A. Move that the minutes of the August 9, 2022 executive session meeting held pursuant to Rhode Island General Laws Section 42-46-5(a)(1) Personnel; to interview Jeremiah Adler, James G. Atchison, and Michael E. Romano for possible appointment or reappointment to a Town board or commission be approved as recorded and sealed.
B. Move that the minutes of the August 9, 2022 open session meeting be approved as recorded.
VII. Consider, discuss and act upon the following possible appointments and reappointments:
A. Conservation Commission reappointment with a term expiring in July of 2025.
B. Land Trust appointment with a term expiring in September of 2023.
C. Land Trust appointment with a term expiring in September of 2025.
D. Economic Development Commission appointments (2) with terms expiring in March of 2023.
E. School Building Committee appointments (2).
VIII. Public Hearings:
A. Schedule a public hearing on October 4, 2022 to consider adopting amendments to the Zoning Ordinance to add Section 9.5 entitled “Contaminated Groundwater Overlay District.”
B. Conduct a public hearing to consider, discuss, and act upon approving a new B-Victualler License for F & F Enterprises, LLC d/b/a “Wing Power”, 5 Sanderson Road, to include Outdoor Seating/Bar Service with the hours of operation to be Monday through Sunday from 6:00 a.m. to 1:00 a.m., as applied, subject to compliance with all State regulations, local ordinances, final approval from the RI Department of Health and the signature of the Building Official.

A. Consider, discuss, and act upon approving a new Victualling License for F & F Enterprises, LLC d/b/a “Wing Power”, 5 Sanderson Road, as applied, subject to compliance with all State regulations, local ordinances, final approval from the RI Department of Health and the signature of the Building Official.
B. Consider, discuss, and act upon approving a new Entertainment License for F & F Enterprises, LLC d/b/a “Wing Power”, 5 Sanderson Road, as applied, subject to compliance with all State regulations, local ordinances and the signature of the Building Official.
C. Consider, discuss, and act upon approving a new Special Dance License for F & F Enterprises, LLC d/b/a “Wing Power”, 5 Sanderson Road, as applied, subject to compliance with all State regulations and local ordinances.
D. Consider, discuss, and act upon approving a new Victualling Only License for J & M Way Enterprises, Inc. d/b/a “Island Fin Poke”, 445 Putnam Pike, as applied, subject to compliance with all State regulations, local ordinances, a Retail Sales Permit, the signature of the Building Official and final approval from the RI Department of Health.
E. Consider, discuss, and act upon approving one (1) Special Event License for Revive the Roots for a “Rootstock”, 374 Farnum Pike on the following date:
• Saturday, September 10, 2022 from 12:00 pm. to 8:00 p.m.
All Special Event Licenses for Revive the Roots are subject to compliance with all State regulations, local ordinances, a copy of their insurance policy and a final electrical inspection.
F. Consider, discuss, and act upon approving a new one (1) One Day Beer/Wine License for the Smithfield Senior Center as follows:
• 2022 Induction to the Heritage Hall of Fame to be held on Thursday, September 22, 2022
The party will take place at the Smithfield Senior Center, 1 William J. Hawkins, Jr. Trail from 6:00 p.m. to 9:00 p.m., as applied, subject to State regulations and local ordinances.
G. Consider, discuss, and act upon approving fifteen (15) Special Event Licenses for Seven Cedars Farm for “Haunted Hayrides”, 20 John Mowry Road on the following dates:

The party will take place at Seven Cedars Farm, 20 John Mowry Road, from 11:00 a.m. to 3:00 p.m., as applied, subject to State regulations and local ordinances.

XI. New Business:
A. Consider, discuss, and act upon a pole petition from RI Energy Co. and Verizon New England, Inc. incorporating the tree removal and tree trimming along Log Road to service the ISM Solar project.
B. Consider, discuss, and act upon authorizing a contract with RICON for road repair services for Deer Run Estates/West Farm Road in an amount not to exceed fifty-six thousand, one hundred dollars ($56,100.00).
C. Consider, discuss, and act upon amendment #15 to the Veolia Water operations and maintenance contract to prepare the Wastewater Treatment Facility Resiliency Plan for a fee not to exceed thirty-six thousand, three hundred and fifty dollars ($36,350.00).
D. Consider, discuss, and act upon rescinding a request for proposals for site construction work for the new fire station on George Washington Highway.
E. Consider, discuss, and act upon authorizing a request for proposals for construction of the new fire station on George Washington Highway subject to final review by the Town Solicitor.
F. Consider, discuss, and act upon cancelling the November 1, 2022 Town Council meeting.
G. Consider, discuss, and act upon authorizing a bid award for Comprehensive Performance Assessment Services to Berry Dunn in an amount not to exceed sixty-eight thousand, seven hundred and seventy dollars ($68,770.00) as recommended by the Budget and Financial Review Board subject to final review by the Town Solicitor.
H. Consider, discuss, and act upon authorizing a contract with Rowse Architects for architectural and engineering services at the Boyle Athletic Complex, Smithfield High School, and Gallagher Middle School in an amount not to exceed six hundred, ninety-seven thousand and seven hundred dollars ($697,700.00) subject to final review by the Town Solicitor.
I. Consider, discuss, and act upon approving tax abatements in the amount of four thousand, two hundred and nine dollars and six cents ($4,209.06).
