INVESTIGATION OF THE NEED AND APPROPRIATENESS OF INTERSTATE NAVIGATION COMPANY'S PLANS TO REPLACE THE ATHENA WITH A

LARGE HIGH-SPEED FERRY

ORDER

 

 

             Whereas: On January 4, 2019, Order No. 23364 in Docket D-18-39 stated in part:

3. That the Division’s Clerk is instructed to open a new docket designed to provide the Division with an opportunity to investigate the need and appropriateness of Interstate [Navigation]’s plans to replace the Athena with a larger high-speed ferry. During this investigation the Division will evaluate whether Interstate’s plans are designed to thwart Rhode Island Fast Ferry, Inc.’s entry into the Rhode Island intrastate high-speed ferry market; and if so, whether the Division should impose a moratorium on such plans to protect the public interest.

 

Whereas: In response to Order No. 23364 the Division opened Docket D-19-05.

Whereas: In May 2019 the Division’s Advocacy Section issued one set of Data Requests upon Interstate Navigation, which were responded to on May 30, 2019.

Whereas: Docket D-19-05 has had no additional filings or activity since May 30, 2019.

Whereas: Given the sufficiency of the initial data responses and subsequent inactivity of the matter, D-19-05 is ripe to be administratively closed.   

Accordingly, it is

(25580) ORDERED:

1.      Docket D-19-05 is hereby closed.

NOTICE OF AVAILABILITY OF JUDICIAL REVIEW

(PROVIDED PURSUANT TO R.I. GEN. LAWS § 42-35-12)

 

Please be advised that if you are aggrieved by this final decision (report and order) of the Rhode Island Division of Public Utilities and Carriers (“Division”) you may seek judicial review of the Division’s final decision by filing an appeal with the Rhode Island Superior Court.  You have thirty (30) days from the mailing date (or hand delivery date) of the Division’s final decision to file your appeal.  The procedures for filing the appeal are set forth in Rhode Island General Laws, Section 42-35-15.

Proceedings for review may be instituted by filing a complaint in the Superior Court of Providence or Kent Counties.  Copies of the complaint must be served upon the Division and all other parties of record in your case.  You must serve copies of the complaint within ten (10) days after your complaint is filed with the Superior Court.

Please be advised that the filing of a complaint (appeal) with the Superior Court does not itself stay enforcement of the Division’s final decision. You may, however, seek a stay from the Division and/or from the Court.

The judicial review shall be conducted by the Superior Court without a jury and shall be confined to the record.  The Court, upon request, shall hear oral argument and receive written briefs.
