REPORT AND ORDER
WHEREAS: By application filed with the Division of Public Utilities and Carriers, ("Division"), Victor C. Gough, DBA: City Towing, 661 West Shore Road, Warwick, Rhode Island 02889 seeks to transfer the operating rights contained in Certificate No. MC-914, in accordance with Rhode Island General Laws, Title 39, Chapter 12, to Robert & Donna Clough, DBA: City Towing, 661 West Shore Road, Warwick, Rhode Island 02889.
WHEREAS: Following a notice of hearing in this matter, the Division held a transfer hearing on September 30, 1998.

FINDINGS
After a review of the record in the proceeding, the Division has determined that the Transferor has been actively providing transportation services under Certificate No. 914 and that the Transferees are fit, willing and able to provide the service required under this certificate. The testimony of the Transferees and the evidence of record demonstrate that the Transferees have the necessary equipment, experience and financial responsibility to provide the proposed transportation service.
No persons appeared at the hearing in opposition to the granting of the transfer.
Accordingly, it is
1. That the application seeking the transfer of Certificate No. 914 which authorizes the transportation of motor vehicles within the state of Rhode Island is hereby granted.
2. That the approval and granting of the instant application is subject to the Transferee hand delivering to this office within 60 days, the following:
(a) letter of consummation signed by both parties,
(b) tariff reflecting rates and charges to be assessed,
(c) proof of financial responsibility (insurance forms E & H).
At the time of submission of the above documents the Applicant must also register with this office the vehicles to be operated under Certificate No. MC-914.
3. That if the above conditions are not met within the 60 day period, this decision shall be of no further force and effect.
