MINUTES FOR THE REGULAR COUNCIL MEETING
MARCH 10, 2021

The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held in accordance with former Governor Raimondo’s Executive Order 21-10 and 20-46 on March 10, 2021 at 6:30 p.m.
The CITY CLERK called the roll, and the following members were present:

MAYOR NAPOLITANO opened the public hearing. Discussion occurred among the Council. William Riccio, Director of Public Services, addressed the Council to answer questions for Council McCalla regarding traffic lights. COUNCILOR CEGLIE moved to close the public hearing and adopt the accompanying resolution. Seconded by COUNCILOR BOVA and VOTED UNANIMOUSLY.

COUNCILOR LEONARD raised concerns due to the fact the Department of Environmental Management has not approved the license. COUNCILOR LEONARD moved to continue the application until DEM has reviewed and approved the license. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

COUNCILOR CEGLIE moved to approve the Second-hand License Renewals with the exception of Bike Newport. Seconded by COUNCILOR BOVA and VOTED UNANIMOUSLY.
COUNCILOR MCCALLA recused.
COUNCILOR CEGLIE moved to approve Bike Newport. Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY (6-0).

COUNCILOR CEGLIE moved to adopt the Consent Calendar in its entirety with the exception of items b (3) and h. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
3. Victualing License, New, The Nitro Cart, LLC, d/b/a The Nitro Bar, 404 Thames St.
COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.
4. Special Event License, Audrain Automobile Museum, Inc., d/b/a Audrain Newport Concours & Motor Week, Various locations throughout the city (list attached); September 30, 2021-October 3, 2021
COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR BOVA. COUNCILOR BOVA had questions regarding the event and use of state parks. John Boxer, Audrain Museum, addressed the Council regarding the use of state parks.
COUNCILOR LEONARD to moved to approve the license with the exception of the portion of the event taking place at Fort Adams until DEM has approved. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
- Request to close Bellevue Avenue from Bowery St. to William Street from 11:00 a.m. to 2:00 p.m. October 2, 2021;
COUNCILOR CEGLIE moved to approve the street closure request. Seconded by COUNCILOR BOVA and VOTED UNANIMOUSLY.
- Communication requesting permission to use golf carts;
- Communication requesting permission to place signage throughout the city.
COUNCILOR LEONARD moved to approve the use of the golf carts and signage subject to the same conditions approved for the 2019 event. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
5. Special Event License, Review, Rhode Races & Events, Inc., d/b/a Newport Rhode Races (route attached); Easton’s Beach; April 17, 2021 from 7:30 a.m. to 1:30 p.m. (Previously approved July 8, 2020)
COUNCILOR CEGLIE moved to rescind the license. Seconded by COUNCILOR BOVA. Susan Rancort, Rhode Races & Events, Inc. addressed the Council. Discussion occurred among the Council. CITY MANAGER NICHOLSON addressed the Council regarding the race and concerns the administration has regarding the safety of the race. Discussion continued regarding working with the administration to select a new date in June 2021. COUNCILOR CEGLIE moved to rescind the license and direct the organizers to work with the administration to select a new date for the race. Seconded by COUNCILOR BOVA and voted 5-1 with COUNCILOR LEONARD opposed.
6. Newport Festa Italiana, d/b/a Newport Festa Italiana, Edward King House, Touro Park & parade on city streets; September 28 & 30, 2021 and October 5, 2021 from 6:00 p.m. to 8:00 p.m.; October 2, 2021 from 11:00 a.m. to 4:00 p.m. and October 11, 2021 from 12:00 p.m. to 1:30 p.m.
COUNCILOR CEGLIE moved to approve the license and approve the request to waive the license fees. Seconded by COUNCILOR BOVA and VOTED UNANIMOUSLY.
- Request to waive all license fees associated with the event including, special event, banner license and park use fees
7. Pedicab Business License, Renewal (1 pedicab- May 1, 2021-April 30, 2023), Timothy Burke, d/b/a Grace Pedicab, 6 Karen Ann Dr., Bristol, RI
COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR LEONARD. Bonnie Watson, 44 Catherine St. addressed the Council regarding safety. The motion to approve was VOTED UNANIMOUSLY.
8. Pedicab Business License, Renewal, (2 pedicabs- May 1, 2021-April 30, 2023), Justin Richardson, d/b/a I Wanna Ride Pedicab, LLC, 84 Wayne St., Warwick, RI
COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.

MAYOR NAPOLITANO moved to appoint Alyson Oakley to the Beach Commission. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
Energy and Environment Commission – Sam Whitin (3-year term) expires 4/9/22
MAYOR NAPOLITANO moved to appoint Sam Whitin to the Energy and Environment Commission. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
Tree and Open Space Commission (2 vacancies)– Lauren Parmelee and Kara DiCamillo (3-year terms) expires 3/10/24
MAYOR NAPOLITANO moved to appoint Lauren Parmelee and Kara DiCamillo to the Tree and Open Space Commission. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
Historic District Commission (2 vacancies) -3-year terms expire 2/3/2023 and 2/3/2024 –Richard Adams, Sean Driscoll, Dale Nelson, Michael Ryan
MAYOR NAPOLITANO moved to appoint Richard Adams and Michael Ryan to the Historic District Commission. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
Henderson Home Commission (2 vacancies) – Joanne Ritchie, Derek Grinkin (1-year terms) expire 3/10/2022
MAYOR NAPOLITANO moved to appoint Joanne Ritchie and Derek Grinkin to the Henderson Home Commission. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
12. Equitable Development added to the Comprehensive Land Use Plan- J. Bova, E. Fuerte, A. McCalla
COUNCILOR BOVA introduced the resolution and moved for its passage. Seconded by COUNCILOR MCCALLA. Discussion occurred among the Council. The motion to adopt the resolution failed (2-4) with MAYOR NAPOLITANO, COUNCILOR CEGLIE, COUNCILOR LEONARD and COUNCILOR HOLDER opposed.
13. Action Item #5963/21 – RE: Award of Bid #21-028 – Portable Toilets (w/accompanying resolution)
COUNCILOR BOVA introduced the resolution and moved for its passage. Seconded by COUNCILOR MCCALLA. Discussion occurred among the Council. The motion to adopt the resolution failed (2-4) with MAYOR NAPOLITANO, COUNCILOR CEGLIE, COUNCILOR LEONARD and COUNCILOR HOLDER opposed.
14. Action Item #5964/21 – RE: Amendment No. 2- Contract # 19-010 Engineering Services for North End Sanitary Sewer Project (w/accompanying resolution)
COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
15. Action Item #5965/21 – RE: Show Cause Hearing – Karma Pizza Co., LLC, d/b/a Karma Pizza – Violation of the General Laws of Rhode Island and Codified Ordinances of the City of Newport - Failure to Meet the Conditions of the City Council in Granting of Victualing License
COUNCILOR CEGLIE moved to continue the hearing to March 24, 2021. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
COUNCILOR CEGLIE moved to adjourn as Council and convene as Board of License Commissioners. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
