A.  Move that the minutes of the November 15, 2021 Town Council work session meeting be approved as recorded.

 

B.  Move that the minutes of the November 16, 2021 Town Council executive session meeting held Rhode Island General Laws Section 42-46-5(a)(1), Personnel, to interview Pamela Dolan, Charles Boyd, Paul Harrison, and Bobby Nikolopoulos for possible reappointments and Elizabeth Segovis and Cori Lynn Healey for possible appointments to a town board or commission and Rhode Island General Laws Section 42-46-5(a)(5) Real Estate; to consider, discuss and act upon the potential disposition, sale or lease of surplus Town Property be approved as recorded and sealed.

 

C.  Move that the minutes of the November 16, 2021 Town Council open session meeting be approved as recorded.

 

VII.      Consider, discuss and act upon the following possible appointments and reappointments: 

 

A.  Land Trust reappointment with a term expiring in September of 2026.

 

B.  Land Trust reappointment with a term expiring in September of 2022.

 

C.  Johnston-Smithfield Juvenile Hearing Board reappointment with a term expiring in September of 2024.

 

D.  Economic Development Commission reappointment with a term expiring in September of 2022.

 

E.   Land Trust appointment with a term expiring in September of 2022.

 

F.   Ad-Hoc Dog Park Committee appointment.

 

VIII.    Public Hearings: 

 

A.  Conduct a public hearing to consider, discuss, and act upon adopting amendments to the Land Use and Economic Development chapters of the Comprehensive Community Plan involving the description of the Planned Corporate District (PCD) in these chapters will be amended by adding light industrial, industrial parks, hospitals, medical offices, pharmaceutical manufacturing facilities and warehouse distribution facilities to the list of “By-right” uses within the district. References to the Planned Corporate District–B (PCDB) will also be eliminated throughout the plan. The Economic Growth Overlay district will also be amended by adding language that acknowledges that life science, industrial and medical facilities are allowed in the district in conformance with design guidelines. New action items calling for an expanded list of “by-right” uses in the PCD and EGO districts will be added in the Goals, Policies and Actions section of the Land Use and Economic Development chapters.

 

B.  Conduct a public hearing to consider, discuss, and act upon adopting amendments to the following sections of the Zoning Ordinance: 3.9 Building or Structure Nonconforming by Dimension: D. Addition and Enlargement, 5.5.7 Accessory Structures, c) 5.3.4 Buffers, A, 9.4 Economic Growth Overlay District, 9.4.4. Applicability, 9.4.6. Master Plan – Major Land Development Projects and Major Subdivisions, B, 9.4.9 Architectural Standards, add H. Industrial Design Standards, 9.4.16. Landscaping and Screening Standards, 12.5 Review Process for the Construction of Low and Moderate Income (LMI) Housing, delete and replace with new Section 12.5, 4.4 Supplementary Use Regulations: G-26. Communication Antenna(s) and H-2. Business & Storage, Zoning District Abbreviations - Industrial-Employment Zoning Districts, J-1A. Manufacture of Drugs and Pharmaceuticals, 4.3 Table of Uses: G. Retail Business & Service, 26. Communication Antenna(s), H. Wholesale Business and Storage, 1. Storage of Flammable Materials, 2. Wholesale Business & Storage, J. Industrial Uses, 1. Storage Facility, not including Truck Terminal and remove all References to PCDB Planned Corporate District (Bio Pharmaceuticals) throughout the Zoning Ordinance and Zoning Map.

 

C.  Schedule a public hearing on January 18, 2022 to consider amendments to Chapter 321 of the Code of Ordinances entitled “Taxation” by adding Article VI entitled “Exempting or Stabilizing of Taxes on Qualifying Commercial or Manufacturing Property”.

 

D.  Schedule a public hearing on January 18, 2022 to consider amendments to Chapter 19 of the Code of Ordinances entitled “Capital Improvements” and replacing it with Chapter 19 entitled “Capital Program and Reserve Funds”.

 

E.   Conduct a Public Hearing to consider, discuss and act upon approving the renewal of the Intoxicating Beverage Licenses, as listed, as applied, subject to compliance with all State regulations, local ordinances and a Certificate of Good Standing from the RI Division of Taxation.

