Convene into executive session to consider, discuss, and act upon matters pursuant to Rhode Island General Laws Section 42-46-5(a)(1) Personnel; to interview Michael Romano for possible reappointment to a Town board or commission and Rhode Island General Laws Section 42-46-5(a)(2); Potential Litigation.

VI.       Minutes: 

 

A.  Move that the minutes of the August 24, 2023 work session meeting on licensing procedures be approved as recorded.

 

B.  Move that the minutes of the September 5, 2023 executive session meeting held pursuant to pursuant to Rhode Island General Laws Section 42-46-5(a)(1) Personnel; to interview Marcie DiOrio for possible reappointment to a Town board or commission be approved as recorded and sealed.

 

C.  Move that the minutes of the September 5, 2023 open session meeting be approved as recorded.

 

VII.      Consider, discuss and act upon the following possible appointments and reappointments:

 

A.  Juvenile Hearing Board reappointment with a term expiring in September of 2024.

 

B.  Juvenile Hearing Board reappointment with a term expiring in September of 2026.

 

VIII.    Public Hearings: 

 

A.  Conduct a public hearing to consider and act upon amendments to Chapter 321 of the Code of Ordinances entitled “Taxation” to amend Article VI “Exempting or Stabilizing of Taxes on Qualifying Commercial or Manufacturing Property” sponsored by Council Members Rachel S. Toppi and Michael P. Iannotti.

 

B.  Conduct a public hearing to consider and act upon amendments to Chapter 305 of the Code of Ordinances entitled “Stone Wall Protection and Preservation” to amend Sections 305-3 and 305-4 and adopt Section 305-7 sponsored by Council Member Sean M. Kilduff.

 

C.  Consider, discuss, and act upon approving a new B-Victualler Liquor License for BKH, LLC d/b/a “Jack’s Pizza Pub”, 970 Douglas Pike, Bldg. A, Unit 2, to include outdoor seating/bar service, with the hours of operation to be Monday through Sunday 6:00 a.m. to 1:00 a.m., as applied, subject to compliance with all State regulations, local ordinances, final approval from the RI Department of Health, a copy of the Retail Sales Permit, Certificate of Good Standing from the RI Division of Taxation and a drawing of the outdoor seating area.

 

IX.       Licenses: 

 

A.  Consider, discuss, and act upon approving a new Victualling License for BKH, LLC d/b/a “Jack’s Pizza Pub”, 970 Douglas Pike, Bldg. A, Unit 2, with the hours of operation to be Monday through Sunday from 6:00 a.m. to 1:00 a.m., as applied, subject to compliance with all State regulations, local ordinances, final approval from the RI Department of Health, a copy of the Retail Sales Permit.

 

B.  Consider, discuss, and act upon approving a new Entertainment License for BKH, LLC d/b/a “Jack’s Pizza Pub”, 970 Douglas Pike, Bldg. A, Unit 2 as applied, subject to compliance with all State regulations and local ordinances.

 

C.  Consider, discuss, and act upon approving a new Solicitation License for “Power Home Remodeling Group”, soliciting home improvement solutions, as applied, subject to compliance with all State regulations, local ordinances, and the following conditions: The Smithfield Police Department is to be notified each time the applicant is soliciting, including which area of Town solicitation will take place.  Solicitation may take place between the hours of 9:00 a.m. to 7:00 p.m. only.  If conditions of the license are not adhered to, the applicant will be required to appear before the Town Council.

 

D.  Consider, discuss, and act upon approving the annual renewal of one (1) Pool Table License, as applied, subject to compliance with all State regulations and local ordinances.

 

1.   Bryant University Fisher Student Center, 1150 Douglas Pike (one pool table)

 

E.   Consider, discuss, and act upon approving a new Peddler’s License for Palagi 2000, Inc. d/b/a “Palagis Ice Cream, to sell frozen treats from a truck with RI Reg.# 109950, 55 Bacon Street, Pawtucket, RI, subject to compliance with all State regulations and local ordinances.

 

X.        Old Business:  None.

 

XI.       New Business:     

 

A.  Consider, discuss, and act upon authorizing the Town Manager to enter into contract, through the Metropolitan Area Planning Council as Agent for the Greater Boston Police Council, with Allegiance Trucks, LLC of Warwick, RI for the purchase of one (1) new international HV607 41,000 GVW Cab and Chassis truck for one hundred twenty-three thousand, four hundred eighty-one dollars and eighteen cents ($123,481.18).

 

B.  Consider, discuss, and act upon adopting a resolution authorizing the financing of the purchase of a GVW Cab and Chassis truck through the Smithfield Capital Lease Fund.

 

C.  Sitting as the Smithfield Water Supply Board, consider, discuss and act upon a request for waiver of water main extension based on the Code of Ordinances, Chapter 350 Water Line Extensions, Article 1 Construction of Waterlines and Other Water Capital Equipment by Private Developers, Section 350-1 Extension of Water Service Article 1.C.

 

D.  Consider, discuss, and act upon a bid award for interior painting at the Town Hall.

 

E.   Consider, discuss, and act upon authorizing the Town Manager to enter into a contract, through the RI Master Price Agreement, with the lowest qualified bidder for a grandstand and press box for the Boyle Athletic Complex.

 

F.   Consider, discuss, and act upon adopting a resolution to place Smithfield Land Trust, recreation, and open space properties in a Municipal Public Trust sponsored by Council Members Rachel S. Toppi and Michael P. Iannotti.
