A.        CALL TO ORDER Video Icon

 

Vice President Palmisciano called the meeting of the Richmond Town Council to order at 6:00 P.M. held on March 15, 2022. This meeting was held In-Person at Town Council Chambers, 5 Richmond Townhouse Road, Wyoming, RI, and was also teleconferenced via Zoom.

 

B.        ROLL CALL

 

Town Council Members present in Council Chambers were as follows: Vice President James Palmisciano, Councilor Ronald Newman, Councilor Rich Nassaney and Councilor Lauren Cacciola. Not Present: Council President Nell Carpenter. Also present Town Administrator Karen D. Pinch, Town Solicitor Karen Ellsworth, Chief of Police Elwood Johnson, Finance Director Laura Kenyon, Town Planner Shaun Lacey, Public Works Director and Fire Chief Scott Barber, Tax Assessor Carmen LaBelle and Town Clerk Erin Liese.

 

C.        THE PLEDGE OF ALLEGIANCE TO THE FLAG

 

Hayden Puglia, Eagle Scout led in the Pledge of Allegiance.

 

D.        MOMENT OF SILENCE

 

Vice President Palmisciano led in the following moment of silence: Sadly, Matt Dennison, has passed from the injuries he sustained when he and his friend, Kevin McDonald, were hit by a drunk driver on February 12th. So I ask that you please keep the Dennison family and the McDonald family in your prayers. Also, as many of you know, my close friend fled Ukraine. Hours after the invasion with her family. Her husband remains now fighting for his country. Please remember the Ukrainian people in your thoughts and prayers and hope for an end of this terrible madness.

1)   Discussion and consideration of “ Fair Share” Distribution to Independent Fire District and Ambulance Associations under the American Rescue Plan Act of 2021

 

Chief Barber had explained that Chief Lee had submitted the proposal available in your packet and that he did plan on attending tonight. He explained the request for the Fire Departments to be included in the distribution of the fund. He advised all the Departments budgets were reviewed and explained the following request:

Chief Barber also explained that the first responders, became the faces of response in the beginning of the pandemic. He further commented on the support to the community provided by the Fire Departments.  He apologized for Chief Lee’s absence. 

 

Council thanked the Chief, Fire Departments and EMS for their work done in the community.

 

A motion was made to refer the request of the Fire District and Ambulance Associations under the American Rescue Plan Act of 2021 to staff for further consideration by Councilor Cacciola seconded by Councilor Newman. A motion was made to re-open the Public Hearing on Application Request from Lawrence G. Mr. Larry Casey and Attorney Robert Craven were present.

 

Town Solicitor Ellsworth advised at the last meeting this had been referred to staff.

 

Town Planner Lacey stated the Council was presented with a request to rezone the property is located at 301 and 310 Nooseneck Hill Road from R-2 to L-1. He advised the applicant was seeking 30 uses. He explained initially Mr. Casey had only come in front of the Planning Board for use code 962- Warehouse storage. He recommended either you approved the list that the applicant is seeking or you refer it back to the Planning Board for a second look at the request.

 

Councilor Newman questioned what the benefit would be to sending the application back to the Planning Board.

 

Town Planner Lacey advised it would give the Planning Board a better understanding on the expansion request, as the board did not have the benefit of that discussion.

 

Councilor Newman stated he was supportive of Mr. Casey and his business.

 

Town Solicitor Ellsworth advised the Planning Board discussed this earlier, they did not have this list of uses in front of them that Mr. Casey is proposing now; so they didn't have an opportunity to discuss.

 

Vice President Palmisciano questioned Town Planner on any concerns of the use codes proposed.

 

Town Planner Lacey explained the Light Industrial Zone is very broad. He explained nothing in particular however; the board did not have the full intent of use categories for both sights. He also explained the Planning Board would have a review of uses during Development Plan Review.

 

Mr. Lawrence Casey explained his request. He explained his business has been in operation for over 35 years. He has been in Richmond for 22 years. He commented on the need to expand and the ability to share his location with other uses. He wanted to create a pathway for small businesses to grow.  He advised they have general uses and nothing concrete. He commented on the difficulty of navigating through a pandemic and shipping costs and availability. He explained he needs to grow his facility. He advised he has no intentions of having Marijuana growth or commercial solar on the sight. He advised this is a family business and it will be passed on to his daughter Serena. They are very proud of the business they have created. He explained the need to provide a location for tradesman, professional offices, trade school, motion picture and recording, retail service and repair, personal service, self-storage, equipment rental with outside storage, farmers market, greenhouse,  art studios, mill work, commercial painting, textile manufacturing, metal fabrication, and general warehouse. He advised on the critical nature of approving this due to space limitations.

