The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held on November 9, 2022 at 6:30 p.m. in the City Council Chambers, City Hall, 43 Broadway, Newport, RI 02840.

COUNCILOR MCCALLA read the resolution into the record honoring COUNCILOR BOVA.

COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR FUERTE. COUNCILOR LEONARD had questions regarding the event and moved to refer it to the City Administration to work out the details. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
c. Communication from CRMC, re: Public Notice, New York Yacht Club, 5 Halidon Ave. for a State of Rhode Island Assent (Receive)

COUNCILOR BOVA moved to receive the communication and referenced their support for waterfront access. Seconded by COUNCILOR MCCALLA and VOTED UNANIMOUSLY.
e. Communication from Marco Camacho, re: Resignation from the Aquidneck Island Planning Commission (Receive with regret)
f. Communication from Ingrid Peters, re: Resignation from the Historic Cemetery Advisory Commission (Receive with regret)
g. Communication from Lillian Hargrove, re: Resignation from the Juvenile Hearing Board (Receive with regret)
h. Communication from Richard David Adams, re: Resignation from the Historic District Commission (Receive with regret)
COUNCILOR CEGLIE moved to adopt the Consent Calendar in its entirety with the exception of items b(5) and (d). Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
2. Pedicab Business License, Renewal, Timothy Burke, d/b/a Grace Pedicab Corp, 6 Karen Ann Drive, Bristol, RI (1 pedicab)- continued from October 26, 2022
COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR FUERTE. COUNCILOR LEONARD moved to amend the application to remove the stands in residential areas. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
COUNCILOR CEGLIE moved to approve the license as amended. Seconded by COUNCILOR BOVA and VOTED UNANIMOUSLY.
3. Entertainment License Expansion Class B (outdoors), Goat Lessee, LLC, d/b/a Newport Harbor Island Resort, One Goat Island, to expand the outdoor entertainment license to operate an outdoor skating rink on the North Lawn, November 18, 2022 through February 28, 2023 from 10:00 a.m. to 9:00 p.m.(Hearing)

COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR FUERTE. David Smiley, General Manager, addressed the Council to request permission to operate the skating rink prior to the second hearing of the license. COUNCILOR CEGLIE moved to refer the request to the City Administration. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
COUNCILOR CEGLIE moved to close the public hearing and approve. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
4. Entertainment License Expansion, Class A (indoors), Broadway Tavern, Ltd., d/b/a Tavern on Broadway, 12, 16 & 18 Broadway to expand the entertainment into 12 Broadway, Monday through Sunday from 12:00 p.m. to 1:00 a.m. (Hearing)
COUNCILOR CEGLIE moved to close the public hearing and approve. Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.
5. 2022-2023 Victualing License Renewals (list attached):

COUNCILOR CEGLIE moved to approve the license renewals. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.

Historic Cemetery Advisory Commission- 2 vacancies

MAYOR NAPOLITANO moved to appoint Joan F. McCarthy and James Lappin to the Historic Cemetery Advisory Commission. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
Reappointments:
Historic Cemetery Advisory Commission- Lew Keen- (3- year term expires 10/26/2025)
MAYOR NAPOLITANO moved to reappoint Lew Keen. Seconded by COUNILOR CEGLIE and VOTED UNANIMOUSLY.
Zoning Board of Review- Samuel Goldblatt (5- year term expires 12/12/2027)
MAYOR NAPOLITNAO moved to continue the reappointment to December 14, 2022. Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.
Historic District Commission- Karl “Andy” Bjork- 3- year term expires 2/3/2026)

Juvenile Hearing Board- Tracy Shea (3- year term expires 11/17/2025), Christopher Lewia (3-year term expires 11/17/2025), Pamela Breves (3-year term expires 11/17/2025)
MAYOR NAPOLITANO moved to reappoint Tracy Shea, Christopher Lewia and Pamela Breves. Seconded by COUNCILOR LEONARD and VOTED UNANIMOUSLY.
Affirmative Action Commission- Fern Lima (3-year term expires 11/9/2025)
MAYOR NAPOLITANO moved to reappoint Fern Lima to the Commission. Seconded by COUNICLOR and VOTED UNANIMOUSLY.

COUNCILOR MCCALLA moved to withdraw the resolution. Seconded by COUNCILOR BOVA and VOTED UNANIMOUSLY.

11. Amending Chapter, 10.24.010 entitled, “Parking Prohibited at all times in designated places” (Second Reading)
COUNCILOR CEGLIE moved to approve the ordinance on second reading. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
12. Amending Chapter 10.20.170 entitled, “Towing by police division” (Second Reading)
COUNCILOR CEGLIE moved to approve the ordinance on second reading. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
13. Amending Chapter 4.08.120, entitled, “Property Tax Classification” (Second Reading)
COUNCILOR CEGLIE moved to approve the ordinance on second reading. Seconded by COUNCILOR FUERTE. COUNCILOR LEONARD moved to amend the ordinance to remove military personnel from the last sentence of paragraph c(6). Seconded by COUNCILOR BOVA and VOTED UNANIMOUSLY.
COUNCILOR CEGLIE moved to approve the ordinance as amended. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
14. Amending Chapter 3.16.060, entitled, “Pay Schedule for Classified Service” for AFSCME Clerical and Trade Positions (Second Reading)
COUNCILOR CEGLIE moved to approve the ordinance on second reading. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
15. Action Item #6107/22 – RE: Change Order #1-Contract for King Park Dinghy Dock Expansion (w/accompanying resolution)
COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
16. Action Item #6108/22 – RE: Hazard Mitigation Plan Update 2022 (w/accompanying resolution)
Patricia Reynolds, Director of Planning, addressed the Council regarding the plan update. COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR FUERTE and VOTED UNANIMOUSLY.
17. Action Item #6105/22 - RE: CRMC File No. 2022-06-148 - Application of William Ruh Trust - Construct and Maintain a Residential Boating Facility - 88 Washington Street- Continued from October 26, 2022
COUNCILOR CEGLIE moved to approve the communication. Seconded by COUNCILOR FUERTE. COUNCILOR MCCALLA had questions and concerns regarding the project and asked for Chestnut Street extension not be adversely impacted.
Jeremiah C. Lynch, III, Esq., addressed the Council on behalf of the property owner. CITY MANAGER NICHOLSON and CITY SOLICITOR BEHAN addressed the Council regarding the project. The motion to approve was VOTED UNANIMOUSLY.
