REPORT AND ORDER
WHEREAS: By application filed with the Division of PUblic Utilities and Carriers, ("Division") James A. Shea, DBA: Shea's Auto Body, 20 Pleasant Street, Cumberland, RI seeks to transfer the operating rights contained in certificate number MC-809 in accordance with Rhode Island General Laws, Title 39, Chapter 12, to James M. Poli, DBA: Shea's Auto Body, 20 Pleasant Street, Cumberland, RI.
WHEREAS: Following a notice of hearing in this matter, the Division held a transfer hearing on this application on February 16, 1998.

FINDINGS
After a review of the record in this proceeding, the Division has determined that the Transferor has been actively providing transportation services under Certificate number MC-809 and that the Transferee is fit, willing and able to provide the services required under this certificate. The testimony of the Transferee and the evidence of record demonstrate that the Transferee has the necessary equipment, experience and financial responsibility to provide the proposed transportation service.
No persons appeared at the hearing in opposition to the granting of the transfer.
Accordingly, it is
1. That the application seeking the transfer of Certificate Number MC-809 which authorizes the transportation of motor vehicles within the state of Rhode Island is hereby granted.
2. That the approval and granting of the instant application is subject to the conditions that within sixty (60) days from the date of this order, the Applicant shall hand deliver to this office the following documentation:
(a) letter of consummation signed by both parties,
(b) proof of financial responsibility (insurance forms E and H),
At the time of submission of the above documents the Applicant must also register with this office the vehicles to be operated under Certificate No. MC-809.
(3) If the above conditions are not met within the 60 day period, this decision shall be of no further force and effect.