 

Vice President Palmisciano stated this sounds like an incubator business that will be working in Richmond.

 

Serena Casey also explained the difficulties of the crowding and the need to expand the warehouse storage.

 

Councilor Newman commented on the green house industry.

 

Joe Reddish of Corey Trail and member of the EDC advised the EDC was supportive of Mr. Casey business expansion. Economic growth is the only way we can reduce the tax burden. He further commented on the improvement to the area by Mr. Casey.

 

Iva Lipton also supported Mr. Casey and delaying this was the wrong way to go.

Councilor Newman questioned the Solicitor if she has some recommendations.

 

Town Solicitor Ellsworth advised that she would feel uncomfortable approving this for all the uses without the Planning Board having the opportunity to review all the uses requested. She advised you could reopen and continue the hearing and send it back to Planning for the option.

Town Solicitor Ellsworth advised it could be referred back to the Planning Board for their next meeting.

 

Town Clerk Liese advised if they are to continue the matter, it needs to be to a date certain to avoid re notice.

 

Councilor Nassaney questioned the Town Planner to see if that was an option.

 

Town Planner Lacey advised they had room on that agenda.

 

Councilor Cacciola shared concern with delaying the matter.

 

Vice President Palmisciano advised that was next Tuesday, March 22nd. He questioned if Mr. Casey could move forward with the Warehouse and send other use codes back.

 

Mr. Casey explained he believed the reasoning why he was limited as the Fasano’s zone change was limited. He shared concern with delaying the matter.

 

Town Solicitor Ellsworth advised you could vote on the single use and send the rest of the uses back to the Planning Board.

 

Councilor Newman asked if that would work for Mr. Casey.

 

Mr. Casey advised that would not be in his best interest. He explained the history of his business.

 

Discussion ensued on the application request and it was noted initially it was for only use code 962- Warehouse.

 

Councilor Nassaney explained deferring this by a week or so gives you more opportunity. He advised he wants to move this forward, however it needs to be reviewed so it is the best interest of the town. He advised the Planning Board needs to have the opportunity to review the entire proposal.

 

Town Planner Lacey advised if it is the Council’s desire to bring it back to the Planning Board, and he does not like breaking up the properties. It would improve the current operation on 301; however, separating the hearings logistically for Planning and the Town Clerk would require lead time and would need to be noticed to the paper and abutters. It would be an additional expense to Mr. Casey. He did agree with Town Clerk Liese to continue the matter to a date certain to avoid those additional expenses.

 

Vice President Palmisciano suggested a special meeting date of March 23rd; which is the day after the Planning meeting.

 

Discussion ensued on planning review and special meeting.

 

Vice President Palmisciano only shared concern with the fuel use code.

 

Councilor Newman confirmed there was no vision for marijuana or commercial solar. Mr. Casey agreed to that.

 

Councilor Cacciola shared concern with waiting and stated we are going backwards.

 

Town Solicitor Ellsworth advised Zone changes are permanent. However the change runs with the land and Planning Board has to determine those uses.

 

Discussion ensued on the opportunity for the potential for growth.

 

A motion was made to continue the Public Hearing to March 23, 2022 on the Application Request from Lawrence G. 2)         Discussion and consideration of amendments to Sec. 3.50.010 of the Code of Ordinances, Tax exemption for older and disabled property owners

 

A motion was made to open the Public Hearing on amendments to Sec. 3.50.010 of the Code of Ordinances, Tax exemption for older and disabled property owners by Councilor Nassaney seconded by Councilor Cacciola. Town Solicitor Ellsworth explained the proposed amendments that would raise the income brackets by 3.9% and it also adjusts the median residential assessment. She further advised that the Tax Assessor had shared concern with the generosity of this exemption.

Tax Assessor LaBelle stated her recommendation would be to level fund the exemption and leave the income where it is at.

 

Councilor Nassaney questioned what the income limit would be.

 

Vice President Palmisciano advised the limit would be $63, 632.

 

Discussion ensued on the revenue impact and exemption. It was noted they could not determine the impact as it’s based on income.

 

Town Solicitor Ellsworth stated if you do decide that you want to keep the income brackets the way they are now and not change them at the very least, I think, you still need to change the second number in each line and that's the number, based on the median residential assessment.

 

Julie Leusner of Beaver River Road questioned what the second number was they were referring to.

 

Town Solicitor Ellsworth advised if you refer to the meeting materials the document is attached and would provide explanation.

