MINUTES FOR THE  REGULAR COUNCIL MEETING

JANUARY 27, 2021

The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held in accordance with Governor Raimondo’s Executive Order 20-25 on January 27, 2021 at 6:30 p.m.

 

The DEPUTY CITY CLERK called the roll, and the following members were present:

CITIZENS’ FORUM

 

1.   PUBLIC HEARING:   Proposed Amendments to the Comprehensive Land Use Plan 2017 to add the North End Urban Plan

 

COUNCILOR CEGLIE moved to receive and refer a communication from Brian Bardorf, Esq., concerning the Newport Tradesmen Center to the City Solicitor.  Seconded by COUNCILOR LEONARD and VOTED  UNANIMOUSLY.

 

CITY SOLICITOR BEHAN  addressed the Council regarding the letter.  COUNCILOR BOVA requested follow-up from the City Solicitor.  COUNCILOR MCCALLA requested clarification regarding the adoption of the North End Urban Plan.

 

MAYOR NAPOLITANO opened the public hearing.

 

a.   Recommendation from the Planning Board

 

COUNCILOR CEGLIE moved to approve the recommendation from the Planning Board. Seconded by COUNCILOR LEONARD and VOTED  UANIMOUSLY.

 

Patricia Reynolds, Director of Planning, addressed the Council regarding the Comprehensive Land Use Plan 2017, the amendment  process, and the North End Urban Plan. Chris Herlich and Alan Mountjoy, NBBJ, presented the North End Urban Plan. Kim Salerno, Planning Board Chair, addressed the Council regarding the North End Urban Plan.

 

Discussion occurred among the Council regarding the North End Urban Plan and the Comprehensive Land Use Plan 2017. Patricia Reynolds, Director of Planning, and Kim Salerno, Planning Board Chair, addressed the Council to answer questions.

 

The following members of the public addressed the Council: Bonnie Watson, 44 Catherine St.

COUNCILOR CEGLIE moved to approve the Proposed  Amendment #1.  Seconded by

COUNCILOR HOLDER and VOTED  UNANIMOUSLY.

 

b.   Ordinance Amending Chapter 14.04 entitled, Comprehensive Plan, Section 14.04.010, entitled, “Comprehensive Planning and Land Use Act” (First Reading)

 

COUNCILOR CEGLIE moved to adopt the ordinance on first reading.  Seconded by COUNCILOR FUERTE.  Patricia Reynolds, Director of Planning, addressed COUNCILOR BOVA’S question regarding the adoption process.

 

COUNCILOR CEGLIE moved to close the public hearing.  Seconded by COUNCILOR LEONARD and VOTED  UNANIMOUSLY.

 

The motion to adopt the ordinance was VOTED  UNANIMOUSLY.

 

2.   CONSENT CALENDAR

(THE CONSENT CALENDAR IS APPROVED IN ITS ENTIRETY UNLESS THE COUNCIL REMOVES AN ITEM FOR DISCUSSION.  ALL LICENSES ARE GRANTED SUBJECT TO COMPLIANCE WITH ORDINANCES #31-80 AND #98-40.)

 

a.   Holiday Selling License, Renewal, Red Door Ventures, Inc., d/b/a Wag Nation, 181 Bellevue Ave. (new location)

COUNCILOR MCCALLA moved to receive the CIP and refer to the Planning Board. Seconded by COUNCILOR FUERTE. Discussion occurred among the Council. CITY MANAGER NICHOLSON addressed the Council.

 

COUNCILOR CEGLIE moved to receive the CIP and order advertised for public hearing on February 10, 2021. Seconded by COUNCILOR BOVA. CITY MANAGER NICHOLSON addressed the Council. CITY SOLICITOR BEHAN  and CITY MANAGER NICHOLSON addressed COUNCILOR MCCALLA regarding the language to amend the motion.

 

COUNCILOR MCCALLA moved to amend the motion to receive the CIP and refer to the Planning Board for review before a scheduled April 1, 2021 deadline. Seconded by COUNCILOR FUERTE.  The motion failed (3-4).

COUNCILOR CEGLIE restated the motion to receive and order advertised for public hearing on February 10, 2021 for the CIP FY2022-2026. Seconded by COUNCILOR LEONARD and VOTED  6-1 with COUNCILOR MCCALLA opposed.

 

d.   Comprehensive Annual Financial Report (CAFR) for the year ended June 30, 2020 (Receive) - A copy for review is in the City Clerk’s Office and on the city’s website http://www.cityofnewport.com/departments/finance 

- Communication from Blum Shapiro (Receive)

 

e.   Communication from the Historic Cemetery Advisory Commission, re:  Requesting the City Council to reinstate CIP funding for Cemetery Restoration (Receive)

 

f.    Communication from Liam Barry, re:  Resignation from the Planning Board (Receive with regret)

 

REMOVED   g.  Communication from Dennis P. Sullivan, St. Patrick’s Day Parade Chairman, re:  2021 St. Patrick’s Day Parade (Receive)

 

COUNCILOR CEGLIE moved to receive the communication. Seconded by COUNCILOR BOVA.  COUNCILOR HOLDER addressed the proposed  date of the parade.  Dan Titus, representative for the St. Patrick’s Day Parade Committee, addressed the Council.  Discussion occurred among the Council regarding the scheduled date. The motion to receive was VOTED UNANIMOUSLY.

