REPORT AND ORDER
WHEREAS: By application filed with the Division of Public Utilities and Carriers, ("Division"), Mark Walsh, DBA: Dick's Towing, Warwick, Rhode Island 02888 seeks to transfer the operating rights contained in Certificate No. MC-998, in accordance with Rhode Island General Laws, Title 39, Chapter 12, to Kenneth F. Gallucci, DBA: Dick's Towing, 3126 Post Road, Warwick, Rhode Island 02888.
WHEREAS: Following a notice of hearing in this matter, the Division held a transfer hearing on this application on October 13, 1998.
APPEARANCES:
Mark Walsh, pro se, for the Transferor
Kenneth F. Gallucci, Jr., pro se, for the Transferee
FINDINGS
After a review of the record in the proceeding, the Division has determined that the Transferor has been actively providing transportation services under Certificate No. 998 and that the Transferee is fit, willing and able to provide the service required under this certificate. The testimony of the Transferee and the evidence of record demonstrates that the Transferee has the necessary equipment, experience and financial responsibility to provide the proposed transportation service.
No persons appeared at the hearing in opposition to the granting of the transfer.
Accordingly, it is
1. That the application seeking the transfer of Certificate No. 998 is hereby approved.
2. That the approval and granting of the instant application is subject to the Transferee hand delivering to this office within 60 days, the following:
(a) letter of consummation signed by both parties,
(b) tariff reflecting rates and charges to be assessed,
(c) proof of financial responsibility (insurance forms E & H),
At the time of submission of the above documents the Applicant must also register with this office the vehicles to be operated under Certificate No. MC-998.
3. That if the above conditions are not met within the 60 day period, this decision shall be of no further force and effect.
