At a WORK SESSION of the Town Council of the Town of South Kingstown, County of Washington, in the State of Rhode Island held at the Town Hall, in and for said Town on the 27th day of November 2017 at 6:45 PM.

The Town Manager reviews the upcoming meetings schedule. The School Committee will meet on December 5th to approve the Vision Statement for the Facilities Study: Council members are invited to attend. The Town Council will hold one Regular Session next month on December 11th, and the Initial Budget Hearing with the School Committee is set for December 18th. The Town Christmas party will be December 19th. Additional School Committee meetings on the facilities plan are scheduled for January 16, January 30 and February 6, 2018.
Discussion ensues relative to Public Hearing Item 7A in regard to an application for renewal of an Indoor Shooting Range License in accordance with the South Kingstown Town Code, Chapter 9 Licenses and Miscellaneous Business Regulation, Article VI Indoor Shooting Ranges. Application by IDGR15, LLC d/b/a Peace Dale Indoor Gun Range, by Mark A. Fay, Member for property located at 132 Pearl’s Way, Wakefield, RI 02879 and designated as Assessor’s Plat 33, Lot 30, consisting of 121.57 acres. The ordinance limits the hours of operation to between 8 AM and 9 PM: the application lists hours in excess of that but Mr. Fay has agreed to correct that this evening.
Discussion ensues relative to removing Communication Item 8B from the Consent Agenda because Jim O’Neill is present and intends to speak on this issue.
Discussion ensues relative to New Business Item 13A, a resolution to allow the number of authorized liquor licenses to be amended due to the closure of Chen’s Restaurant and La Strada Wood Fired Pizza.

Background information relative to this Public Hearing concerning an application for renewal of an Indoor Shooting Range License by IDGR15, d/b/a Peace Dale Indoor Gun Range, 130 Pearl's Way, Wakefield was previously distributed to the Town Council with the November 9, 2017 Town Manager's Report, Agenda Item I 13K.
Attorney Mark Fay is present along with Sven Soderberg and discusses the application, requesting that the address be corrected to 132 Pearl’s Way.
Discussion ensues relative to the ordinance limitation on operating hours from 8 AM to 9 PM, in contrast to the application request for 10 PM closing. Mr. Fay advises that they will have meeting facility space and other club uses at the facility. Town Solicitor Michael Ursillo advises that they may need to request an expansion of the Town ordinance to reflect the additional uses and hours of operation. Further discussion ensues, and it is

A. Discussion ensues, and it is 
UNANIMOUSLY VOTED: that a communication dated November 9, 2017 from John F. Pacheco III, President, Burrillville Town Council concerning the Energy Facility Siting Board’s (EFSB) suppression of municipal resolutions opposing Invenergy’s proposed siting of the Clear River Energy Center power plant in that town, and advising of upcoming EFSB hearings for public comment is received, placed on file, and the Town Council reaffirmed its opposition. (11/16/2017 Interim, Item C.)
B. Jim O’Neill is present and speaks at length regarding his concerns over construction by the South Shore Village and Country Club, suggesting an injunction on the issuance of building permits. Town Solicitor Michael Ursillo discusses his firm’s review of the history of this development which started as a manufactured home park and is converting to condominium ownership. The form of ownership was not specified in Town approvals, and the Department of Business Regulation has no jurisdiction because it’s a manufactured home park. Four building permits were inadvertently issued for stick-built homes. Further discussion ensues, and it is 
UNANIMOUSLY VOTED: that a communication dated November 21, 2017 from James W. O’Neill providing additional background information concerning construction by the South Shore Village and Country Club, formerly known as the South County Country Club is received, placed on file and referred to the Town Solicitor. Council President Healy invites residents to come forward with comments.
Jim O’Neill asks for clarification of a comment by the Town Solicitor: Mr. Ursillo reiterates that there have been no complaints to the Town regarding the South Shore Village and Country Club development. Mr. O’Neill then comments on the Capital Budget and School Committee budget and facilities study.