 

COUNCILOR CEGLIE made a motion to approve the Consent Calendar in its entirety with the exception of item c and g. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.

 

LICENSES AND PERMITS

 

3.   Victualing License, Renewal, 8-10 Broadway Newport, LLC, d/b/a Hope on Broadway, 8-10 Broadway and 1 River Lane first floor and basement

 

COUNCILOR CEGLIE moved to approve the license.  Seconded by MAYOR NAPOLITANO. Joelle Rocha, Esq., on behalf of 8-10 Broadway Newport, LLC, addressed the Council to answer questions regarding the status of the license. CITY SOLICITOR BEHAN addressed the Council regarding the license. The motion to approve was VOTED UNANIMOUSLY.

 

4.   Victualing License, New/Expansion, Chive Blossom, LLC, d/b/a Stoneacre Garden, 151 Swinburne Row, and to expand the premises to include 723 sq. foot roof top patio (In conjunction with liquor license transfer of L & B Associates, LLC)

 

CITY SOLICITOR BEHAN addressed the Council regarding the restrictions imposed by the Zoning Board of Review. COUNCILOR CEGLIE moved to approve the license subject to the restrictions imposed by the Zoning Board.  Seconded by COUNCILOR HOLDER.  CITY SOLICITOR BEHAN addressed questions by COUNCILOR LEONARD.  Discussion occurred among Council.  The motion to approve was VOTED UNANIMOUSLY.

MAYOR NAPOLITANO moved to approve the appointments.  Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.

 

Reappointments

Historic District Commission – Joanne Salvo (term expires 2/3/2023)

 

MAYOR NAPOLITANO moved to continue to the appointment to February 10, 2021. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

Tree and Open Space – Maureen Cronin Marosits (term expires 3/27/2022)

 

MAYOR NAPOLITANO moved to reappoint Maureen Cronin Marosits to Tree and Open Space.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

RESOLUTIONS

 

6.   Council Rules

 

COUNCILOR CEGLIE moved to approve.  Seconded by COUNCILOR BOVA. COUNCILOR CEGLIE moved to amend the Council Rules to include closed executive sessions be conducted at City Hall to ensure confidentiality of information provided to the Council.  Seconded by MAYOR NAPOLITANO. Discussion occurred among Council.  The motion to amend was voted (4-3).

COUNCILOR HOLDER introduced the resolution and moved for its passage.  Seconded by COUNCILOR CEGLIE.  Discussion occurred among Council.  The motion to approve was VOTED  UNANIMOUSLY.

 

ORDINANCES

 

8.   Amending Chapter 10.52.010 of the Codified Ordinances, “entitled”, “No through-streets listed—Signs required”,  to add Leal Terrace (Second Reading)

 

COUNCILOR CEGLIE moved to approve the ordinance on second reading.  Seconded by MAYOR NAPOLITANO and VOTED  UNANIMOUSLY.

 

9.   Amending Chapter 10.32.110 of the Codified Ordinances, entitled “Designated residential parking streets” to add Marchant Street from Atlantic Street to Eastnor Road (Second Reading)

 

COUNCILOR CEGLIE moved to approve the ordinance on second reading.  Seconded by

MAYOR NAPOLITANO and VOTED  UNANIMOUSLY.

 

COMMUNICATIONS FROM THE CITY MANAGER

 

10. Memorandum from the City Manager RE: Homestead Exemption

 

CITY MANAGER NICHOLSON addressed the Council. COUNCILOR BOVA  moved to receive the Memorandum.  Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.

 

11. Action Item #5955/21 – RE:  Award of Bid # 21-014 - Custom Reactivated and/or Virgin Granular Activated Carbon (w/accompanying resolution)

 

COUNCILOR CEGLIE moved to receive the Communication and adopt the accompanying resolution.  Seconded by MAYOR NAPOLITANO and VOTED  UNANIMOUSLY.

 

COUNCILOR CEGLIE moved to adjourn as Council and convene as Board of License Commissioners.  Seconded by COUNCILOR FUERTE and VOTED  UNANIMOUSLY.

 

BOARD OF LICENSE COMMISSIONERS

1.   2020-2021 Liquor License, Renewal, Class BV, 8-10 Broadway Newport, LLC, d/b/a Hope on Broadway, 8-10 Broadway & 1 River Lane, First Floor and Basement (Hearing)

 

MAYOR NAPOLITANO opened the public hearing.  COMMISSIONER CEGLIE moved to approve the license.  Seconded by MAYOR NAPOLITANO. Joelle Rocha, Esq., on behalf of 8-10 Broadway Newport, LLC, addressed the Council to answer questions.  COMMISSIONER LEONARD moved to close the public hearing and approve the license.  Seconded by MAYOR NAPOLITANO and VOTED  UNANIMOUSLY.

 

2.   Application of L & B Associates, LLC, d/b/a Stonearce, 151 Swinburne Row, holder of a Class BV alcoholic beverage license to transfer ownership to Chive Blossom, LLC (Crispy Shallots, LLC- 100%), d/b/a Stoneacre Garden, 151 Swinburne Row and to expand the license premises to include a 723 sq. foot rooftop patio limited to 49 seats (Hearing)

 

MAYOR NAPOLITANO opened the public hearing.  COMMISSIONER CEGLIE moved to close the public hearing and approve subject to the restrictions imposed by the Zoning Board of Review.   SECONDED BY COMMISSIONER FUERTE and VOTED  UNANIMOUSLY.
