City Council, April 6, 1994

A regular session of the City Council is held Wednesday, April 6, 1994, at nine o’clock p.m. All the members are present and President Barry presides.

The reading of the Records of March 23, 1994, is dispensed with and the Records are approved as prepared by the Clerk.

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder the *Consent Agenda is approved on a unanimous voice vote.

Petition for AUTO REPAIR SHOP LICENSE of B. Baron Automotive, Inc., 25 Hazel Street, Tax Assessor’s Plat 47, Lot 656, to keep a shop for repairing automobiles and repairing same, which was advertised for a hearing at this time, it taken up: LIC#30153

Speaking in favor is Herman Ramdeen, 25 Hazel Street, applicant.

Mr. Ramdeen states that this business will be a repair shop for high class vehicles, by appointment only.

The hours of operation will be 8:30 a.m. - 6 p.m. Mondays - Fridays, and Saturdays by appointment.

There will be no vehicles parked on the street, only in the fenced-in area. No more than 5–6 vehicles will be kept on the lot at one time. There is enough room for eight.

There will be two employees.

There will be no body work or painting.

Speaking in opposition is Patricia MacDonald, 235 Gano Street, Providence, RI.

070      Ms. MacDonald represents the property owner of 33 Hazel Street, which is next door to the shop. She is concerned about noise, environmental concerns, many kids nearby, and devaluation of property.

Speaking in opposition is Margaret Pollard, 48 Hazel Street, Pawtucket, RI.

Ms. Pollard submits a petition with 31 names in opposition to the license for an auto repair shop.

Ms. Pollard asks why the shop is now operating without a license, and why are there are more vehicles on the property than what Mr. Ramdeen says there should be. She has seen flatbed trucks delivering cars to the lot which were not high class.

She states that the business appears to be a salvage operation. She further states that there are cars on the lot that have no plates. She is concerned about kids getting hurt, ventilation at the shop, and spray painting, which he appears to be doing.

Speaking in opposition is Cheryl Dupre, 24 Hazel Street, Pawtucket, RI.

Ms. Dupre states that today, there were 9 cars on the lot; 4 junks on the side. There was loud music, engines were revving, cars were peeling out, and kids were playing near there.

Ms. Dupre further states that Mr. Ramdeen has gone against everything he said he would do. She also states that there are several other auto repair shops in the neighborhood.

There are no other speakers.

Petition for AUTO REPAIR SHOP LICENSE of Jiffy Lube International d/b/a Jiffy Lube, 121 Newport Avenue, Tax Assessor’s Plat 41, Lot 211, to keep a shop for repairing automobiles and repairing same, which was advertised for a hearing at this time, it taken up: LIC#40140

Speaking in favor is Bill Mitchell, 72 Pine Road, Attleboro, MA.

Mr. Mitchell states that he is the District Manager of Jiffy Lube in Pawtucket, and has been there for eight years as a Franchise; it has now been bought by Jiffy Lube, International.

Mr. Richard Almeida manages the Newport Avenue store and has worked for the Company for six years; four months on Newport Avenue.

There will be no change in the operation.

Speaking in opposition is Dorothy Donnelly, 98 Newport Avenue, Pawtucket, RI.

Ms. Donnelly states that she does not know what will be happening at the shop.

Petition for VICTUALLING HOUSE (24 HOUR) LICENSE of Christy Mihos d/b/a Christy’s Market, 755 Mineral Spring Avenue, requesting a license to operate the additional hours between 2:00 am and 6:00 am, which was advertised for a hearing at this time, is taken up: LIC#135

Speaking in favor is Anthony J. Bucci, Jr., Attorney, One Park Row, Providence, RI.

Mr. Bucci states that the applicant is requesting a 24 hour license. The establishment has been in operation for 6 years as a convenience store, and has been asked by customers to stay open for the additional hours.

There have been no complaints. There is an alarm system tied to the police station and also there are panic buttons.

The additional hours will create two new jobs.

There is a Dunkin Donuts across the street, which has a 24 hour license.

All traffic is through the front of the building and should not affect the neighbors in the back. The trash is dumped in back between 3–5 p.m. only. There are no deliveries after dark.

Speaking in opposition is Charles A. Henry, 19 Russell Lane, Smithfield, RI.

Mr. Henry states that he owns the property adjacent to Dunkin Donuts. He states that this is a residential area with many commercial businesses within 300 feet of his property.

He further states that there may be a drive-thru added to Dunkin Donuts.

Mr. Henry feels there is enough activity in the area during those hours.