G.  Conduct a Public Hearing to consider, discuss and act upon approving the renewal of the  following one (1) Victualling Only License to include renewal of the Extended Hours of Operations, as applied, subject to compliance with all State regulations and local ordinances:

A.  Consider, discuss, and act upon authorizing a contract, through the RI Master Price Agreement #MPA 52, with East Coast Masonry & Restoration, Inc. in the amount of eighty-three thousand, nine hundred dollars ($83,900.00) for masonry repairs at the Putnam Pike Fire Station to be funded by the EMS billing account.

 

B.  Consider, discuss, and act upon authorizing a resolution to purchase property located at 321 George Washington Highway (Assessor’s Plat 48. Lot 51) with funds from the voter approved Fire Station bond.

 

C.  Consider, discuss, and act upon authorizing the Police Department to accept a FY 21 Community Oriented Policing Services (COPS) Hiring Program grant, award number 15JCOPS-21-GG-03571-UHPX, in the amount of one hundred and twenty-five thousand dollars ($125,000.00), with a local match of up to two hundred and nine thousand, eight hundred and thirteen dollars and seventy six cents ($209,813.76).

 

D.  Consider, discuss, and act upon authorizing authorizes the Town Manager to submit a Land Acquisition Grant application for the purchase of 0 Cross Street (Assessor’s Plat 23, Lot 67A) in the amount of one hundred and seventy thousand dollars ($170,000.00.) through the RIDEM Recreation Acquisition and Development Grant.

 

E.   Consider, discuss, and act upon authorizing the Town Manager to submit a Large Grant application for the development of Pickleball Courts and an inclusive playground at Willow Field in the amount of four hundred and twenty-one thousand dollars ($421,000.00) through the RIDEM Recreation Acquisition and Development Grant.

 

F.   Consider, discuss, and act upon authorizing the Town Manager to submit a Small Grant application for the development of a splash pad at Deerfield Park in the amount of one hundred and fifty-five thousand dollars ($155,000.00) through the RIDEM Recreation Acquisition and Development Grant.

 

G.  Consider, discuss, and act upon authorizing Change Order #8 to Ahlborg Construction for the School Capital Improvement Project in an amount not-to-exceed two hundred and fifty-nine thousand, and seven dollars ($259,007.00).

 

H.  Consider, discuss, and act upon authorizing the purchase of ten (10) magnetic whiteboards for the School Capital Improvement Project in an amount not to exceed six thousand dollars ($6,000).

 

I.    Consider, discuss, and act upon authorizing furniture purchases for the School Capital Improvement Project from ME O’Brien and W.B. Mason in an amount not to exceed sixty-one thousand, two hundred and fifty-eight dollars and fifty-eight cents ($61,258.58).

 

J.   Consider, discuss, and act upon authorizing a request for proposals for the High School Auditorium theatrical sound, lighting, and video system replacement.

 

K.  Consider, discuss, and act upon adopting a resolution to sell property located at 999 Douglas Pike (Assessor’s Plat 46, Lot 49) to Richard J. Conti for the amount of two million, one hundred and fifty-five dollars ($2,155,000.00).

 

L.   Consider, discuss, and act upon the modification of restrictions in that deed dated June 22, 2010 and recorded in the Land Evidence Records of the Town of Smithfield in Book 747 at page 107 as modified by that Corrective Quitclaim Deed recorded in the Land Evidence Records of the Town of Smithfield at Book 808 at page 1 relative to the property located at 999 Douglas Pike (Assessor’s Plat 46, Lot 49).

 

M. Consider, discuss, and act upon adopting a resolution authorizing the Town Manager to accept a land donation from Esmond Realty Corporation for property located at 1 Oak Street and 5 Esmond Street (Assessor’s Plat 25, Lot 56, and Assessor’s Plat 25, Lot 47).

 

N.  Consider, discuss, and act upon approving tax abatements in the amount of three thousand, five hundred and twenty dollars and eighty-nine cents ($3,520.89).

 

O.  Consider, discuss, and act upon convening into executive session pursuant to Rhode Island General Laws Section 42-46-5(a)(5) Real Estate; to consider, discuss and act upon the potential disposition, sale or lease of surplus Town Property and and Section 42-46-5(a)(1); Personnel: Town Manager Annual Review.

 

XII.      Reconvene in open session, if necessary, to announce any executive session votes to be disclosed pursuant to RI General Laws, Sec. 42-46-4.
