The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting to be held on July 12, 2023 at 6:30 p.m. in the City Council Chambers, City Hall, 43 Broadway, Newport, RI 02840.

COUNCILOR CEGLIE opened the public hearing. Robert Plain addressed the Council regarding the grant on behalf of Church Community Housing. COUNCILOR CEGLIE moved to close the public hearing and approve. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

COUNCILOR MCCALLA recognized Conexion Latina. Yolanda Macias addressed the Council regarding the event on behalf of Conexion Latina. COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

Marcella Baggot, Admiral Kalbfus Rd. addressed the Council.
COUNCILOR CEGLIE moved to receive the communication. Seconded by COUNCILOR NAPOLITANO.
e. Communication from Lew Keen, Chair, Historic Cemetery Advisory Commission, re: Appointment of representatives from organizations to the Historic Cemetery Advisory Commission (Receive)
COUNCILOR CEGLIE moved to approve the Consent Calendar in its entirety with the exception of items b (2) and d. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.
3. Victualing License, Extended Hours, Colbea Enterprises, L.L.C., d/b/a Seasons Corner Market, 138 JT Connell Highway and 184-186 Admiral Kalbfus Rd. to have extended hours between 2:00 a.m. and 6:00 a.m. (Hearing)
COUNCILOR CEGLIE moved to close the public hearing and approve. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.
4. Victualing License, New, Radish Patch, LLC, d/b/a Lorusso’s, 580 Thames St., Unit A 102
COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR HOLDER. COUNCILOR CARLIN moved to continue the application. Seconded by COUNCILOR NAPOLITANO. The motion failed (1 in favor -5 opposed).
The motion to approve was voted 5-1 with COUNCILOR CARLIN opposed.
5. Entertainment License, New, Class A (indoors), Newport Protective Club, d/b/a The Protective Club, 596 Thames St., to have entertainment on Sundays from 6:00 p.m. to 9:00 p.m. (Second Hearing)
COUNCILOR CEGLIE moved to close the public hearing and approve. Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.
Appointments:
Historic District Commission- Frank Balla-Alternate Member (3-year term, expires 2/9/25)
MAYOR KHAMSYVORAVONG moved to appoint Frank Balla as alternate member to the Historic District Commission. Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.
7. Requesting to amend Sections 10.20.180 (B)(6) and Section 10.20.200 of the Codified Ordinances to establish five spaces in the Touro Lot as resident only parking – D. Carlin
COUNCILOR CARLIN introduced the resolution and moved for its passage. Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.
8. Amending Chapter 5.12 of the Codified Ordinances, entitled, “Alcoholic Beverage Licenses”, to amend Section 5.12.40, entitled, “Number of Licenses Permitted”(First Reading)

COUNCILOR CEGLIE moved to adopt the ordinance on first reading. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.
9. Amending Chapter 5.57 of the Codified Ordinances, entitled, “Mobile Food Establishments”, to amend Section 5.57.040 entitled, “Restrictions on Permit” (First Reading)
COUNCILOR CARLIN introduced the ordinance and moved for its passage. Seconded by COUNCILOR HOLDER. COUNCILOR CARLIN moved to amend the ordinance to provide different hours and regulations for Perotti Park. Discussion occurred among the Council. The following members from the public addressed the Council:

The motion to amend the ordinance failed 1-5 with COUNCILOR HOLDER, COUNCILOR CEGLIE, COUNCILOR NAPOLITANO, MAYOR KHAMSYVORAVONG and COUNCILOR MCCALLA opposed.
COUNCILOR MCCALLA moved to continue the ordinance. Seconded by COUNCILOR CEGLIE. The motion failed 1-5.
COUNCILOR CARLIN moved to approve the ordinance. Seconded by MAYOR KHAMSYVORAVONG. The motion failed 1-5.
10. Action Item #6181/23 – re: Permanent Increase in Purchasing Limits (w/accompanying resolution)
COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.
11. Action Item #6182/23 – re: Coggeshall School Redevelopment - Acceptance of Proposal (w/accompanying resolution)
COUNCILOR HOLDER recused.
COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR NAPOLITANO. Patricia Reynolds, Director of Planning, provided a historical timeline of Coggeshall School since its closure. Lengthy discussion occurred among the Council. The following members from the public addressed the Council:

COUNCILOR MCCALLA moved to continue the communication. Seconded by MAYOR KHAMSYVORAVONG. The motion failed 1-4. COUNCILOR MCCALLA in favor and COUNCILOR NAPOLITANO, COUNCILOR CARLIN, COUNCILOR CEGLIE and MAYOR KHAMSYVORAVONG opposed.
MAYOR KHAMSYVORAVONG moved to approve the communication and accompanying resolution. Seconded by COUNCILOR CEGLIE and vote 4-1 with COUNCILOR MCCALLA opposed.
12. Action Item #6184/23 – re: Award of Contract – RIMPA - Newport City Hall Interior Office Space Analysis, Design and Construction/Installation Oversight (w/accompanying resolution)
COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.
13. Action Item #6185/23 – re: Award of Re-Bid #23-040A, Yard Waste Composting Services (w/accompanying resolution)
COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY (5-0).
COUNCILOR CARLIN left the dais and was not present for the vote.
14. Action Item #6186/23 – RE: Award of Contract - Rubberized Asphalt Chip Seal (w/accompanying resolution)
COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY (5-0).
COUNCILOR CARLIN left the dais and was not present for the vote.
COUNCILOR CEGLIE moved to adjourn as Council and convene as Board of License Commissioners. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

COMMISSIONER CEGLIE moved to close the public hearing and approve. Seconded by COMMISSIONER HOLDER and VOTED UNANIMOUSLY.
2. Application of Premier Entertainment II, Inc., d/b/a Newport Grand, holder of a Class BV alcoholic beverage license to transfer ownership and location to Radish Patch, LLC (Anthony Lorusso-100%), d/b/a Vieste Vino, 580 Thames St., Units B102, B103 and B104 (Hearing)
COMMISSIONER CEGLIE moved to close the public hearing and approve. Seconded by COMMISSIONER HOLDER and VOTED UNANIMOUSLY.
