REGULAR MEETING

December 5, 2006

7:30 p.m.

 

MEMBERS PRESENT

 

President Sisto, Ricci, Giusti, Zambarano, Douglas and Burchfield. Caranci was absent.  Also present was Mark Welch, Town Solicitor, Elizabeth Iafrate, Deputy Clerk and Mary Ann DeAngelus, Town Clerk.

 

BEFORE THE MEETING BEGAN, PRESIDENT SISTO SPOKE HONORING COUNCILMAN RICCI BECAUSE IT WAS HIS LAST OFFICIAL MEETING AFTER 18 YEARS. PRESIDENT SISTO GAVE HIM A GIFT FROM THE TOWN COUNCIL.  MAYOR MOLLIS ALSO SPOKE A FEW WORDS AND PRESENTED COUNCILMAN RICCI WITH A GIFT AS WELL.

 

REZONING AMENDMENT

 

Received application from Asylum Road Realty, LLC to amend Article II, Section 202 of the Zoning Ordinance of the Town of North Providence to change Lot 1420 on Assessor’s Plat 22C from RS 12-Residential Single Household District to a district denoted as RG-Residential General or Multihousehold District.

 

Said petition was advertised in the Providence Journal on September 15, 22, and 29, 2006 and continued at meeting of October 3, 2006.

 

Atty. Robert Murray and Armand Cortollesso were present as well as a representative from engineering firm to answer questions from the Town Council.  There were also neighbors of the site present and stated that they were in favor of this zone change as long as certain restrictions and requirements were met.  (For full testimony and for specific requirements, please see transcripts in this council envelope.)  After much discussion and upon a motion made by Zambarano, seconded by Douglas and upon a roll call vote of 6 ayes and 0 nays it was voted to change the zone from RS-12 to RG with the following restrictions: 1) Fence around retention pond, 2) 150 ft. buffer zone can never be built on and 3) Shrubs and trees (10ft. Pines) to be put up on Carriage Way.

 

CLASS BV LIMITED LIQUOR LICENSE

 

Received application for a Class BV Limited Liquor License from Bickford’s Family Restaurant, Inc. d/b/a Bickford’s Family Restaurant @1460 Mineral Spring Avenue.

 

Said application was advertised in the Providence Journal on November 15 and 22, 2006 for hearing on this date.

 

Steve Raymond, Executive Chef and two other representatives from the company were present to answer questions from the Council.  There were also many neighbors there in opposition to this license.  After much discussion and upon a motion made by Ricci, seconded by Douglas it was voted unanimously to grant the BV Limited License to Bickfords with some stipulations. MAYORAL COMMUNICATION

 

Received communication from Mayor A. Ralph Mollis requesting to address the Town Council regarding authorization to go out to bond.

 

This item was moved to number one on the agenda.  Mayor Mollis spoke regarding the Bond Ordinance. (For full testimony, please see this council envelope.)

 

PROPOSED ORDINANCES

 

Notice was given of a public Hearing to be held this date at 7:30 P.M. whereby the Town Council will consider passage of the following proposed Ordinances.

 

Said Ordinances were advertised in the Providence Journal on November 22, 2006 or continued from previous meeting for hearing on this date.

 

ORDINANCE # 06-011

 

“AN ORDINANCE AMENDING CHAPTER FOURTEEN (14), SECTION SEVEN (7) OF THE CODE OF ORDINANCES OF THE TOWN OF NORTH PROVIDENCE PERTAINING TO “OPEN BURN POLICY”.

 

The solicitor spoke stating that the state fire marshall had gotten back to him and informed him that the open burn ordinance needed to be advertised 3 weeks in a row in a paper of general circulation and posted in 3 different area of the town before the public hearing.  Darcy Lombo was present and very irate over the process.  Marie Ciccline was also present and both were told that it would be heard next month. Upon a motion made by Zambarano, seconded by Giusti, it was voted unanimously to introduce this item for hearing at the January 9, 2007 regular Town Council Meeting.

 

ORDINANCE 06-014

 

“AN ORDINANCE AMENDING CHAPTER NINETEEN (19), ARTICLE TEN (10), SECTION NINETEEN-THIRTY (19-30) OF THE CODE OF ORDINANCES OF THE TOWN OF NORTH PROVIDENCE, ENTITLED “NO PARKING ON CERTAIN STREETS-GENERALLY”, TO PROVIDE FOR CERTAIN PARKING RESTRICTIONS ON ATLANTIC BLVD. IN THE TOWN OF NORTH PROVIDENCE.

 

There being no objectors, upon a motion made by Douglas, seconded by Burchfield, it was voted unanimously to adopt Ordinance #06-014.

 

ORDINANCE 06-015

 

“AN ORDINANCE AMENDING CHAPTER NINETEEN (19), ARTICLE TEN (10), SECTION NINETEEN-FORTY SEVEN (19-47) OF THE CODE OF ORDINANCES OF THE TOWN OF NORTH PROVIDENCE, ENTITLED “FOUR WAY STOP SIGNS” TO PROVIDE FOR A FOUR WAY STOP SIGN AT THE INTERSECTION OF FLORENCE AND BORAH STREETS.

 

After reading the recommendation of the traffic officer and upon a motion made by Burchfield, seconded by Douglas, it was voted unanimously to deny passage of Ordinance #06-015.

