The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held on May 10, 2023 at 6:30 p.m. in the City Council Chambers, City Hall, 43 Broadway, Newport, RI 02840.

MAYOR KHAMSYVORAVONG made a motion to move items No. 15, 16 & 19 to the beginning of the meeting and heard in the following order, 16, 19 and 15.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

16. Ocean Race- X. Khamsyvoravong, M. Aramli, C. Holder, D. Carlin

 

MAYOR KHAMSYVORAVONG introduced the resolution and moved for its passage.  Seconded by COUNCILOR NAPOLITANO.  Johan Strid addressed the Council on behalf of the Ocean Race.  The motion to approve was VOTED UNANIMOUSLY.

 

19. Action Item #6160/23 – RE:  Municipal Flag Display Policy (w/accompanying resolution)

 

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR CARLIN and VOTED UNANIMOUSLY.

COUNCILOR MCCALLA introduced the resolution and moved for its passage.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

 

1.   PUBLIC HEARING:  FY 2024 & FY 2025 Proposed Biennial Operating Budget:

 

COUNCILOR CEGLIE moved to open the public hearing.  Seconded by COUNCILOR NAPOLITANO.   Hearing no public comment, COUNCILOR CEGLIE moved to close the public hearing.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

Discussion occurred among the Council and Finance Director, Laura Sitrin.

 

COUNCILOR MCCALLA moved to table the Community Liaison Position for further discussion.  Seconded by COUNCILOR NAPOLITANO.  The motion failed 1-6.  Discussion occurred among the Council members, CITY SOLICITOR BEHAN and CITY MANAGER NICHOLSON regarding the Canvassing Authority and Canvassing Clerk position.  COUNCILOR MCCALLA moved to keep the Canvassing Clerk position and not rename it as Election Administrator.  The motion failed, there was no second.

 

a.   Budget Change Sheet;

 

COUNCILOR CEGLIE moved to receive the change sheet and Civic Support sheet.  Seconded by COUNCILOR CARLIN and VOTED UNANIMOUSLY.

 

b.   Personnel Ordinance (First Reading);

 

COUNCILOR CEGLIE moved to approve the ordinance on first reading.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

 

c.   Ordinance Appropriating Revenue (First Reading)

 

COUNCILOR CEGLIE moved to approve the ordinance on first reading.  Seconded by COUNCILOR NAPOLITANO.  MAYOR KHAMSYVORAVONG moved to fund the OPEB Trust at 100%.  Seconded by COUNCILOR CARLIN and voted 6-1 with COUNCILOR NAPOLITANO opposed.

 

MAYOR KHAMSYVORAVONG moved to approve the ordinance as amended.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR HOLDER.  Discussion occurred among the Council regarding the ordinance and the process for obtaining a pedicab business license.  Discussion occurred among the Council.  Andrew Croan and Luke Whelan addressed the Council regarding the pedicab licenses.  The motion to approve was VOTED UNANIMOUSLY.

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR  HOLDER.  Remy Kritter, applicant, addressed the Council regarding his application and the process.  Discussion occurred among the Council regarding the ordinance in place.  The motion to approve was VOTED UNANIMOULSY.

 

7.   Pedicab Business License, New, Nicholas Leimbach, d/b/a R.I. Pedicab, 175 Broadway, Newport- 1 pedicab valid from May 1, 2023 through April 30, 2025

 

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR NAPOLITANO.  The motion to approve failed 0-7.

COUNCILOR CEGLIE moved to approve the license.  Seconded by MAYOR KHAMSYVORAVONG.  The motion to approve failed 0-7.

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR MCCALLA.  The motion to approve failed 0-7.

 

10. Victualing License, Expansion, Mooring LTD, d/b/a Smokehouse, The, 31 Scott’s Wharf, to expand the licensed premises to include a 38’ x 36’ outdoor seating area consisting of ten tables and 80 seats

 

COUNCILOR CEGLIE moved to approve the license expansion.  Seconded by COUNCILOR HOLDER.  Turner Scott, Esq., addressed the Council on behalf of the applicant.  Michael Rubin, Esq., addressed the Council on behalf of Friends of the Waterfront.  Discussion occurred among the Council.  Linda Stevenson, Chair, Friends of the Waterfront, addressed the Council regarding the public right of way.  Michael Rubin, Esq., requested the Council continue the application for two weeks in order for the parties to meet and discuss the right of way. 

 

COUNCILOR MCCALLA moved to continue the application to May 24, 2023.  Seconded by COUNCILOR NAPOLITANO and voted 6-1 with COUNCILOR HOLDER opposed.
