By application filed January 15, 1998, Dean M. DePietro seeks operating authority in the transportation of household goods throughout the state of Rhode Island. A duly noticed hearing on the application was held on February 5, 1998 at 100 Orange Street Providence.
APPEARANCE: DEAN M. DEPIETRO, pro se
Mr. DiPietro testified that he has been in the household goods industry for the past ten years. He said he worked for Paul Arpin Van Lines while in high school and worked part time and summers for the company while attending college.
Mr. DePietro presented five witnesses in support of his application. Christine Masse Florio, who lives in Woonsocket, testified that she had trouble finding a mover on quick notice when she moved from Warwick. She said it was a small job. Mrs. Florio said that Mr. DePietro is very responsible and would try to accommodate people who want to have small amounts of furniture moved.
Manuel Ferschke, who resides in Cumberland, testified that he had trouble finding a mover on a weekend.
Kevin P. Kernan, owner of Consumers' Moving Company, and Anthony Cunha, owner of Cunha Moving and Storage, testified in opposition to the application. Mr. Kernan testified that there are an abundance of movers in Rhode Island and any more would adversely affect financially the movers who already have authority.
FINDINGS
After a review of the record in this proceeding, the Division has determined that Mr. DePietro is fit, willing and able and has established through witnesses that there is a public convenience and necessity
Accordingly, it is
That the application filed by Dean M. DePietro, 383 Mt. Pleasant Avenue, Providence, Rhode Island 02908, seeking operating authority in the transportation of household goods within the state of Rhode Island is hereby granted subject to the terms and conditions listed on Appendix A, which is hereby incorporated by reference. If the conditions contained on Appendix A are not met within sixty (60) days from the date of this order, the approval herein granted will be of no further force and effect. Upon satisfactory completion of the terms and conditions contained in Appendix A, a certificate of operating authority shall be issued. No transportation services shall be provided until such time as said certificate is issued.

APPENDIX A
1. The Applicant must hand deliver to the Division proof of financial responsibility from an insurance company (forms E - liability and forms H - Cargo).
2. All vehicles intended to be used in the operation of the business must be registered with this office.
3. The company's business address will remain at the same location as listed on the application unless otherwise approved and authorized by the Division.
4. Management, ownership and control will be retained in the name of the Applicant unless otherwise approved and authorized by the Division.
5. The conditions outlined in paragraphs 1 and 2 above must be met within sixty days from the effective date of the order.
