A regular session of the Pawtucket Board of License Commissioners was held Wednesday, February 5, 2024, at 7:09 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

 

Present – President Mercer, Councilors Araujo, Coderre, Moran, Moreno, Rubio, Stachowiak and Wildenhain.

 

Absent – Councilor Gregor.

 

Chairperson Mercer presided.

 

1.      The reading of the records of January 22, 2025 was dispensed with and the records were APPROVED as prepared by the Clerk

 

2.      Upon motion made by Councilor Araujo, seconded by Councilor Moreno, the *Consent Agenda was APPROVED, on a unanimous voice vote.

 

3.      *THE FOLLOWING PETITIONS FOR LICENSES WERE APPROVED ON A UNANIMOUS VOICE VOTE:

4.      Communication from Dino Giorgio, Pawtucket Police, to Pawtucket Board of License Commissioners. (Report on Industrial Café, 120 Webster Street) was READ AND ORDERED FILED.

 

5.      A FORMAL HEARING ON THE FOLLOWING LICENSE WAS TAKEN UP:

 

CLASS B (VICTUALLER)

 

Picos Restaurant & Hookah Lounge (Picos Restaurant & Lounge LLC) 110 School St. LIC#LQB-24-60 (ent)

 

Representing the City of Pawtucket was Frank Milos, Jr., Esq., City Solicitor.

 

Speaking was Attorney George Lough, III, 222 Jefferson Blvd., Warwick, RI, attorney for the license holders; and Osvaldino DaSilva, 71 Meadow Street, Pawtucket, RI, license holder.

 

Mr. Milos stated that the owners of Picos Restaurant admit to keeping a disorderly house.

 

If accepted by the Board, the owners agree to a $500 fine and a 1-day suspension, which is to be stayed for 90 days.  If they avoid further issues, the penalties will be waived.  However, if there are further issues within 90 days, the penalties will come due.

 

Attorney Lough agrees with Mr. Milo’s assessment, however, he stated that these been isolated incidences.  He noted that they have had a number of community activities and charitable events. 

 

They take these issues seriously.  After 11:00 p.m. they will try to limit to people coming into the establishment to those over age 25.  They will add on additional security, if needed.  They are looking to address parking issues.  They will turn down the music.

 

Mr. Lough also noted that on Sunday nights, 7-9 of the people exiting the building are staff cleaning up.  They left right before 1:30 a.m.

 

There were no other speakers. The formal hearing was closed.

 

THE CHAIR RECOGNIZED COUNCILOR CODERRE.

 

Upon motion made by Councilor Coderre, seconded by Councilor Araujo, the Board ACCEPTED THE PLEA OF NO LO CONTENDRE AND IMPOSED ON THE LICENSE HOLDER, PICOS RESTAURANT & HOOKAH LOUNGE (PICOS RESTAURANT & LOUNGE LLC) 110 SCHOOL STREET, A FINE IN THE AMOUNT OF $500.00 AND A 1-DAY SUSPENSION TO BE STAYED FOR 90 DAYS, for the following reasons, on a unanimous voice vote:

 

1.      On or about September 8, 2024; October 21, 2024; November 10, 2024; December 16, 2024; and January 6, 2025: Failure to maintain control of patrons and/or employees, agents; and/or endangering the health, safety and welfare of the general public; and/or permitting the house or place where you are licensed to sell beverages under the provisions of Title 3 of the General Laws to become disorderly as to annoy and disturb the persons inhabiting or residing in the neighborhood; and/or permitting any of the laws of this state or ordinances of this city to be violated. (See attached report.) (Violation of R.I. Gen. Laws § 3-5-23).

 

 

Upon motion made by Councilor Araujo, seconded by Councilor Rubio, the meeting was adjourned at 7:25 p.m.
