., went over the changes to the state regulation for dimensional variances. Mr. Regan reviewed the changes/adjustments to the five dimensional variance requirements.

New Petitions:
Petition of: Dan Williams (Owner) for a Special Use from 803 & 902 and a Variance from 603 & 903 to construct a second floor addition located 5’-7” from the front (northern), 5’-0” from the front (eastern) property line where 25’ is required, and 16’-11” from the side (southern) property line where 20’ is required. Said real estate is located at 174 Renfrew Avenue and further identified as lot 33 on tax assessor’s plat 115 SE. . The petition of Dan Williams (Owner) for a Special Use from 803 & 902 and a Variance from 603 & 903 to construct a second floor addition located 5’-7” from the front (northern), 5’-0” from the front (eastern) property line where 18’9”’ is required, and 16’-11” from the side (southern) property line where 15’ is required. Mr. Williams explained the need for the additional special use and variance. Mr. Williams pointed out that he had previously received approval for the first floor variances (deck and stairs). Additionally, Mr. Williams wanted to clarify (along with his architect) that the second floor extension was on the plans previously submitted. However, he failed to request the special use and variances required for the proposed second floor extension on his written request. Mr. Huttle asked Mr. Williams if any of his neighbors objected to the project. Mr. Williams said his abutting neighbor was supportive of his plan to erect an addition of a new second floor. When the Chairman opened the meeting to the public, no one spoke out against the petition. After closing the hearing a motion was made to approve the petition by Eric Kirton and second by Stephen Huttler. There was no additional discussion among the board members. The board voted 5-0 to approve the petition. The reasons given for approval are:
1. That the special use will not result in the diminution of property values;
2. That the special use will not create a nuisance;
3. That the special use is not detrimental nor will it injure the proper use of the property;
4. That the special use will not result in hazardous conditions or conditions inimical to the public health, safety, or welfare.
A motion to adjourn the Jan 3, 2024 meeting was made by Stephen Huttler. Antone Viveiros second the motion. The meeting was adjourned at 6:15 pm.
