WHEREAS: By application filed with the Division of Public Utilities and Carriers, ("Division"), on May 18, 1998, Sal Zincone's, Inc., 1285 Park Avenue, Cranston, Rhode Island 02910 seeks to transfer the operating rights contained in certificate number MC-1033, in accordance with Rhode Island General Laws, Title 39, Chapter 14, to Currieri Collision Center, Inc., 164 Fountain Avenue, Cranston, Rhode Island 02920.
WHEREAS: Following a notice of hearing in this matter, the Division held a hearing on this application on June 16, 1998 at 10:00 a.m. in the Division's hearing room, 100 Orange Street, Providence, Rhode Island.

FINDINGS
After a review of the record in this proceeding, the Division has determined that the Transferor has been actively providing transportation services under certificate number MC-1033 that the Transferee is fit, willing and able to provide the services required under this certificate. The testimony of the Transferee and the evidence of record demonstrates that the Transferee has the necessary equipment, experience and financial responsibility to provide the proposed transportation service.
No persons appeared at the hearing in opposition to the granting of the transfer.
Accordingly, it is
1. That the application seeking the transfer of certificate number MC-1033 which authorizes the transportation of motor vehicles within the State of Rhode Island is hereby granted.
2. That the approval and granting of the instant application is subject to the Transferee hand delivering to this office within 60 days, the following:
a) letter of consummation signed by both parties,
b) tariff reflecting rates and charges to be assessed,
c) registration forms to register vehicle(s) to be operated under the authority granted herein.
3. That if the above conditions are not met with the 60 day period, this decision shall be of no further force and effect.
