REGULAR MEETING

December 5, 2017

7:00 p.m.

 

MEMBERS PRESENT: President Autiello, Feola, Amoriggi, DiLorenzo, Giusti, Brady and DeStefanis were present. Also present were Mark Welch, Legal Counsel, MaryAnn DeAngelus, Town Clerk and Troy Campopiano, Deputy Town Clerk.

1) ACCEPTANCE OF MEETING MINUTES::

Discussion and possible action/vote with regard to the acceptance of meeting minutes from the meetings of November 7 and 20, 2017 to be accepted/approved by the Town Council.

 

Upon a motion made by Giusti and seconded by Brady, it was vote to accept/approve the minutes.

 

2) STREETLIGHT INSTALLATION::

Mayor Lombardi requests discussion and possible vote on the installation of a streetlight on Arro Street on Pole #1 or Pole #2.

 

Mayor Lombardi spoke and stated that neighbors in the area requested a light in this area. Audience Member spoke on this issue as well. Upon a motion made by DeStefanis and seconded by DiLorenzo, it was voted to approve.

 

3) DEMARCO CLAIM::

Mayor Lombardi requests discussion and possible vote regarding the DeMarco Claim.

 

Mayor spoke and reiterated the story of the DeMarco Claim situation and after a short discussion and some questions from the council, a motion was made by DiLorenzo and seconded by Giusti to refer this item to the Finance Committee.

 

4) DEM GRANT::

Lisa Andoscia requests discussion and possible vote for municipal approval, as required by DEM for recreational grant submittal.

 

Lisa Andoscia spoke and explained the procedure for applying for a DEM Grant and how it is processed. After a short discussion and upon a motion made by Giusti and seconded by Brady, it was voted to approve the grant submittal.

 

PROPOSED ORDINANCES:     Notice was given of a Public Hearing on this day whereby the Town Council would consider passage of the following proposed ordinances.

 

5) ORDINANCE 17-014::   “AN ORDINANCE OF THE TOWN OF NORTH PROVIDENCE, ENTITLED “THROUGH TRUCKING-TRUCKS OVER NINETY-FIVE HUNDRED (9500) POUNDS GROSS WEIGHT-PROHIBITED ON EAST AVENUE IN THE TOWN OF NORTH PROVIDENCE

 

Upon a motion made by Giusti and seconded by DeStefanis, it was voted to Adopt Ordinance 17-014.

 

6) ORDINANCE 17-015::   "AN ORDINANCE AMENDING CHAPTER NINETEEN (19), ARTICLE TEN (10), SECTION NINETEEN-FORTY SEVEN (19-47) OF THE CODE OF ORDINANCES OF THE TOWN OF NORTH PROVIDENCE, ENTITLED “FOUR WAY STOP SIGN”

 

Upon a motion made by Giusti and seconded by Brady, it was voted to Adopt Ordinance 17-015.

 

7) ORDINANCE 17-016::   "AN ORDINANCE AMENDING CHAPTER NINETEEN (19) ARTICLE SEVEN (7), SECTION SECTION NINETEEN - THIRTY (19-30) OF THE CODE OF ORDINANCES OF THE TOWN OF NORTH PROVIDENCE, ENTITLED “NO PARKING ON CERTAIN STREETS –GENERALLY’, TO PROVIDE FOR CERTAIN PARKING RESTRICTIONS ON SPICER STREET IN THE TOWN OF NORTH PROVIDENCE.

 

Upon a motion made by DeStefanis and seconded by Brady, it was voted to Adopt Ordinance 17-016.

 

8) ORDINANCE 17-017::   “AN ORDINANCE AMENDING ORDINANCE NUMBER 15-011 ENTITLED “ESTABLISHMENT OF A TAX EXEMPTION AND TAX STABILIZATION AGREEMENT FOR PROPERTY LOCATED AT 184 WOONASQUATUCKET AVENUE, NORTH PROVIDENCE, RHODE ISLAND.

