1. July 22, 2025 Regular Meeting Minutes
1. Requested Removal of Inclusionary Zoning Requirements and Return of Fee In-Lieu – Master Plan Decision, Sept. 11, 2018, amended Sept. 14, 2021 – The Preserve at Boulder Hills, Phase 2 and Final Plan Decision, June 12, 2024 – The Preserve at Boulder Hills, Phase 2B. Submitted by Attorney Americo Scungio, on behalf of his clients: The Preserve at Boulder Hills, LLC; The Preserve at Boulder Hills, II, LLC; The Preserve at Boulder Hills, III, LLC; The Preserve at Boulder Hills, IV, LLC; Castle Residences, LLC; MTM Development Corp.
The applicants are seeking the removal of Inclusionary Zoning requirements, and the return of a fee paid in-lieu. The Planning Board will discuss, consider, and possibly vote on the requests identified in Section 2 of Attorney Scungio’s April 28, 2025 letter, “RE: The Preserve at Boulder Hills – Phase 2. Major Land Development Project – Master Plan Decision, September 11, 2018, as amended and Decision of Administrative Officer, Final Plan – Phase 2B, The Preserve at Boulder Hills III”, and Attorney Scungio’s letter of July 17, 2025, “Request of the Preserve for removal of condition #15 from Master Plan Approval for Phase 2.”
2. Planning Board Recommendation to the Town Council - Discussion and Recommendation of Draft Amendments to the Code of Ordinances, Title 18, “Zoning”, Chapter 18.16 – “Use Regulations”, for Special Use Permit criteria. Continued from the Planning Board’s May 13, 2025, June 10, 2025, and June 24, 2025 workshops.
The Planning Board will discuss, consider, and possibly vote to submit the drafted amendments to Ch. 18.16 of the Zoning Ordinance to the Town Council for their consideration.
1. Master Plan Extension Request – Request of The Preserve at Boulder Hills, LLC, The Preserve at Boulder Hills, II, LLC, The Preserve at Boulder Hills, III, LLC, The Preserve at Boulder Hills, IV, LLC, Castle Residences, LLC, and MTM Development Corp., for a one-year extension of the Preserve at Boulder Hills Master Plan Decision, approved September 11, 2018, as amended.
The Planning Board will discuss, consider, and possible vote on the applicant’s Master Plan extension request. The applicant will appear before the Planning Board to request the extension, and explain the status of the project, pursuant to Article 5, Section 5.6.3.7 of the Richmond Land Development and Subdivision Regulations.
2. Advisory Opinion to the Town Council – Application of the Town of Richmond, 5 Richmond Townhouse Road, Wyoming, RI 02898 for a proposed Zoning Ordinance Amendment. The proposed Zoning Ordinance amendment, if approved, would amend the Zoning Map by rezoning 4 Richmond Townhouse Road, Wyoming, RI 02892, designated as Plat 6C, Lot 18 from Residential Use – Two Acre (R-2) to Public and Governmental (PUB).
The Planning Board will discuss, consider, and possibly vote to render an Advisory Opinion to the Town Council on the proposed application.
1. I administratively approved the Final Plan for the Tug Hollow Conservation Subdivision, and recorded the decision in the Land Evidence Records on July 9, 2025. My apologies for not including this information as part of the July 22, 2025 “Announcements and/or Informational Items.”
2. I administratively approved the Final Plan for the Gardiner Apartments application, and recorded the decision in the Land Evidence Records on August 7, 2025.
3. Some members of the public have inquired about the material produced by Stantec for the Municipal Technical Assistance Program (MTAP). The final product (which is, for reasons unknown to me, labeled as a “draft”) has been included in the Planning Board’s packet.
