Present: First Warden Kenneth C. Lacoste, Town Councilor Martha Ball, Town Councilor Andre Boudreau and Town Councilor Christopher Willi.  Also present were Town Solicitor Kathy Merolla and for the recording of minutes, Deputy Town Clerk Millicent McGinnes.  Second Warden F. Norris Pike and Interim Town Manager Shirlyne Gobern were absent.

 

First Warden Lacoste called the meeting to order at 4:02 p.m.

Public Hearing for Transfer of Class BVL License:

Steve Filippi was present representing Shoreham, Inc.  It was noted that the Police Report shows many calls at Ballard’s.  Mr. Filippi confirmed that he was still working closely with the Police Department and has a security detail.

It was noted with aggravation that no one was present representing Champlin’s Trader Vic’s.  Mr. Lacoste moved to renew a Class BV Liquor License issued to Champlin’s Trader Vics, Inc. d/b/a Champlin’s Trader Vics pursuant to a site plan on file, pending receipt of a Certificate of Good Standing from the Division of Taxation and to grant permission for dancing and to remain closed from December 1, 2017 to April 15, 2018 and from October 15, 2018 to November 30, 2018 and to further require the correction of any fire code violations and that food be available at a sandwich level, as opposed to offering solely snack foods, during all times alcoholic beverages are sold.  The motion was seconded by Mr. Willi and carried.

Club Soda, Inc. Stockholders: Maxon Balmforth, Jr. & Glenn McKiernan, d/b/a Club Soda / Highview, Connecticut Avenue

Max Balmforth was present representing Club Soda.  The Council and NSPD Chief Carlone discussed the volume of police calls and incidents that have taken place at Club Soda over the year.  From the audience, neighbor John Cullen stated that the noise, lack of crowd control and fighting is as bad as it has ever been.  It was noted that letters complaining about Club Soda’s loud noise and loose operations were received from neighbors Verna Littlefield, Marguerite Donnelly, Mary Donnelly and Shel Swanson.  Chief Carlone recommended conditions be placed on the license and that if the there is a violation of the conditions, a “show cause” hearing be held to potentially revoke the license.

 

Mr. Lacoste moved to renew a Class BV Liquor License issued to Club Soda, Inc. d/b/a Club Soda pursuant to a site plan on file, pending receipt a Certificate of Good Standing from the Division of Taxation and to grant permission to remain closed from April 1, 2018 to April 30, 2018 and for dancing and to further require the correction of any fire code violations and that food be available at a sandwich level, as opposed to offering solely snack foods, during all times alcoholic beverages are sold.  Additionally, the license be granted with the following conditions:

  1. Club Soda management shall not consume any alcoholic beverage(s) while on the Premises. (For purposes of these restrictions, “Premises” includes the building in which Club Soda is located and the lot upon which the building is located.)
  2. In the event that the police are called to respond to any matter occurring at the Premises, Club Soda management and personnel shall be courteous and cooperative with the responding officer(s).
  3. Club Soda management shall engage in no physical altercation(s) on the Premises and, in the event of any potential physical altercation(s), Club Soda management/personnel shall immediately notify the New Shoreham Police Department.
  4. Club Soda management and personnel shall report to the New Shoreham Police Department any illegal drug activity of which they become aware which occurs on the Premises.
  5. Club Soda management shall not permit its patrons or the public to congregate around/near the front door of the building and signage shall be posted on the building to the that effect.

Old Island Pub, LLC, Member: Lewis N. Gaffett, d/b/a Old Island Pub, Corn Neck Road

Attorney William Landry was present representing Old Island Pub.  He explained that the Old Island Pub building just received Planning and Zoning approvals and is ready to begin construction.  He further explained that the previous year’s license was issued and used, so it is not subject to Rule 14, which only addresses licenses granted but not issued.  He stated that the building should be ready for operation in August 2018.

Public Hearing for New Class BV Liquor License:

Receive and act on new Class BV liquor license application from Audino, Inc., Stockholders: Brenna Audino and Ross Audino, d/b/a Tigerfish, Corn Neck Road, Plat 5, Lot 10

Attorney Kelly Morris was present representing Audino, Inc.  She raised the following points explaining why Tigerfish should receive a new Class BV liquor license:

 

Mr. Lacoste stated that he believed the use of the Class P Caterers license for operation in the restaurant for routine service was not fitting with the law.  Ms. Morris countered, stating the law allows for service five hours per day and there is no violation of the law in the license’s use.

 

It was noted that nine letters were received in support of granting the license and one letter was received against the action.

 

First Warden Lacoste moved to grant a Class BV liquor license to Audino, Inc., Stockholders: Brenna Audino and Ross Audino, d/b/a Tigerfish, Corn Neck Road, Plat 5, Lot 10, subject to receipt of RI Division of Taxation clearance and to grant permission for dancing and to remain closed from December 1, 2017 to April 30, 2018 and from October 15, 2018 to November 30, 2018 and to further require the correction of any fire code violations and that food be available at a sandwich level, as opposed to offering solely snack foods, during all times alcoholic beverages are sold.  The motion was seconded by Mr. Boudreau.

 

Following discussion, Mr. Lacoste moved to amend the motion on the floor to add the language, “providing the cap on licenses is raised.”  Mr. Willi seconded the amendment and it carried.

Mr. Lacoste stated as a qualifier to his vote that any further action of using a Class P Caterers license for regular restaurant service will result in potential legal action.

 

Public Hearing for New Class BH Liquor License:

Receive and act on new Class BH liquor license application from Block Island

Accommodations, LLC, Member: Cariona Corccoran, d/b/a Bellevue, High Street, Plat 7,

Lot 73-2

Attorney Erik Wallin and Cariona Corccoran were present representing Block Island Accommodations, LLC.  Cariona Corccoran stated that she wanted to provide liquor service in the hotel guest rooms to improve her guest’s experience, help increase revenues at both the inn and at the Town level through taxes.  Attorney Wallin stated that a Class BH license is available and the liquor service is unobtrusive, as it is served in the rooms. 

 

Town Attorney Kathy Merolla noted that the license is only subject to a licensed hotel and Building Official Marc Tillson disapproved the license, as the inn doesn’t meet the qualifications of a hotel.  Attorney Wallin stated that state law definition for hotels includes inns.

 

From the audience, Christine Grele, Terri Chmiel, Anna Mullen and Linda Powers spoke in opposition to granting the license, noting the following:

 

Two letters of objection were noted as being received.

 

Attorney Wallin asked to have the hearing continued to address the concerns of the Building Official.

 

Ms. Ball moved to continue the hearing to December 4, 2017 to give the applicant time to address the concerns of the Building Official.  Mr. Willi seconded the motion and it carried.

Mr. Lacoste moved to grant a new outdoor entertainment license, in accordance with the Town of New Shoreham ordinances and the application on file, to Island Caterers, Inc., d/b/a Dead Eye Dick’s, Ocean Avenue, Plat 5, Lot 66.  The motion was seconded by Mr. Boudreau and carried.
