KENNEL Renewal -

Harmony (Harmony Dog Training LLC) 65 Patterson Ave. LIC#KNL-25-2

Chair Mercer asked Amy H. Goins, Esq., attorney for Harmony Dog Training LLC, to approach the podium.

Chair Mercer asked Attorney Goins if the license holder would accept two stipulations for the license:

1.      No outside use by the dogs

2.      Soundproofing of the building

Attorney Goins responded that Harmony Kennel would object to any conditions on the license.  She stated that the license should be approved without any conditions, as it had been 2025, and that the Board had approved the license without conditions in 2024.

THE CHAIR RECOGNIZED COUNCILOR GREGOR.

Upon motion made by Councilor Gregor, seconded by Councilor Wildenhain, the motion to DENY the  Kennel license renewal for Harmony Dog Training LLC for the following reason was APPROVED on a roll call vote, as follows:

Ayes – President Mercer; Councilors Araujo, Coderre, Gregor, Rubio, Stachowiak and Wildenhain
Noes – 0.

(1)  The premises are located within 200 feet of a residential district, in violation of the locational requirement for kennels.  Section 116-56(C) of the Code of Ordinances of the City of Pawtucket conditions the issuance of a kennel license upon compliance with the performance standards set forth in Section 410-60(U), including Section 410-60(U)(3), which requires that a kennel be located no closer than 200 feet to a residential district.

Based on the evidence presented at the hearing, including the testimony of Carl Johnson, Director of Zoning and Code Enforcement, the Board finds that the premises at 65 Patterson Avenue are located within 200 feet of a residential district.  The Board further finds that the 200-foot requirement is a condition of licensure under Chapter 116 that the Board is obligated to apply to every application, whether for an original license or a renewal.

The denial was based on the foregoing findings and reasons, following the formal hearing on September 10, 2026 and consideration of testimony, evidence, and relevant municipal ordinances.

THE CHAIR RECOGNIZED COUNCILOR GREGOR.

Upon motion made by Councilor Gregor, seconded by Councilor Stachowiak, the motion to DENY the kennel license renewal for Harmony Dog Training LLC for the following additional reason was APPROVED on a roll call vote, as follows:

Ayes – President Mercer; Councilors Araujo, Coderre, Gregor, Rubio, Stachowiak and Wildenhain.

Noes – 0.

(2)  The operation of the kennel constitutes a nuisance under Sections 116-25(A), 116-59(K) and Section 286-10 of the Code of Ordinances, as cited in the Summons.

The Board heard credible testimony from residents of the surrounding neighborhood that dogs kept at the premises bark frequently and for extended periods, including in the early morning and late evening hours, and that the barking is plainly audible inside their homes.

The Board finds that the aforementioned barking along with persistent and offensive odors, produced by allowing the dogs to relieve themselves in the side yard of the premises in close proximity to neighboring residential dwellings, constitutes a nuisance within the meaning of the cited ordinances.

The denial was based on the foregoing findings and reasons, following the formal hearing on September 10, 2026 and consideration of testimony, evidence, and relevant municipal ordinances.

9.      THE FOLLOWING PETITION FOR LICENSES WAS APPROVED ON A UNANIMOUS VOICE VOTE: Video
