REPORT AND ORDER
WHEREAS: By application filed with the Division of Public Utilities and Carriers, ("Division"), Joseph B. Dempsey, Jr., 140 Larch Street, Providence, Rhode Island 02906 seeks to transfer the operating rights contained in Certificate No. W-1164, in accordance with Rhode Island General Laws, Title 39, Chapter 3, to Providence River Boat Co., Inc., 140 Larch Street, Providence, Rhode Island 02906.
WHEREAS: Following a notice of hearing in this matter, the Division held a transfer hearing on September 30, 1998.
APPEARANCES: Joseph B. Dempsey, Jr., pro se.
FINDINGS
After a review of the record in the proceeding, the Division has determined that the Transferor has been actively providing transportation services under Certificate No. W-1164 and that the Transferee is fit, willing and able to provide the service required under this certificate. The testimony of the Transferee and the evidence of record demonstrates that the Transferee has the necessary equipment, experience and financial responsibility to provide the proposed transportation service.
No persons appeared at the hearing in opposition to the granting of the transfer.
Accordingly, it is
1. That the application seeking the transfer of Certificate No. W-1164 which authorizes the transportation of passengers by riverboat is hereby granted.
2. That the approval and granting of the instant application is subject to the condition that within sixty (60) days from the date of this order, the Applicant shall hand deliver to this office the following documentation:
(a) letter of consummation signed by both parties
(b) proof of financial responsibility.
3. That if the above conditions are not met within the 60 day period, this decision shall be of no further force and effect.
