REPORT AND ORDER
By application filed with the Division of Public Utilities and Carriers, Peter Pan Bus Lines of Rhode Island, Inc. seeks authority to operate both as a jitney carrier in accordance with Rhode Island General Laws, Title 39, Chapter 13, and as a water vessel passenger carrier in accordance with the General Laws Title 39, Chapter 3 over regular routes within the city of Providence, Rhode Island.
A duly noticed hearing on the application was held March 18, 1998 in the Division hearing room, 100 Orange Street, Providence, RI
APPEARANCE: JEREMY KAHN, ESQ., for the Applicant
David W. Batchelor, a vice-president of Peter Pan, testified that the company plans to conduct a tour of the historical places in Providence and then begin a water tour from Collier Point Park to Water Place Park. He said the tour will begin and terminate at Exchange Terrace. Mr. Batchelor testified that the City of Providence and the Convention and Visitor's Bureau supports this venture by Peter Pan Bus Lines. He said the tour will utilize an amphibious vehicle that seats thirty-five (35) persons. Mr. Batchelor testified that the vehicle has been given preliminary approval from the United States Coast Guard and that final approval will be requested when all the plans have been finalized. No one appeared in opposition to the application.
FINDINGS
After a review of the record, the Division has determined that the Applicant/Corporation is fit, willing and able to operate within the city of Providence in the transportation of passengers. Since the jitney service will conduct tours on land and water, the Division will issue a certificate that authorizes both a jitney and water vessel passenger carrier operation. This will be a unique operation in the city of Providence and the Division has determined from the testimony that a public convenience and necessity exists for the proposed service.
Accordingly, it is
That the application filed by Peter Pan Bus Lines, Inc. is hereby approved subject to the following conditions:
1. That prior to these services being granted, the Applicant/Corporation must provide the Division with all necessary documentation proving they have met the necessary government regulations, i.e.; U.S. Coast Guard requirements over the water, Registry of Motor Vehicles for jitney registration for the vehicles to be used in this operation and financial responsibility covering the insurance requirements.
Approval and granting of the application is subject to the conditions listed above. The Applicant/Corporation shall also hand deliver to this office a tariff reflecting rates and charges to be assessed and a schedule of runs that will be maintained during the year.
Vehicles to be used under the jitney portion of the certificate must be registered with this office.
If the conditions outlined above are not met within sixty (60) days from the date of this Order, the approval herein granted will be of no further force and effect.
