MINUTES FOR THE REGULAR COUNCIL MEETING

FEBRUARY 24, 2021

The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting to be held in accordance with Governor Raimondo’s Executive Order 21-10 (2) and 20-46-1(a) on February 24, 2021 at 6:30 p.m.

 

The CITY CLERK called the roll, and the following members were present:

1.   CONSENT CALENDAR (THE CONSENT CALENDAR IS APPROVED IN ITS ENTIRETY UNLESS THE COUNCIL REMOVES AN ITEM FOR DISCUSSION.  ALL LICENSES ARE GRANTED SUBJECT TO COMPLIANCE WITH ORDINANCES #31-80 AND #98-40.)

1.   Fireworks Display – Bailey’s Beach Club, d/b/a Bailey’s Beach Club Fireworks, barge off Bailey’s Beach Club; July 3, 2021, 6-minute display beginning at 9:18 p.m. – Continued from February 10, 2021

 

COUNCILOR CEGLIE moved to approve the application.  Seconded by COUNCILOR LEONARD.   COUNCILOR LEONARD expressed concern regarding a fireworks display which occurred in September 2020 and requested the company be notified and reminded of safety concerns regarding the display.

 

c.   2020 Annual Report – Board of Tax Appeals (Receive)

 

REMOVED   d.   Communication from Clean Ocean Access, re: Clean Ocean Access 2020 Updates (Receive)

 

Eva Touhey, COA, addressed the Council regarding the report.  COUNCILOR CEGLIE moved to receive the report.  Seconded by COUNCILOR BOVA.  MAYOR NAPOLITANO thanked Clean Ocean Access for their work in the community and the students of the Newport School Department and VOTED UNANIMOUSLY.

 

REMOVED   e.   Communication from the Planning Board, re: Review for Diversity, Equity, and Inclusion in the Comprehensive Plan (Receive)

 

COUNCILOR MCCALLA introduced the communication and requested Patricia Reynolds, Director of Planning, address the Council to discuss the communication.  COUNCILOR MCCALLA moved to receive the communication and refer to administration.  Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.

 

f.    Communication from the Planning Board, re: Tree and Open Space Ordinance (Receive)

 

g.   Popular Annual Financial Report - July 1, 2019 – June 30, 2020 (Receive)  

 

COUNCILOR CEGLIE moved to approve the Consent Calendar in its entirety with the exception of items b(1), d and e.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

LICENSES AND PERMITS

 

2.   Victualing License, Boru Noodles LLC, d/b/a Boru Noodle Bar, 36 Broadway and 51-53 Marlborough St. (In conjunction with liquor license transfer of Mission, LLC)

 

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

 

3.   Mobile Food Establishment (MFET), Renewals:

 

a.   1899, LLC, d/b/a La Costa Lobster and Tacos, 186 Bellevue Ave., Newport, RI – Continued from February 10, 2021

 

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.

 

b.   Amano LLC, d/b/a A Mano Pizza & Gelato, 181 Bellevue Ave. #315, Newport, RI – Continued from February 10, 2021

 

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR HOLDER.  COUNCILOR CEGLIE had a question for the applicant regarding the business address.  John Boxer, addressed the Council on behalf of the applicant.  The motion to approve was VOTED UNANIMOUSLY.

 

4.   Mobile Food Establishment (MFEC), Renewal:

 

a.   Jordan Durand, d/b/a Simple Merchant, 1 Arcadia Avenue, North Dartmouth, MA

 

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.

 

APPOINTMENTS TO BOARDS AND COMMISSIONS

 

RESOLUTIONS

 

5.   Resolution of the City of Newport approving the issuance of not to exceed $106,500,000 General Obligation bonds, notes and other evidences of indebtedness to finance all costs relating to the construction, renovation, improvement, alteration, repair, landscaping, furnishing and equipping of: (I) an addition to the Claiborne Pell Elementary School, including, but not limited to, classrooms and associated support space site improvements, and parking and (II) a new school facility for the William S. Rogers High School, provided that the authorization shall be reduced by the amount of certain grants received from State bond proceeds, from the Rhode Island Department of Education or from the Rhode Island School Building Authority

COUNCILOR CEGLIE moved to adopt the resolution.  Seconded by MAYOR NAPOLITANO and VOTED UNANIMOUSLY.

 

6.   Language Access Plan – E. Fuerte, A. McCalla, J. Bova, L. Ceglie, C. Holder

 

COUNCILOR FUERTE introduced the resolution and moved for its passage.  Seconded by COUNCILOR MCCALLA.  Discussion occurred among the Council.  The motion to approve the resolution was VOTED UNANIMOUSLY.

 

ORDINANCES

 

7.   Amending Chapter 2.120 entitled, General Fee Schedule, Section 2.120.010, entitled, “Fees for Permits and Licenses” (Second Reading)

 

COUNCILOR CEGLIE moved to adopt the ordinance on second reading.   Seconded by COUNCILOR MCCALLA and VOTED UNANIMOUSLY.

 

8.   Amending Chapter 5.57 entitled, Mobile Food Establishments, Section 5.57.040, entitled, “Restrictions on Permit” (First Reading) – Continued from February 10, 2021

 

-          Communication from Jason and David Bazarsky

 

COUNCILOR  CEGLIE moved to approve the ordinance.  Seconded by MAYOR NAPOLITANO.  Discussion occurred among the Council.  COUNCILOR MCCALLA moved to table the ordinance and schedule a workshop.  Seconded by COUNCILOR FUERTE and voted 4-3 with MAYOR NAPOLITANO, COUNCILOR HOLDER and COUNCILOR LEONARD opposed.

9.   Action Item #5962/21 – RE: Award of Bid #21-017 – School and Cemetery Mowing (w/accompanying resolution)

1.   Application of Mission, LLC, d/b/a Mission, 29 (Unit 3) & 31 Marlborough St., holder of a Class BL alcoholic beverage license to transfer ownership and location to Boru Noodles LLC (Casey Shea – 50% and Steve Lucier – 50%), d/b/a Boru Noodle Bar, at 36 Broadway and 51-53 Marlborough St. (Hearing)

 

COMMISSIONER CEGLIE moved to close the public hearing and approve the license.  Seconded by COMMISSIONER HOLDER and VOTED UNANIMOUSLY.