 

Town Administrator Pinch stated, I think there are two pieces here I think there's a question of whether you level fund or  increase it by 5.9% or you do something in between, and then there's also a separate issue of potentially recalculating how this exemption is awarded.

 

Vice President Palmisciano questioned if other towns looked at assets.

 

Tax Assessor LaBelle advised she did not know of any other town that looks at assets. However, suggested looking at the exemptions by range of income.

 

Iva Lipton of Wilbur Hill Road advised on the history of the elderly exemption.

 

Laura Rieger of Downs Court stated she agreed the Town of Richmond does have a generous exemption. She further explained the town only has a 3 year limit. She also stated the increase was based on evaluations from last year.

 

A motion was made to close the Public Hearing on amendments to Sec. 3.50.010 of the Code of Ordinances, Tax exemption for older and disabled property owners by Councilor Nassaney seconded by Councilor Newman. Vote: Vice President Palmisciano, Aye Councilor Newman, Aye; Councilor Cacciola, Aye; Councilor Nassaney, Aye    

 

Councilor Nassaney advised this is a difficult decision and you are effecting people’s pocket. He explained that he shared concern of the 5.9%; however level funding is also difficult.

 

A motion was made to level fund Sec. 3.50.010 of the Code of Ordinances, Tax exemption for older and disabled property owners by Councilor Newman seconded by Councilor Nassaney.

 

Councilor Nassaney questioned what that number would be.

 

Town Solicitor Ellsworth advised, generally speaking, the income brackets are increased, and the median residential values decreased.

 

Discussion ensued on change from last year.

 

Councilor Newman withdrew his previous motion.

 

A motion was made to approve the amendments as presented to Sec. 3.50.010 of the Code of Ordinances, Tax exemption for older and disabled property owners by Councilor Newman seconded by Councilor Cacciola.

Town Administrator Pinch advised on the hiring process and explained Kendra was present.

 

A motion was made to approve the hiring of Kendra Tanguay as Assistant Town Clerk with a rate of pay to be $20.50 by Councilor Newman seconded by Councilor Cacciola. Vote: Vice President Palmisciano, Aye Councilor Newman, Aye; Councilor Cacciola, Aye; Councilor Nassaney, Aye    

 

b)         Update on Richmond Summer Camp

 

Town Administrator Pinch reminded parents that they are now accepting applications from grants.

 

c)         Update on Federal Grants

 

Town Administrator Pinch advised on the status of federal grants. She explained they are waiting on word on the $150,000 grant application. She was also pleased to announce the Town received a grant in the amount of $570,000 for across the street on the land that we own for a pavilion with the bathroom facility playground basketball courts, septic, and engineering.

 

d)         Announcement of Government Finance Officers Association Award

 

Town Administrator Pinch advised on the award received and thanked Laura Kenyon for her work.

 

e)         Moderator for the Financial Town Meeting

 

Town Administrator Pinch advised that Julianna Golas has announced she would be resigning as moderator. She has advertised the vacancy and requested consideration of rate of pay.

 

Discussion ensued on rate of pay and Moderator’s role.

 

Councilor Newman suggested a stipend of $100.00.

Town Solicitor Ellsworth cautioned against a motion at this time. It should be placed on a future agenda for consideration.

2)         Discussion and consideration of a request of Hayden Puglia for an Eagle Project Proposal to construct 1-3 pieces of agility equipment for the Richmond Dog Park located at 55 Buttonwoods Road

 

Hayden Puglia explained her Eagle Scout Project to construct agility equipment for the Richmond Dog Park.  She presented the examples of equipment she wished to construct. She also advised on the fundraising effort and her badges.

 

Vice President Palmisciano questioned her rank in girl scouts.

 

Ms. Puglia explained she is working on her silver project so she will be a Gold Eagle someday.

 

A motion was made to approve the Hayden Puglia for an Eagle Project Proposal to construct 1-3 pieces of agility equipment for the Richmond Dog Park located at 55 Buttonwoods Road by Councilor Cacciola seconded by Councilor Newman. Vote: Vice President Palmisciano, Aye Councilor Newman, Aye; Councilor Cacciola, Aye; Councilor Nassaney, Aye    

 

Council donated funds towards the project.

 

Councilor Nassaney suggested bringing a bucket to town hall to collect donations.

 

Ms. Puglia introduced her family.

 

3)         Discussion and consideration of Cancelling/Rescheduling the April 5, 2022 Regular meeting due to the Chariho All Day Referendum

 

Town Clerk Liese advised chambers will not be available on April 5th as voting takes place on that day.