 

Upon a motion made by Giusti and seconded by DiLorenzo, it was voted to Adopt Ordinance 17-017

 

9) LIQUOR LICENSE::

Notice was given of a Public Hearing to be held this date in the Providence Journal on November 17 and 24, 2017 for a transfer of a BV Liquor License.

Owners were present and after a short discussion and upon a motion made by DeStefanis and seconded by Brady, it was voted to approve.

 

10) VICTUALLING LICENSE::

Town Council to consider approval of an Victualling License for Currywalla, LLC d/b/a Currywalla Indian Cuisine, 1525 Smith Street.

 

Owners were present and after a short discussion and upon a motion made by DeStefanis and seconded by Brady, it was voted to approve.

 

11) VICTUALLING LICENSE::

Town Council to consider approval of an Victualling License for Fresh Pita LLC d/b/a Fresh Pita, 1385 Mineral Spring Avenue.

 

Owner Yelda May was present and answered questions from the council. Upon a motion made by DeStefanis and seconded by Feola, it was voted to approve.

 

12) VICTUALLING LICENSE::

Town Council to consider approval of a Victualling License for Onur Ozbay d/b/a Mediterranean Pizza, 2220 Mineral Spring Avenue.

 

Owner Onur Ozbay was present and answered questions from the council. Upon a motion made by DeStefanis and seconded by Feola, it was voted to approve

 

13) TACO BELL::

Pietro Scorpio of 45 Spicer Street requests to appear to discuss the noise and loud music coming from drive-thru at Taco Bell during early morning hours.

 

Pietro Scorpio of 45 Spicer Street spoke in detail about the noise and disturbance issues in his neighborhood due to the late night hours of Taco Bell. There was much discussion and questions asked and then the following motions were made:

 

1)   Upon a motion made by Brady and seconded by DeStefanis it was voted to send the Chief of Police to do a thorough analysis of the situation and report back to the council at the January 2, 2018 meeting.

2)   Upon a motion made by Brady and seconded by Giusti it was voted to send a letter to the Management and the Corporate Offices  of Taco Bell to appear at the January 2, 2018 meeting.

 

14) FERA STREET::

Residents of Fera Street to appear with a petition to discuss changing Fera Street to a one-way street.

 

Sheila Kesse and other neighbors in the area of Fera Street were present and explained the congestion and the dangerous traffic issues that are occurring in this area due to the Atomic Salon in the strip mall. After a short discussion the following two motions were made:

1)   Upon a motion made by Amoriggi and seconded by Brady it was voted to send a letter to the Police Department to do a formal traffic study of the area during regular business hours.

2)   Upon a motion made by Amoriggi and seconded by  Feola, it was voted to have the Clerk’s Office look to see if the parking spots for this strip mall are owned by the owner of the building.

 

15) MULTI-PURPOSE FIELD COMPLEX::

Received request from Lorice J. Autiello-Daignault to appear to discuss the possibility of installing a multi-purpose field complex at North Providence High School.

 

Lorice Autiello could not be present so a motion was made by Giusti and seconded by Brady to continue this until January 2, 2018 meeting. Ruth Bucci was in the audience and asked if she could speak. She informed the council and passed out information on concerning facts about artificial turf. She stated that the council should contact an expert in the area before building a Multi-purpose field complex. Mayor Lombardi thanked Mrs. Bucci and stated that we will do a full investigation into these issues before we build the complex.

 

16) HOPKINS MANOR::

Received request from Mark S. Levesque, Administrator of Hopkins Manor to appear to request approval of work that needs to be done at the facility after hours stated in Town Noise Ordinance.

 

Mark Levesque, Administrator of Hopkins Manor, was present and explained why the work of an industrial kitchen cleaning could not be done at regular working hours. He stated that they are mandated to serve during certain hours by DOH and that the industrial cleaning needs to happen afterwards. After a short discussion and upon a motion made by Giusti and seconded by Feola, it was voted to approve the work from7PM to 11PM for two nights in December.

