A.   The Town Council may convene into Executive Session to discuss, take possible action, and/or vote regarding litigation pursuant to the relevant requirements of R.I. General Laws § 42-46-5(a) Subsection (2) Pending Litigation (Guglielmi v. Town of Scituate et al, C.A. PC-2017-4543, No. 1:17-cv-00460-JJM-LDA).  Discussion and/or Potential action, announcement and/or vote(s) from Executive Session and/or Open Session in Guglielmi v. Town of Scituate et al, C.A. PC-2017-4543, No. 1:17-cv-00460-JJM-LDA, and to take any other action relative thereto.

 

B.   The Town Council may convene into Executive Session to discuss, take possible action, and/or vote regarding litigation pursuant to the relevant requirements of R.I. C.   The Town Council may convene into Executive Session to discuss, take possible action, and/or vote regarding litigation pursuant to the relevant requirements of R.I. General Laws § 42-46-5(a) Subsection (2) Potential Litigation (Aeril Rolley v. Town of Scituate, Workers’ Compensation Claim # 412555).  Discussion and/or Potential action, announcement and/or vote(s) from Executive Session and/or Open Session concerning settlement proposal in Aeril Rolley v. Town of Scituate, Workers’ Compensation Claim # 412555, and to take any other action relative thereto.

F.   Authorization for Council President Brady to sign the deed from the State of Rhode Island in which the State proposes to transfer the Esek Hopkins land (Lots 7 & 39 on Scituate Tax Assessor’s Plat 32), with restrictions, to the Town, and to take any other action relative thereto.

 

G.   Authorization for Councilman McCormick, current liaison to the RI League of Cities and Towns, to serve as Scituate’s representative and voting member on the Executive Board of the RI League of Cities and Towns.

 

H.   Consideration and approval of updated Purchasing Policies, proposal by the Town's Purchasing Agent and Treasurer.

 

I.    Consideration and approval of updated Capital Budget Guidelines, proposal by the Town's Purchasing Agent and Treasurer.

 

11. Resolutions:

 

A.   A Resolution authorizing the Town to enter into loan agreements with the Rhode Island Infrastructure Bank for the Community Septic System Loan Program, a continuation of the septic system homeowner loan program begun in June of 2013, and to issue notes in the aggregate amount of not more than $300,000.00, and no more than $40,000.00 per homeowner, with a maximum loan term of ten (10) years, and to take any other action relative thereto.

 

12. Town Business—Review, Discussion and/or Potential Action and/or Vote:

 

A.   Update from Police Station Building Committee on the status of the Police Station Project and consideration of the Committee’s actions and progress of the Project.

 

B.   Consideration and approval of a job description and qualifications for the Department of Public Works (“DPW”) Director Position; authorization to post seeking interested applicants for open DPW Director Position.

 

C.   Reconsideration of the appointment of a search committee for the open DPW Director position; said committee to be charged with reviewing applicants, conducting interviews and providing the Town Council with a 1^st and 2^nd recommendation for the open position, and/or such other related charge as determined by the Town Council; the Town Council to determine the composition of the search committee, which may be comprised of three members of the Town Council and two members from the community, or such other composition as determined by the Town Council, with nominations and selection to fill the committee positions to be made at this meeting, and the Town Council to take any other action relative thereto.

 

D.   Discussion and consideration regarding the State Department of Labor and Training (“RIDLT”) adding the Town to RIDLT’s legal actions being undertaken related to the alleged failure on the part of two vendor contractors to pay prevailing wages on the Police Station construction project.

 

E.   Recommendation from the Town Purchasing Agent to award the bid for furniture and fixtures for the new police station; bids submitted: Environments at Work - $71,223.93, Office Direct - $51,259.00, HCONE International - $134,099.00, WB Mason - $61,346.04, Sheehan’s - $47,665.50; bid award recommendation to be made at the Council meeting; funded using the anticipated unused balance from the 2019/20 operating budget for the Scituate Police Department, and authorization for the Purchasing Agent and Treasurer, each, to take any and all such actions, and to approve, execute and deliver all such awards, certificates, receipts, or other documents as may be necessary to carry into effect the foregoing, or to take any other action relative thereto.

 

F.   Recommendation from the Town Purchasing Agent to award the bid for a Hybrid VoIP PBX telephone system for the new Police Station; bids submitted: ATG Group - $17,959.00, RI Telephone - $22,724.45, Connectivity Point - $20,856.00; bid award recommendation to be made at the Council meeting; funded using previously approved funds in the five-year capital plan for the Scituate Police Department, and authorization for the Purchasing Agent and Treasurer, each, to take any and all such actions, and to approve, execute and deliver all such awards, certificates, receipts, or other documents as may be necessary to carry into effect the foregoing, or to take any other action relative thereto.

 

G.   Authorization for Police Chief Donald R. Delaere, Jr. to execute a Holding Facility Agreement between the Johnston Police Department and the Scituate Police Department to address mutual assistance in the temporary holding of arrestees and/or other prisoners.

 

H.   Clarification from the Scituate Land Trust and Conservation Commission on conservation restrictions with regard to the current status on Doctor’s Field (Lot 318 on Scituate Tax Assessor’s Plat 10) and Town Council’s consideration on future use of Doctor’s Field.

 

I.    Recommendation from the Scituate Land Trust and Conservation Commission regarding the transfer of town-owned land at Lawton Farm (Lot 9 on Scituate Tax Assessor’s Plat 9) to the Land Trust with a simultaneous conservation easement from the R.I. Department of Environmental Management; Discussion, consideration, and authorization for the Town Council President and Treasurer, each, to take any and all such actions, and to approve, execute and deliver all such deeds, certificates, receipts, or other documents as may be necessary to carry into effect the foregoing, or to take any other action relative thereto.
