The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held in accordance with Governor Raimondo’s Executive Order 20-25 on February 10, 2021 at 6:30 p.m.

Julia Forgue, Director of Utilities, provided information on the water break incident that occurred on February 10, 2021 and the low-pressure advisory.

MAYOR NAPOLITANO opened the public hearing. COUNCILOR LEONARD moved to close the public hearing. Seconded by COUNCILOR CEGLIE. COUNCILOR BOVA asked the City Manager about the second public hearing on the CIP and the timing of the workshop. CITY MANAGER NICHOLSON addressed the question. COUNCILOR LEONARD addressed the CIP. The motion to close the public hearing was VOTED UNANIMOUSLY.

COUNCILOR CEGLIE moved to approve the Consent Calendar in its entirety. Seconded by COUNCILOR HOLDER. Discussion occurred among the Council regarding the fireworks application and fireworks ordinance. CITY SOLICITOR BEHAN addressed the Council. COUNCILOR CEGLIE moved to continue the fireworks application to February 24, 2021. Seconded by COUNCILOR LEONARD. Discussion occurred among the Council. The motion to continue was VOTED UNANIMOUSLY.
COUNCILOR CEGLIE moved to approve the Holiday Selling License. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
3. Mobile Food Establishment (MFET), Renewals:
a. 1899, LLC, d/b/a La Costa Lobster and Tacos, 186 Bellevue Ave., Newport, RI
COUNCILOR CEGLIE moved to continue the application to February 24, 2021. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
b. Amano LLC, d/b/a A Mano Pizza & Gelato, 181 Bellevue Ave. #315, Newport, RI
COUNCILOR CEGLIE moved to continue the application to February 24, 2021. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
4. Mobile Food Establishment (MFEC), Renewal:
a. Wally’s Hot Dog Cart, LLC, d/b/a Wally’s Hot Dog Cart, 252 Oliphant Lane, Middletown, RI
COUNCILOR CEGLIE moved to continue the application. Seconded by COUNCILOR LEONARD. Discussion occurred among the Council. COUNCILOR CEGLIE struck her motion to continue the application and moved to approve the application. Seconded by COUNCILOR FUERTE. COUNCILOR LEONARD asked regarding the approved areas of operation for MFECs. ASSISTANT CITY SOLICITOR GALVIN addressed the question. The motion to approve was VOTED UNANIMOUSLY.
5. Resolution Authorizing the Issuance of General Obligation School Refunding Bonds of the City of Newport to Refund the City's General Obligation Bonds Issued to the Rhode Island Health and Educational Building Corporation and the City's General Obligation Bond Dated June 20, 2013 Issued for School Purposes

COUNCILOR CEGLIE moved to approve the resolution. Seconded by COUNCILOR FUERTE. Discussion occurred among the Council. Laura Sitrin, Finance Director, responded to questions from the Council. The motion to approve was VOTED UNANIMOUSLY.
6. Amending Chapter 14.04 entitled, Comprehensive Plan, Section 14.04.010, entitled, “Comprehensive Planning and Land Use Act” (Second Reading)
COUNCILOR CEGLIE moved to approve the ordinance. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
7. Amending Chapter 5.57 entitled, Mobile Food Establishments, Section 5.57.040, entitled, “Restrictions on Permit” (First Reading)
COUNCILOR CEGLIE moved to continue the ordinance. Seconded by COUNCILOR LEONARD. Discussion occurred among the Council. The motion to continue was VOTED UNANIMOUSLY.
8. Action Item #5956/21 – RE: Special Detail Rates (w/accompanying ordinance)
COUNCILOR CEGLIE moved to approve the ordinance. Seconded by COUNCILOR BOVA. COUNCILOR LEONARD asked about the rates and application of fees. Laura Sitrin, Finance Director, addressed the questions. COUNCILOR FUERTE asked about assistance available to groups. CITY MANAGER NICHOLSON addressed the question. The motion to approve was VOTED UNANIMOUSLY.
9. Action Item #5957/21 – RE: RFP #21-016 – Lease of Retail Space at Easton’s Beach (w/accompanying resolution)
COUNCILOR CEGLIE moved to approve the resolution. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
COUNCILOR CEGLIE moved to adjourn as Council and convene as Board of License Commissioners. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
CITY SOLICITOR BEHAN provided an update to the Council.

2. Action Item #5959/21 – RE: Show Cause Hearing: Salvation Café, Inc., d/b/a Salvation Café – Operating Without a Valid Class C Alcoholic Beverage License
COUNCILOR CEGLIE moved the Show Cause Hearing for Salvation Café, Inc. be dismissed. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
3. Action Item #5960/21 – RE: Show Cause Hearing: The Protective Club, d/b/a Protective Club – Operating Without a Valid Class D Alcoholic Beverage License
4. Action Item #5961/21 – RE: Show Cause Hearing: Pyramid Club, d/b/a Pyramid Club – Operating Without a Valid Class D Alcoholic Beverage License
COUNCILOR CEGLIE moved the Show Cause Hearing for Mermaids Newport, LLC, The Protective Club, and the Pyramid Club be continued to the March 24, 2021 hearing. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