 

ORDINANCE 06-017

 

“AN ORDINANCE AMENDING CHAPTER NINETEEN (19), ARTICLE TEN (10), SECTION NINETEEN-THIRTY (19-30) OF THE CODE OF ORDINANCES OF THE TOWN OF NORTH PROVIDENCE, ENTITLED “NO PARKING ON CERTAIN STREETS-GENERALLY”, TO PROVIDE FOR CERTAIN PARKING RESTRICTIONS ON TIMBER STREET. IN THE TOWN OF NORTH PROVIDENCE.

 

There being no objectors, and upon a motion made by Zambarano, seconded by Douglas, it was voted unanimously to adopt Ordinance #06-017.

 

RT. 146 SOUND BARRIER

 

Received request from Councilman Burchfield for discussion concerning the proposed sound barrier for Rt. 146.

 

Councilman Burchfield explained that the resident of North Providence and Lincoln that abut Rt. 146 are very concern with the sound barrier issues.  He has meant with them and upon a motion made by Burchfield, seconded by Douglas, it was voted unanimously to send communication to many state senators and representatives and executive officers of the Towns of Lincoln and North Providence with concerns over these noise problems.

 

THOMAS STREET PARKING

 

Received request from Councilman Burchfield for discussion concerning parking on Thomas Street and Ordinance #03-031.

 

Upon a motion made by Burchfield, seconded by Douglas, it was voted unanimously to send Ordinance #03-031 to the Ordinance Committee for review.

 

WEST RIVER PARKWAY/DOUGLAS AVE. CONDOS

 

Received request from Councilman Burchfield for discussion concerning fence between homes on West River Parkway and Douglas Avenue Condominiums.

 

Councilman Burchfield withdrew this item.

 

RESOLUTION #06-006 TRI-TOWN

 

Town of North Providence Resolution #06-006 in support of Tri-Town Health Center Grant Proposal.

 

Upon a motion made by Zambarano, seconded by Ricci, it was voted unanimously to pass Resolution #06-006.

 

SALVATION ARMY

 

Received communication from Luigi DelPonte of 1900 Smith Street for discussion concerning the progress on Salvation Army Building work that was agreed upon to be done, enclosing of dumpsters, concerns with Bailey’s Pub and un-kept property.

 

This item was deferred because Mr. DelPonte was not able to attend this meeting.

 

SAMPSON AVENUE

 

Ms. Patricia Hall wishes to appear before the council for Mr. David Sanzaro to discuss the reasons that they are requesting resident parking at 11 Sampson Avenue.

 

Councilman Douglas explained to Mr. Sanzaro that there was a moratorium on parking signs until at least January. Councilman Douglas also said that he would attempt to speak to the person running the group home next to 11 Sampson to see if he can stop the people from parking in front of Mr. Sanzaro’s house.  If this does not work, he says that Mr. Sanzaro should request this again after January.

 

NOTTE PARK

 

Mr. Charles Lombardi requests discussion concerning the purchase of property that abuts Notte Park.

 

Charles Lombardi spoke regarding the same issue that was in the previous agenda item—Camp Meehan. There was much discussion between Mr. Lombardi and Council Members regarding the Town purchasing this property. (For full testimony, please see this council envelope).

 

VICTUALLING LICENSE

 

Received application for a Victualling License from N.M.B. Corp. d/b/a Bella Pizza at 1933 Mineral Spring Avenue.

           

Upon motion made by Zambarano, seconded by Burchfield, it was voted unanimously to grant the victualling license subject to all necessary requirements to N.M.B. Corp. d/b/a Bella Pizza @ 1933 Mineral Spring Avenue.

 

HOLIDAY LICENSE

 

Received application for a Holiday License from Kelley A. Fagnant d/b/a Smokestack Cigar Shop at 2003 Smith Street.

 

Upon motion made by Zambarano, seconded by Ricci, it was voted unanimously to grant subject to all necessary requirements.

 

HOLIDAY LICENSE

 

Received application for a Holiday License from Family Dollar Inc. at 1527 Smith Street.

 

Upon motion made by Zambarano, seconded by Douglas it was voted unanimously to grant subject to all necessary requirements

 

AMUSEMENT DEVICE

 

Received application for Amusement Device License from Club Raymond Ltd. Located at 1084 Charles Street.

 

Upon motion made by Douglas, seconded by Burchfield and Zambarano it was voted unanimously to grant subject to all necessary requirements

 

FINANCIAL REPORTS

 

Received monthly Financial Report from North Providence School Department for November 2006.

 

Upon a motion made by Zambarano, seconded by Burchfield and Douglas, it was voted unanimously to accept and place on file.

 

RESOLUTION

 

Received Resolution from the City of Providence.

 

Upon motion made by Zambarano, seconded by Giusti, it was voted unanimously to accept and place on file.

WINDMILL STREET CONDOS

 

Residents of Windmill Street would like to address the Town Council with concerns involving the Windmill Court Condominiums.

 

Lauren Banna spoke on behalf of Windmill Street residents with their many concerns with the Windmill Court Condos. Some of their concerns are traffic problems, water related issues, road not being wide enough and the zone of that particular area. (For full testimony, please see this council envelope.)
