Order 15576 - Warwick & KCWA: Petition Prohibiting PWSB from Shutting Down Aqueduct

NOTICE OF PREHEARING CONFERENCE

Whereas, On April 1, 1998 the City of Warwick ("Warwick") and the Kent County Water Authority ("KCWA") filed a petition with the Rhode Island Division of Public Utilities and Carriers ("Division") seeking an order that will prohibit the Providence Water Supply Board ("PWSB") from shutting down an aqueduct that provides substantial water service to Warwick and the KCWA.

Whereas, The petition states that the PWSB plans to shut down the aforementioned aqueduct, in order to effectuate an inspection, beginning on April 6, 1998.

Whereas, Warwick and the KCWA request a postponement of the inspection "to allow time for preparation for a long-term plan that will solve the water shortage problems experienced by Warwick and Kent County {KCWA} during what will become increasingly frequent closures of this essential conveyance."

Whereas, under the authority conferred under R.I.G.L. Sections 39-1-15 and 39-4-13, the undersigned hearing officer finds that a pre-hearing conference on the instant petition is essential, especially in view of the time constraints associated with the instant matter.

Now Accordingly, it is

(15576) ORDERED:

That the PWSB, Warwick and the KCWA shall provide counsel and/or representatives to attend a prehearing conference to be conducted at 12:00 p.m. on Friday, April 3, 1998 at the Division's offices located at 100 Orange Street in Providence.
