TOWN OF SMITHFIELD, RHODE ISLAND

PUBLIC HEARING

 

NOTICE IS HEREBY GIVEN that the Smithfield Town Council will hold a Public Hearing at the Smithfield Town Hall, 64 Farnum Pike, Smithfield, RI on Tuesday, February 4, 2025 at 7:00 PM.  The purpose of the Public Hearing is to consider and act upon a proposed amendment to the following Article(s) and Section(s) of the Smithfield Zoning Ordinance as summarized below:

           

      Summary:  Amendments are proposed to ARTICLE 9- Special District which adds a new overlay district entitled “Davis Liquid Waste Superfund Site - Groundwater Protection Overlay District” which will prohibit the use of groundwater for irrigation or potable purposes in an area including and proximate to the Davis Liquid Waste Superfund Site at 167 Tarkiln Road.   

     

The specific amendment proposed will add a new section entitled, “Article 9.5 Contaminated Groundwater Overlay District” containing the following subsections: Section 1. “Legislative Intent”; Section 2. “Prohibition of Use of Groundwater for Irrigation or Potable Purposes”; Section 3. “Enforcement”; Section 4. “Exemptions”; Section 5. “District Boundary Disputes”; Section 6. “Notification”; Section 7. “Conflicting Provisions”; Section 8. “Saving Clause;      Section 9. “Effective Date”, and “Figure 1- Groundwater Overlay District 2021”

 

At said Hearing opportunity will be given to all interested persons to be heard upon the proposed amendments.  The proposals shown hereon may be altered or amended prior to the close of the Public Hearing, without further advertising, as a result of further study or because of the views expressed at the Public Hearing. Any alteration or amendment must be presented for comment in the course of the Hearing. 

 

A complete copy of the proposed ordinance is available for inspection or copying at the Smithfield Planning Office, Town Hall, 64 Farnum Pike, Smithfield, Rhode Island during regular business hours (8:30 AM – 4:30 PM, Monday – Friday) and may be viewed on the Town website, www.smithfieldri.com. Interested persons requiring special accommodations or assistance are requested to notify the Town Manager's Office (401-233-1010) 48 hours in advance of the meeting.