Town Manager Stephen Alfred notes the Town will receive a Watershed Restoration Grant from RIDEM, and that the Town has received the Distinguished Budget Presentation Award for the FY 2017-2018 budget from the Government Finance Officers Association. The Town Manager’s Interim Report dated November 16, 2017, and the Agenda and Miscellaneous Reports dated November 22, 2017 are accepted, approved and placed on file.

UNANIMOUSLY VOTED: to reject all bids received on September 25, 2017 for the Animal Shelter Exterior Painting project; as further described in a memorandum from the Facilities Superintendent to the Town Manager dated November 16, 2017 and entitled “Bid Award – Animal Shelter Post and Beam Rehabilitation.” 
D. UNANIMOUSLY VOTED: to authorize an award of bid to M & J Construction, 8 Zoar Street, Johnston, RI 02919 for the Animal Shelter Post and Beam Rehabilitation project, in accordance with all bid specifications, in an amount not to exceed $28,175, including a $2,500 contingency; and as further described in a memorandum from the Facilities Superintendent to the Town Manager dated November 16, 2017 and entitled “Bid Award – Animal Shelter Post and Beam Rehabilitation.” 
E. Discussion ensues relative to the CDBG program and the decision by the Town of East Greenwich to end its role as host community for the program. Geoff Marchant, head of the East Greenwich Consortium who has led the program for many years is present and notes his impending retirement and the continuation of the CDBG program. Following further discussion, it is 
UNANIMOUSLY VOTED: to authorize the filing of an application for the Program Year 2017 Community Development Block Grant program for an annual estimated amount of $100,000 to implement the activity of a local housing rehabilitation program, and authorizing the Town Manager to provide any additional information or documents required by the Office of Housing and Community Development, to make any assurances required in connection with this program, to execute an agreement with the State of Rhode Island, and to otherwise act as the Representative of the Town of South Kingstown in all matters relating to this application and any award which may be based upon this application; as further described in a memorandum from the Senior Planner to the Town Manager dated November 15, 2017 and entitled “Community Development Block Grant – Program Year 2017 Application Process.”
F. UNANIMOUSLY VOTED: to authorize an award of bid to Brunswick Commercial & Government Products, Inc., 420 Megan Z Avenue, Edgewater, FL 32132 for the purchase of a Boston Whaler 17’ Guardian model patrol boat, motor and trailer package in a total amount not to exceed $49,993; and as further described in a memorandum from the Harbormaster to the Town Manager dated November 14, 2017 and entitled “Bid Recommendation – Harbor Patrol Boat Replacement – SK0029PD.” 
G. UNANIMOUSLY VOTED: to authorize the submittal of an application to the Rhode Island Department of Environmental Management for funding through the 2018 Recreation Acquisition and Development grant program, for the purpose of replacing playground equipment at West Kingston Park; as further described in a memorandum from the Director of Leisure Services to the Town Manager dated November 21, 2017 and entitled “RIDEM 2018 Recreation Acquisition and Development Grant Application.” 
H. UNANIMOUSLY VOTED: to authorize an award of contract to VHB, Inc., 1 Cedar Street, Suite 400, Providence, RI 02903 for consulting services to update the Town of South Kingstown Multi-Hazard Mitigation Plan, in an amount not to exceed $25,269; and as further described in a memorandum from the Director of Planning to the Town Manager dated November 20, 2017 and entitled “Recommendation on Award of Contract, Consulting Services to Update the Town’s Multi-Hazard Mitigation Plan.” 
I. UNANIMOUSLY VOTED: to authorize the Town Manager to execute a letter of support relative to the Rhode Island Commerce Corporation application to the U.S. Foreign-Trade Zones Board, which would include inclusion of South Kingstown within the Service Area of Foreign-Trade Zone No. 105; as further described in a memorandum from the Director of Planning to the Town Manager dated November 20, 2017 and entitled “Letter of Support for RI Commerce Corporation Foreign Trade Zone (FTZ) Application.”
