REPORT AND ORDER
WHEREAS: By application filed with the Division of Public Utilities and Carriers, ("Division"), Gladys N. Gosselin, dba: Friendly Cab, 6 St. Mary Street, West Warwick, RI 02893 seeks to transfer the operating rights contained in her taxicab certificate number MC-T-275, in accordance with Rhode Island General Laws, Title 39, Chapter 14, to Friendly Cab Co., LLC, 6 St. Mary Street, West Warwick, RI 02893.
FINDINGS
After a review of the record in this proceeding, the Division has determined that the Transferor has been actively providing transportation services under certificate number MC-T-275 and that the Transferee is fit, willing and able to provide the service required under this certificate. The testimony of the Transferee and the evidence of record demonstrates that the Transferee has the necessary equipment, experience and financial responsibility to provide the proposed transportation service.
No persons appeared at the hearing in opposition to the granting of the transfer.
Accordingly, it is
1. That the application seeking the transfer of certificate MC-T-275 for three (3) taxicabs authorizing the transportation of passengers and their baggage via taxicab within the towns of Coventry and West Warwick, Rhode Island is hereby granted.
2. That the approval and granting of the instant application is subject to the Transferee hand delivering to this office, within 60 days from the date of this order, the following:
a) letter of consummation signed by both parties;
b) tariff reflecting rates and charges to be assessed;
c) proof of meter calibration;
d) register the vehicles to be operated under the authority granted herein.
3. That if the above conditions are not met within the 60 day period, this decision shall be of no further force and effect.