 

17) STOP SIGN::

Councilwoman Brady requests discussion and possible vote for a 2-Way Stop Sign on Newton Street at the intersection of Brook Street. (Residents will speak to this matter).

 

Councilwoman Brady stated that the traffic in this area at different times of the day is very congested and neighbors of the area also spoke reiterating Brady’s information. After a short discussion and upon a motion made by Brady and seconded by DiLorenzo, it was voted to send this to the Ordinance Committee.

 

18) TRASH TRANSFER STATION::

Councilman DeStefanis requests discussion and possible vote on City of Pawtucket proposed Trash Transfer Station on Concord Street.

 

Councilman DeStefanis spoke in reference to the City of Pawtucket proposing to put a Trash Transfer Station on Concord Street. There was some discussion on the matter and upon a motion made by DeStefanis and seconded by DiLorenzo, it was voted to send a resolution in opposition to this to Pawtucket Officials.

 

19) BOARD APPOINTMENTS::

Discussion and vote on appointment to the Zoning Board to replace the recently deceased Ronald Montecalvo and the alternate appointment this may create.

 

Charles Pollack from the Zoning Board spoke and the following two motions were made:

 

1)   Upon a motion made by DiLorenzo and seconded by Brady, it was voted to appoint Brendon Snodgrass as a permanent minority member of the Zoning Board.

2)   Upon a motion made by DeStefanis and seconded by Amoriggi, it was voted to appoint Anthony Costello as the alternate minority member of the Zoning Board

 

20) UNCOLLECTABLE TAX::

Received letter from Tax Collector Claudette Mooney, for Uncollectable Taxes for 2006 to be removed from the Accounts Receivables in the following amounts:

 

$5,564.12 for Real Estate

$121,186.46 for Tangibles

$154,069.58 for Motor Vehicles

$2,846.31 for expired legal fees

 

Upon a motion made by Giusti and seconded by Brady, it was voted to remove the above mentioned taxes/fees.

 

21) CLAIM SUBMITTED::

Town Council discussion and possible vote with regard to claim received from Datoyia Herring by Attorney Rob Levine, 544 Douglas Avenue, Providence, Rhode Island.

 

Upon a motion made by Giusti and seconded by Brady, it was voted to send the above mentioned claim to the Claims Committee.

 

22) CLAIMS COMMITTEE REPORT::

Town Council discussion and possible vote with regard to the Claims Committee Report and approval, denial or referral of claims, within said report, to be presented by Councilman Feola.

 

Councilman Feola read the Claims Committee Report and upon a motion made by Brady and seconded by DeStefanis, it was voted to accept the report.

 

23) FINANCE COMMITTEE REPORT::

Town Council discussion/action with regard to the Finance Committee Report to be presented by Councilman DeStefanis.

 

Councilman DeStefanis spoke and reported out the finance committee minutes. Upon a motion made by DeStefanis and seconded by DiLorenzo, it was voted unanimously to accept the minutes as presented.

 

24) TAX ADDENDAS::

Town Council discussion and action/possible vote for the approval of the list of Tax Addenda received from Tax Assessor in the amount of $256.61 for Motor Vehicle.

 

Upon a motion made by Brady and seconded by Giusti, it was voted to approve the list of Tax Addenda received from Tax Assessor in the amount of $256.61 for Motor Vehicle

 

25) TAX ABATEMENTS (UNDER $1,000.00)::

Town Council discussion and action/possible vote for the approval of the list of Tax Abatements under $1,000.00 received from the Tax Assessor in amount of $1,356.05 for Real Estate, $5,279.42 for Motor Vehicle and $1,176.82 for Tangibles.

 

Upon a motion made by Brady and seconded by Giusti, it was voted to approve the list of Tax Abatements under $1,000.00 received from the Tax Assessor in amount of $1,356.05 for Real Estate, $5,279.42 for Motor Vehicle and $1,176.82 for Tangibles.
