REPORT AND ORDER

 

On March 19, 1998, the Division held a hearing at 100 Orange Street, Providence, Rhode Island to determine if AGI Construction Company violated Section 39-1.1-10 of the Dig Safe Law relating to excavation activities at 20 Park Street, Providence, Rhode Island.

 

Anthony Pirolli, of Providence Gas Company, was Construction Inspector at the Providence Place Mall Project where the alleged violation occurred. He said Dig Safe had been called and the site had been marked as required by law. He said the gas main was broken by a backhoe during excavation.

 

Mark Albert, owner of AGI Construction, admitted in his testimony that his operator had broken the main. He said one person was fired and another suspended because of the incident.

The Division finds that AGI Construction violated 39-1.1-10 of the Dig Safe Law.
