Order 15570 - Blue Sky Natural Gas: Appl. to Operate as a Gas Marketer

 

STATE OF RHODE ISLAND AND PROVIDENCE PLANTATIONS

PUBLIC UTILITIES COMMISSION

ORDER

WHEREAS, On October 8, 1996, the Rhode Island Public Utilities Commission ("Commission") adopted Rules and Regulations for Utility Interaction with Gas Marketers [1 Effective October 29, 1996.]; and

WHEREAS, The regulations set forth the entry requirements for gas marketers and the standards of conduct for utilities with respect to gas marketers; and

WHEREAS, On February 13, 1998, Blue Sky Natural Gas & Petroleum, Inc. ("Blue Sky") filed with the Commission its Statement of Business Operations for authorization to do business in Rhode Island; and

WHEREAS, The Division of Public Utilities and Carriers ("Division") indicates that Blue Sky has entered into an agreement with Enserch Energy Corporation  [2 Gas marketer authorized to provide service in R.I. Order No. 15279.] to act as a sales representative to market gas and gas related services in Rhode Island  [3 Under the agreement, Blue Sky will act as sales agent for Enserch and receive a commission on sales Enserch makes to such customers. Enserch will administer the contract with customers, provide daily balances, account for any losses on the retail sales, and provide billing and general customer service. Blue Sky will have no liability associated with this contract.]; and

WHEREAS, On March 19, 1998, the Division of Public Utilities and Carriers filed a memorandum indicating that it had reviewed the Company's application and found it to comport with the entry requirements established by the regulations. The Division recommended approval of the application provided that the services provided by Blue Sky be limited to the terms of the agreement between Blue Sky and Enserch Energy Corporation; and

WHEREAS, The Commission finds that the Company's application meets the regulatory requirements previously adopted;

Accordingly, it is

(15570) ORDERED:

1) That the registration filed by Blue Sky Natural Gas & Petroleum, Inc. is hereby approved, effective April 1, 1998.

2) That Blue Sky is further instructed to refile its statement of business and operations if it wishes to expand its service offerings beyond the terms of the agreement entered with Enserch Energy Corporation.

2) That Blue Sky shall comply with the standards of conduct and all other regulatory requirements.

EFFECTIVE AT PROVIDENCE, RHODE ISLAND APRIL 1, 1998, PURSUANT TO AN OPEN MEETING DECISION.
